TITLE: Ordinance No. 2021-17: Amending the LCP Implementation Plan
Related to Setback Maps S -3A and S -3B on Lido Isle (PA2016-066)
ABSTRACT:
On September 26, 2017, the City Council adopted amendments to Title 20 (Planning and
Zoning) of the Newport Beach Municipal Code (NBMC) correcting setback maps affecting
eight residential properties on Lido Isle. The errors occurred during the 2010 Zoning Code
update, where the City of Newport Beach (City) inadvertently labeled eight properties
incorrectly on Setback Maps S -3A and S -3B. Since the errors were also included in the
City's 2017 certification of Title 21 (Local Coastal Program Implementation Plan), a Local
Coastal Program (LCP) amendment is also required. On September 14, 2018, the
California Coastal Commission approved the Title 21 amendments with no modifications.
This agenda item requests City Council introduction of an ordinance adopting LCP
Amendment No. LC2017-004, which will revise Title 21 consistent with the California
Coastal Commission approval. Approval of the proposed ordinance will also make the
setback maps in Title 21 consistent with the zoning setback maps provided in the Zoning
Code.
RECOMMENDATION:
a) Find this amendment exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15305 of the CEQA Guidelines, Class 5 (Minor Alterations in Land
Use Limitations) because it has no potential to have a significant impact on the
environment; and
b) Waive full reading, direct the City Clerk to read by title only, introduce Ordinance
No. 2021-17, An Ordinance of the City Council of the City of Newport Beach,
California, Amending Title 21 (Local Coastal Program Implementation Plan) of the
Newport Beach Municipal Code and Adopting Local Coastal Program Amendment
No. LC2017-004 Related to Certain Front Yard and Side Yard Setbacks on Lido Isle
(PA2016-066), and pass to second reading on September 28, 2021.

DISCUSSION:
Background
In 2010, the City substantially updated the Zoning Code. The update included digitizing
historic, hand -drawn maps (previously known as "districting maps") that identified
setbacks for many properties. These digitized maps are now referred to as "setback
maps" in the current Zoning Code and Local Coastal Program Implementation Plan (IP).
Setback Maps S -3A and S-313 apply to Lido Isle properties. During the Code update and
transition in map format, eight properties were inadvertently labeled incorrectly on
Setback Maps S -3A and S-313. In seven of the eight cases, setbacks labeled on the new
setback maps were not referenced on the historic districting maps. In one case (335
Piazza Lido), a front setback was labeled unclearly. Changes to setbacks on Lido Isle
were not contemplated during the 2010 Zoning Code update and in digitizing the maps,
the intent was to carry forward the same historic zoning and setbacks rather than to alter
or add to them. The subject amendments affect eight properties located on Lido Isle as
identified in Figure 1 below.

The City Council conducted a public hearing and considered the amendments at its
September 12, 2017 meeting and unanimously voted to introduce Ordinance No. 2017-
13, correcting the setbacks in the Zoning Code (Title 20). The September 12, 2017 City
Council staff report is included as Attachment B for reference. The City Council ultimately
adopted Ordinance No. 2017-13 on September 26, 2017, formally correcting the setback
maps in Title 20.
Summary of Title 21 Amendment
Properties located in the Coastal Zone of the city are regulated by the Local Coastal
Program (LCP), which is comprised of the Coastal Land Use Plan (CLUP), a policy
document, and the IP (also called Title 21), a regulatory document. Any amendments to
the LCP must be reviewed and approved by the City Council, with a recommendation
from the Planning Commission, prior to submitting the amendment request to the Coastal
Commission for review and approval.
Corrections to Setback Maps S -3A and S-313 contained within Title 21 (Local Coastal
Program Implementation Plan) of the NBMC are needed for consistency with the adopted
changes to Title 20. On September 12, 2017, the City Council adopted Resolution No.
2017-59 (Attachment C), authorizing submittal of LCP Amendment No. LC2017-004 to
the California Coastal Commission (CCC) for review and approval. The resolution
specified LCP Amendment No. LC2017-004 shall not become effective until approval by
the CCC and adoption, including any modifications suggested by the CCC, by resolution(s)
and/or ordinance(s) of the City Council.
On September 14, 2018, the CCC approved LCP Amendment No. LC2017-004 with no
modifications (Attachment D). As a result, the amendment is now considered deemed
approved and became a certified part the City's Local Coastal Program; however, full
implementation requires the adoption of the recommended ordinance. The item was
originally set aside after CCC approval due to City staff retiring and transitioning to a new
project manager. No project has been affected due to the delay in bringing the item back
to City Council for their consideration. The proposed action will complete the final step in
correcting the setback maps for the affected properties and will result in consistency
between both Title 20 and Title 21 setbacks maps.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW
The amendment is categorically exempt under Section 15305, of the California
Environmental Quality Act (CEQA) Guidelines — Class 5 (Minor Alterations in Land Use
Limitations). The Class 5 exemption allows minor alterations in land use limitations in
areas with an average slope of less than 20 percent and which do not result in any
changes in land use or density. In this case, the eight lots affected by the amendment
have an average slope of less than 20 percent; the amendment will not change the land
use category or zoning district of the affected lots; and the maximum number of dwelling
units per lot will not change.

NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
Notice of the September 12, 2017, City Council hearing where this amendment was
originally considered and approved for submittal to the California Coastal Commission
was published in the Daily Pilot, mailed to all owners of property within 300 feet of the
boundaries of the site (excluding intervening rights-of-way and waterways) and posted on
the subject properties at least 10 days before the scheduled meeting, consistent with the
provisions of the Municipal Code.
Lastly, pursuant to Section 13515 of the California Code of Regulations, a review draft of
the Local Coastal Program Amendment was made available, and a Notice of Availability
was distributed on July 6, 2017, to all persons and agencies on the Notice of Availability
mailing list.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, AMENDING TITLE 21
(LOCAL COASTAL PROGRAM IMPLEMENTATION PLAN)
OF THE CITY OF NEWPORT BEACH MUNICIPAL CODE
RELATED TO THE AMORTIZATION OF
NONCONFORMING SIGNS (PA2019-0184)
WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the
City Council with the authority to make and enforce all laws, rules and regulations with
respect to municipal affairs subject only to the restrictions and limitations contained in
the Charter and the State Constitution, and the power to exercise, or act pursuant to
any and all rights, powers, and privileges or procedures granted or prescribed by any
law of the State of California;
WHEREAS, Section 30500 of the California Public Resources Code requires
each county and city to prepare a local coastal program for the portion of the coastal
zone within its jurisdiction,
WHEREAS, in 2005, the City adopted the City of Newport Beach Local Coastal
Program Coastal Land Use Plan ("LCP") as amended from time to time including most
recently on February 12, 2019, via Resolution No. 2019-16;
WHEREAS, the California Coastal Commission effectively certified the City's
Local Coastal Program Implementation Plan on January 13, 2017, and the City Council
adopted Ordinance No. 2016-19 adding Title 21 (Local Coastal Program
Implementation Plan) ("Title 21") to the Newport Beach Municipal Code ("NBMC")
whereby the City assumed coastal development permit -issuing authority as of January
30, 2017;
WHEREAS, Sections 20.42.140 (Nonconforming Signs) and 21.30.065 (Signs) of
the NBMC require certain signs that do not conform to the sign regulations to be abated
within 15 years ("Amortization Period") from the effective date of the sign code update;
WHEREAS, the Amortization Period was set to expire on October 27, 2020, at
which time all nonconforming signs were to be removed;
WHEREAS, on October 22, 2019, the City Council adopted Resolution No. 2019-
92 initiating amendments to Title 20 (Planning and Zoning) ("Title 20") and Title 21
(Local Coastal Program Implementation Plan) ("Title 21") related to signs including
extending the Amortization Period;

