The City's Negotiating Team and NBFA representatives have
completed discussions regarding a comprehensive MOU which reflects
the agreement reached as a result of the meet and confer process
prior to, and after, July 1, 1993. As you know, we are trying to
develop comprehensive MOU's for each association to serve as a
baseline for subsequent negotiations.
Staff recommends the City Council approve the proposed MOU and
authorize the Mayor and City Clerk execute the agreement.

SUBJ: Fire Department MOU
The City's Negotiating Team and NBFA representatives have
discussed, and tentatively agreed to, certain minor modifications
to the proposed comprehensive MOU. These tentative minor
modifications can be summarized as follows:
1.. Section 1(D) Tiould be modified to specifically permit E -Mail_
to be used for Association business on a limited basis and
consistent with Department Policy. This. is consistent with
current practice; .
2._ Section 2(A)(1) would be amended so that salary increases
scheduled to become effective on. January 1, 1995 -would become
effective at the beginning of last pay period of 1994 - this
change was requested by the Finance Director, is consistent
with past practice, and will facilitate payroll calculations;
3. Section 2•(A)(7) (Internal Adjustments) would be modified to
include Fire -Specialist III at 125% of Firefighter_and .clarify_
that Staff Captains-receive..a 7 1/2% bonus;
4. Section 2(A)(9) would be modified to reduce the permitted
accumulation of Vacation Leave to be consistent with current
practice;
5. Section. 2 (B) (2) (a) would be modified so that Holiday time
would be added to a member's Flex Leave or Vacation Leave
account on a bi-weekly basis which will facilitate payroll
calculations and accounting;
6. Section 4(B) (3) would be modified to explain the rationale for -
the difference between disability benefits for industrial and
non -industrial injuries - industrial injury payments are less
because City supplements industrial disabilities and
Firefighters are entitled to full salary pursuant to Section
4850 of the Labor Code;
7. Section 5(I)(2)(c) would be modified to increase, from three
working days to seven working days, the time within which an
.employee must notify the Fire Chief of his or her intention to
exercise bumping rights.
It is recommended that the City Council approve the MOU with
the modified terms and conditions described in this memorandum.
