SUBJ: MEET -AND -CONFER FY 83/84.- NEWPORT BE9A0H- MPLOYEES LEAGUE (NBEL) Background: The City Negotiating Team and representatives of the Employees League (NBEL), City field crews, have been conducting meet - and -confer sessions in an effort to reach an agreement for Fiscal Year 1983/84. The representatives for both negotiating teams have been unable to reach an agreement. Discussion: In accordance with the City Council's instruction, the its' y's_Tinal offer was as follows: 1. Total compensation: 6.0% 2. Salary increase: .5% across-the-board 3. PERS Pick-up: at the Newport Beach Employee League's request, and in lieu of a proportionate salary increase, the City offered to pay the additional 3.5% employees' Public Employees Retirement System (PERS) contribution, not to exceed a maximum of 7.0%. The payment of the employees' contribution will be credited to the individ- ual employee's account. 4. Family Sick Leave: Employees will be allowed to use one (1) additional eight (8) hour day of accrued sick leave per calendar year for an illness of spouse, son or daughter which requires the presence of the employee. The City's final offer was presented to and rejected by the Newport Beach Employees League Association. It should be noted that the contents of the City's final offer is acceptable to the Association. The point of disagreement is based upon the Association's position that the General Services Department, excluding the Refuse Division, be placed on a similarly modified workshift and week as the Utility and Parks, Beaches and Recreation Departments. Currently, the General Services Department works the traditional eight (8) hour day, five (5) days a week. The total hours worked in a two-week payroll period is eighty (80) hours. The Utility and Parks, Beaches and Recreation Departments' workshift and work week consists of a modified work shift and work week as indicated below. Total Week 1- 9 9 9 9 8 44 Week 2- 9 9 9 9 -0- 36 In both the traditional and modified workshift and week schedules, the respective Department Directors evaluate and recommend to the City Manager for his approval of the workshift and week schedule. It is the City's position that a change in workshift and/or week schedule in the General Services Department is at the recommendation of the General Services Director to the City Manager for approval. Recommendation: Based on the discussion of this report, it is recommended that the attached Resolution be approved which would im- plement the following effective July 9, 1983: 1. July 9, 1983, to June 22, 1984. 0 0 RESOLUTION NO. 8 3 - 8 0 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING AN INCREASE IN COMPENSATION FOR MEMBERS OF THE NEWPORT BEACH EMPLOYEES LEAGUE WHEREAS, pursuant to the provisions of Government Code Section 3505 and of Resolution NO. 7173 of the City of Newport Beach, through its negotiating teairc, has, on numerous occasions, met and conferred, in good faith, with representatives of the Newport Beach Employees League (NBEL) concerning salaries, benefits and other terms and conditions of employment for fisal year 1983-1984; and WHEREAS, the City of Newport Beach and the Newport Beach Employees League (NBEL) have been able to reach an agreement as to the salaries and benefits but have been unable to reach an agreement as to other terms and conditions of employment to be accorded members of Newport Beach Employees League (NBEL) during the fiscal year 1983-1984; and WHEREAS, the City Council of the City of Newport Beach is desirous of implementing, unilaterally, its final proposal to the Newport Beach Employees League (NBEL) for increasing compensation paid to its members; and WHEREAS, the current Memorandum of Understanding between the City of Newport Beach and the Newport Beach Employees League (NBEL) expired on June 24, 1983; and WHEREAS, the final offer of the City of Newport Beach to the Newport Beach Employees League (NBEL) for increased compensation and benefits called for a 6.08 increase in total compensation. 3 j 0 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the total compensation package for the members of the Newport Beach Employees League (NBEL) for fiscal year 1983-1984, effective July 9, 1983 to June 22, 1984 shall be as follows: 1. Total Compensation: 6.08 2. Salary Increase: .58 across-the-board. The salary ranges for the members of Newport Beach Employees' League, shall be as set forth in Appendix "A" which is attached hereto and incorporated herein by reference. 3. PERS Pickup: 4. Family Sick Leave: �d BE IT FURTHER RESOLVED At the Newport Beach Employees' League request and in lieu of a proportionate salary increase, the City shall pay the additional 3.58 employees' Public Employees Retirement System (PERS) contribution, not to exceed a maximum of 7.0%. The payment of the employees' contribution will be credited to the individual employee's account. Amend current provision to provide that employees will be allowed to use one (1) additional eight (8) hour day of accrued sick leave per calendar year for illness of spouse, son or daughter who requires the presence of the employee. that all other terms and conditions of employment of all affected employees pursuant to the provisions contained in the Memorandum of Understanding between the City of Newport Beach and members of the Newport Beach Employees League (NBEL) shall remain unchanged and in full force during fiscal year 1983-1984 as hereinabove described.