WHEREAS, on March 15, 2020, the City proclaimed a local emergency due to
the COVID-19 global pandemic;
WHEREAS, due to the extreme peril upon personal safety that is based on the
existence or threatened existence of COVID-19 within and/or around the City, many
businesses have been forced to reduce services or temporarily close;
WHEREAS, pursuant to Section 13515 (Public Participation and Agency
Coordination Procedures) of the California Code of Regulations, Title 14, Division 5.5,
Chapter 8, review of the draft LCP Amendment was made available and a Notice of the
Availability was distributed on November 6, 2020, which is a minimum of six (6) weeks
prior to the final action date;
WHEREAS, a telephonic public hearing was held by the Planning Commission on
May 7, 2020, in the Council Chambers located at 100 Civic Center Drive, Newport Beach,
California, observing restrictions due to the Declaration of a State Emergency and
Proclamation of Local Emergency related to COVID-19. A notice of time, place and
purpose of the public hearing was given in accordance with the California Government
Code Section 54950 et seq. ("Ralph M. Brown Act") and Chapters 20.62 and 21.62
(Public Hearings) of the NBMC. Evidence, both written and oral, was presented to, and
considered by, the Planning Commission at this public hearing;
WHEREAS, at the conclusion of the public hearing, the Planning Commission
adopted Resolution Nos. PC2020-015 and PC2020-016 by a majority vote (7 ayes, 0
nays) recommending the City Council eliminate the Amortization Period;
WHEREAS, a public hearing was held by the City Council on June 23, 2020, in
the Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A
notice of time, place and purpose of the public hearing was given in accordance with the
Ralph M. Brown Act and Chapters 20.62 and 21.62 (Public Hearings) of the NBMC.
Evidence, both written and oral, was presented to, and considered by, the City Council at
this public hearing;
WHEREAS, on June 23, 2020, the City Council adopted Resolution No. 2020-66
to initiate the General Plan Amendment and Coastal Land Use Plan Amendment to
eliminate the Amortization Period,

WHEREAS, a telephonic public hearing was held by the Planning Commission on
November 19, 2020, in the Council Chambers located at 100 Civic Center Drive, Newport
Beach, California, observing restrictions due to the Declaration of a State Emergency and
Proclamation of Local Emergency related to COVID-19. A notice of time, place and
purpose of the public hearing was given in accordance with Ralph M. Brown Act and
Chapters 20.62 and 21.62 (Public Hearings) of the NBMC. Evidence, both written and oral,
was presented to, and considered by, the Planning Commission at this public hearing;
WHEREAS, at the conclusion of the public hearing, the Planning Commission
adopted Resolution Nos. PC2020-042 and PC2020-043 by a majority vote (7 ayes, 0
nays) recommending the City Council approve Zoning Code Amendment No. CA 2019-
007 and LCP Amendment No. LC2019-005 to eliminate the Amortization Period;
WHEREAS, a telephonic public hearing was held by the City Council on February
23, 2021, in the Council Chambers located at 100 Civic Center Drive, Newport Beach,
California, observing restrictions due to the Declaration of a State Emergency and
Proclamation of Local Emergency related to COVID-19. A notice of time, place and
purpose of the public hearing was given in accordance with the Ralph M. Brown Act and
Chapter 21.62 (Public Hearings) of the NBMC. Evidence, both written and oral, was
presented to, and considered by, the City Council at this public hearing;
WHEREAS, on February 23, 2021, the City Council introduced Ordinance No.
2021-05 revising Title 20 (Planning and Zoning) to eliminate the amortization of
nonconforming signs (Code Amendment No. CA2019-007) and adopted Resolution No.
2021-16 to eliminate the amortization of nonconforming signs as set forth in the General
Plan and adopted Resolution No. 2021-17 authorizing submittal of LCP Amendment No.
LC2019-005 to the California Coastal Commission by a unanimous vote (6 ayes, 0
nays); and
WHEREAS, on July 7, 2021, the California Coastal Commission approved LCP
Amendment No. LC2019-005 (LCP-5-NPB-21-0036-1 Part B) with no modifications. As
a result, LCP Amendment No. LC2019-005 is now deemed approved and became a
certified part of the City's Local Coastal Program.
NOW THEREFORE, the City Council of the City of Newport Beach ordains as
follows:
Section 1: Section 21.30.065(E) (Signs) of Title 21 (Local Coastal Program
Implementation Plan) of the NBMC shall be deleted in its entirety.

