TITLE: Resolution No. 2021-80: Authorizing the City Manager to Apply for
the PLHA Grant and Adopting the PLHA Plan for the Permanent
Local Housing Allocation Program
ABSTRACT:
On July 27, 2021, the City Council approved Resolution 2021-67, authorizing the City
Manager to apply for a Permanent Local Housing Allocation (PLHA) grant and adopting
the City's PLHA plan. The Resolution did not contain a recital that is necessary for
approval of the City's plan. Staff recommends adoption of a new Resolution to meet the
State of California's (State's) requirements.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Adopt Resolution No. 2021-80, A Resolution of the City Council of the City of Newport
Beach, California, Authorizing the City Manager to Apply for the PLHA Grant and
Adopting the Permanent Local Housing Allocation Program; and
c) Authorize the City Manager to execute the PLHA Program Application, the PLHA
Standard Agreement and any subsequent amendments as required by the State of
California.
DISCUSSION:
SB 2 was passed in 2017 and created the Building Homes and Jobs Act and the PHLA
program. The bill established a permanent source of funding for affordable housing.
Revenue for the program is generated through recording fees on real estate transactions
and therefore, varies from year to year, depending on activity. Beginning in 2019, the
revenues collected flow to local jurisdictions through the PLHA funding allocation. This
application period covers 2019 through 2023.

PLHA funds are distributed to local agencies using the same formula as the Community
Development Block Grant (CDBG) program. The State Department of Housing and
Community Development (State HCD) has determined that the City of Newport Beach
(City) is entitled to approximately $1,017,678 over the five-year period covered by the
application (2019-2023).
The State requested additional language in the City Council resolution, which states, "City
certifies that its selection process of these subgrantees was or will be accessible to the
public and avoided or shall avoid any conflicts of interest". A new Resolution is attached.
FISCAL IMPACT:
Should the City receive the grant award, staff will return with a budget amendment. The
State estimates that the City will receive $1,017,678 through this program over the five-
year period covered by the application. These funds will reduce the amount of General
Fund resources that would otherwise be required to support the Bridge Shelter's
navigation center operations hosted by the City of Costa Mesa.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item). The original plan was noticed
as required by the State program guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
THE CITY MANAGER TO APPLY FOR THE PLHA
GRANT AND ADOPTING THE PLHA PLAN FOR THE
PERMANENT LOCAL HOUSING ALLOCATION
PROGRAM
WHEREAS, the State of California ("State"), Department of Housing and
Community Development ("Department") is authorized to provide up to $304 million under
the SB 2 Permanent Local Housing Allocation ("PLHA") Program Formula Component
("Program") from the Building Homes and Jobs Trust Fund for assistance to Cities and
Counties (as described in Health and Safety Code section 50470 et seq.);
WHEREAS, the Department issued a Notice of Funding Availability ("NOFA")
dated May 3, 2021, under the PLHA Program;
WHEREAS, the City of Newport Beach ("City") is an eligible local government that
has applied for program funds to administer one or more eligible activities, or a local or
Regional Housing Trust Fund to which an eligible local government delegated its PLHA
formula allocation; and
WHEREAS, the Department may approve funding allocations for PLHA Program,
subject to the terms and conditions of the PLHA Guidelines, NOFA, Program
requirements, the standard agreement, and other contracts between the Department and
PLHA grant recipients.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby represent and certify that if the City
receives a grant of PLHA funds from the Department pursuant to the above referenced
PLHA NOFA, the City will use all such funds in a manner consistent and in compliance
with all applicable state and federal statutes, rules, regulations, and laws, including,
without limitation, all rules and laws of the PLHA Program, as well as any and all contracts
between the City and the Department.
Section 2: City is hereby authorized and directed to receive a PLHA grant, in an
amount not to exceed the five-year estimate of the PLHA formula allocations, as stated
in Appendix C of the current NOFA of One Million Seventeen Thousand Six Hundred
Seventy -Eight Dollars and 00/100 ($1,017,678.00), in accordance with all applicable
statutes, rules, regulations, and laws.

Section 3: City hereby agrees to use the PLHA funds for eligible activities as
approved by the Department and in accordance with all Program requirements,
Guidelines, other statutes, rules, regulations, and laws, as well as in a manner consistent
and in compliance with the standard agreement and other contracts between the City and
the Department.
Section 4: Pursuant to Section 302(c)(4) of the PLHA Guidelines, Applicant's
PLHA Plan for the 2019-2023 Allocations is attached to this resolution, and City hereby
adopts this PLHA Plan and certifies compliance with all public notice, public comment,
and public hearing requirements in accordance with the Guidelines.
Section 5: City certifies that it has or will subgrant some or all of its PLHA funds
to another entity or entities. Pursuant to Section 302(c)(3) of the PLHA Guidelines, "entity"
means a housing developer or program operator, but does not mean an administering
local government to whom a local government may delegate its PLHA allocation.
Section 6: City certifies that its selection process of these subgrantees was or
will be accessible to the public and avoided or shall avoid any conflicts of interest.
Section 7: Pursuant to City's certification in this resolution, the PLHA funds will
be expended only for eligible activities and consistent with all Program requirements.
Section 8: City shall be subject to the terms and conditions as specified in the
standard agreement, the PLHA Program Guidelines, and any other applicable SB 2
Guidelines published by the Department.
Section 9: The City Manager is hereby authorized to execute the PLHA
Program Application, the PLHA Standard Agreement and any subsequent amendments
or modifications thereto, as well as any other documents which are related to the Program
or the PLHA grant awarded to the City, as the Department may deem appropriate.
Section 10: The City hereby rescinds Resolution 2021-67, and replaces it with
this current resolution.
Section 11: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.

Section 12: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 13: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.
Section 14: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution, to -wit:

§302 c (4) A Describe the manner in which allocated funds will be used for eligible activities.
The Cily of Newport Beach is desiring louse our allocation to assist person who are experiencing or at risk of being homeless The City of Newport Beach is in partnership with the City of Costa Mesa for
shelter services. The City contracts for 20 beds at an annual cost of $1,000,000 per year that increases annually by the Consumer Price Index. The currant agreement is for a five year term, The shelter is
located at 3175 Airway Avenue. Costs Mesa. PHLA funds will be used to support the City's 20 beds which indude day-to-day shelter activity, related homeless outreach services, and assistance to hlep
persons who are experiencing or at risk of homelessness to obtain and retain housing

(AMI).

The City of Newport Beach entered into a Memedanum of Understanding (MOU) with the City of Costa Mesa, This MOU Identifies the services that will be provided by the City of Costa Masa in support of our
homeless population. The MOU identifies the responsibilities of Costa Mesa to piovide all services necessary to Mee the needs of the City's homeless population, Both cities have agreed that this regional
approach to providing services joimiy benefits both communites without additional expensive shelter operations. In additon to these costs. the City of Newport Beach provides staff resources including a
Homeless Liasion Coordinator, Homeless Liasion Officer and a social services provider that works to move people from the street to the Costa Mesa Bridge Shelter.

The City has completed two major steps in workng with the City's homeless population The first step is having a 5 year contract wilh City Net, a social services contractor who has the skill set and education