Section 2: The LCP, including LCP Amendment No. LC2019-005, shall be
carried out in full conformance with the California Coastal Act.
Section 3: The recitals provided in this ordinance are true and correct and are
incorporated into the substantive portion of this ordinance.
Section 4: If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed this ordinance and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 5: The City Council finds the introduction and adoption of this
ordinance is exempt pursuant to California Environmental Quality Act ("CEQA")
Guidelines Section 15061(b)(3), the general rule that CEQA applies only to projects,
which have the potential for causing a significant effect on the environment. While LCP
Amendment No. LC2019-005 would allow existing legal nonconforming signs to remain
in place, it does not authorize new development that would directly result in physical
change to the environment. There is no evidence that removal of the Amortization
Period would result in any new effects on the environment. Additionally, pursuant to
CEQA Guidelines Section 15265(a)(1), local governments are exempt from the
requirements of CEQA in connection with the adoption of a Local Coastal Program.
None of the exceptions listed in Section 15300.2 of the CEQA Guidelines are applicable.
Section 6: Except as expressly modified in this ordinance, all other sections,
subsections, terms, clauses and phrases set forth in the NBMC shall remain unchanged
and shall be in full force and effect.
Section 7: The Mayor shall sign and the City Clerk shall attest to the passage
of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be
published pursuant to City Charter Section 414.

The subject amendments affect eight properties located on Lido Isle; seven are located
north of Piazza Lido and one is located south of Piazza Lido, and all have frontages on
Piazza Lido. The lots are within the R-1 (Single Unit Residential) Zoning District, which is
intended to provide for single unit residential land uses. Table 1 provides General Plan
and zoning information.

Pursuant to Section 20.66.020 of the Newport Beach Municipal Code (NBMC), the
Planning Commission initiated the code amendment on July 11, 2016.
Plannina Commission Recommendation
The Planning Commission determined that the Code Amendment is necessary to correct
the error and adopted Resolution Nos. 2061 and 2062 on July 6, 2017 (Attachment C),
recommending approval of the Code Amendment to the City Council. The Planning
Commission meeting minutes and staff report, which includes a detailed analysis, are
contained in Attachment D.
Local Coastal Program
The Implementation Plan of the Local Coastal Program (LCP) includes setback maps
identical to those in the Zoning Code. Therefore, subsequent to the Council adoption of
the Zoning Code Amendment, staff will submit corresponding amendments to the LCP
for review and approval of the California Coastal Commission to ensure consistency
between both regulatory documents.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, AUTHORIZING THE
SUBMITTAL OF LOCAL COASTAL PROGRAM AMENDMENT
NO. LC2017-004 TO THE CALIFORNIA COASTAL
COMMISSION AMENDING THE NEWPORT BEACH
MUNICIPAL CODE RELATED TO CERTAIN FRONT YARD AND
SIDE YARD SETBACKS (PA2016-066)
WHEREAS, pursuant to Newport Beach Municipal Code ("NBMC") Section
20.66.020 the Planning Commission initiated a code amendment on July 11, 2016, to
amend side and front setbacks for eight residential properties located on Lido Isle,
consistent with historic front and side yard setbacks for these properties;
WHEREAS, following adoption of the City of Newport Beach's ("City")
comprehensive 2010 Zoning Code update, City staff discovered that front setbacks were
left unclarified and/or inadvertently placed on setback maps S -3A and S-313 Lido Isle in
NBMC Section 20.80.040 ("Setback Maps") for residential properties located at 203 Via
Ithaca and 300, 328, 332, 335, 408, 412 and 416 Piazza Lido;
WHEREAS, on July 6, 2017, the Planning Commission conducted a public hearing
in the City Hall Council Chambers located at 100 Civic Center Drive, Newport Beach,
California to consider this amendment. A notice of time, place and purpose of the public
hearing was given in accordance with the NBMC and Ralph M, Brown Act. Evidence,
both written and oral, was presented to, and considered by, the Planning Commission at
this public hearing;
WHEREAS, at the July 6, 2017, public hearing, the Planning Commission received
public comments and written staff reports, and on an affirmative motion (6 ayes, 1 absent,
and 0 noes), forwarded a recommendation to the City Council to approve the proposed
amendment;
WHEREAS, the City Council conducted a public hearing on September 12, 2017, in
the Council Chambers located at 100 Civic Center Drive, Newport Beach to consider this
Amendment. A notice of time, place and purpose of the public hearing was given in
accordance with the NBMC. Evidence, both written and oral, was presented to, and
considered by, the City Council at this public hearing;
WHEREAS, following this proposed amendment, the subject properties will remain
consistent with the General Plan, Coastal Land Use Plan, and Zoning Code designation
of Single -Unit Residential (R-1);
WHEREAS, the standard side setback for properties over forty feet in width and
zoned Single -Unit Residential (R-1) is four feet pursuant to NBMC Section 20.18.030
Table 2-2, unless a different distance is depicted on a setback map;

WHEREAS, if a setback is depicted on a setback map, it is regulated as a front
setback. Prior to the 2010 Zoning Code update, the historic districting map acted as a
setback map. When the Setback Maps were created as a part of the 2010 Zoning Code
update, property lines on seven residential properties, previously regulated as side
setbacks, were labeled as front setbacks. This discrepancy was inadvertent and this code
amendment corrects the prior error;
WHEREAS, in the creation of the Setback Maps, the front setback adjacent to Via
Firenze for the property at 335 Piazza Lido was left unclear. This ambiguity was
inadvertent, and the Setback Maps intended to identify the four foot front setback
identified on the historic map, DM6;
WHEREAS, amending the setback map to reinstate the side yard setbacks and
clarify front setbacks does not result in a significant change to the existing development
pattern of the neighborhood since the properties were developed with these standards,
thus, this code amendment allows the properties to maintain their existing uses and
remain consistent with adjacent properties; and
WHEREAS, pursuant to Section 13515 of Title 14, Division 5.5, of the California
Code of Regulations, review drafts of the Local Coastal Program Implementation Plan
("LCP") Amendment No. LC2017-004 were made available and a notice of the availability
was distributed a minimum of six weeks prior the City Council public hearing.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby authorize City staff to submit LCP
Amendment No. LC2017-004 to the California Coastal Commission for review and
approval, as attached in Exhibit A, and incorporated herein by reference.
Section 2: LCP Amendment No. LC2017-004 shall not become effective until
approval by the California Coastal Commission and adoption, including any modifications
suggested by the California Coastal Commission, by resolution(s) and/or ordinance(s) of the
City Council of the City of Newport Beach.
Section 3: The City certifies the LCP including the proposed amendment is
intended to be carried out in a manner fully in conformity with the California Coastal Act.
Section 4: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 5: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council
hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

Section 6: This action is exempt from environmental review under Section 15305,
of the California Environmental Quality Act (CEQA) Guidelines — Class 5 (Minor
Alterations in Land Use Limitations) because the residential properties affected by this
amendment have an average slope of less than 20 percent; the amendment will not
change the land use category or zoning district of the affected residential properties; and

You are hereby notified that the California Coastal Commission, at its September 14, 2018
meeting in Fort Bragg, approved as submitted City of Newport Beach LCP Amendment No. 4-17
Part A. The LCP amendment will be fully effective upon filing of the notice of the
Commission's certification with the Secretary of the Resources Agency as provided by Public
Resources Code Section 21080.5(d)(2)(v).
LCP Amendment No. 4-17 Part A, which was submitted pursuant to City Council Resolution
2017-59, amends the LCP's Implementation Plan (IP) in order to correct mapping errors to
Setback Maps S -3A and S-313 (Lido Isle) for eight inland residential properties on Lido Isle. The
subject properties are: 203 Via Ithaca and 300, 328, 332, 335, 408, 412, and 416 Piazza Lido on
Lido Isle The Executive Director determined that the LCP Amendment was a minor
amendment, and the Commission concurred, thus approving as submitted the LCP amendment.
