TITLE: Concrete Replacement Program — Notice of Completion for Contract
No. 7892-1 (Project No. 21 R06)
ABSTRACT:
On November 24, 2020, the City Council awarded Contract No. 7892-1 for the Concrete
Replacement Program project to S&H Civilworks. The work is now complete and staff
requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The project originally included the replacement of deteriorated concrete sidewalks,
driveways, curbs and gutters, and access ramps on the Balboa Peninsula, Lido Isle and
in Newport Shores. During construction, staff identified additional work needed on Lido
Park Drive and on Vista del Oro in Eastbluff. The additional work was added to the
contract.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final contract cost was $745,966.60, which was approximately 9.7 percent higher
than the original bid amount. The cost increase was primarily due to additional concrete
improvements on Lido Park Drive and Vista del Oro.
The change order work on Lido Park Drive consisted of reconstructing new sidewalk and
curb and gutter to improve street drainage conditions and prevent storm water from
entering a private underground parking garage. The second change order work on Vista
del Oro involved removing an old dilapidated wooden barrier and steel railing in front of
an abandoned road entrance. The road entrance was removed and converted to a new
parkway with sidewalk, curb and gutter, and grass to match the adjacent existing
improvements.
A summary of the project schedule milestones is as follows:

Additional time was added to the contract for the change order work on Lido Park Drive
and Vista del Oro. S&H Civilworks is also concurrently working on a separate construction
contract, which involves the reconstruction of concrete alleys. To minimize public
inconvenience associated with alley reconstruction during the summer season, staff
directed the contractor to prioritize the concrete alley reconstruction project prior to
Memorial Day.
FISCAL IMPACT:
Funds for the construction contract were expended from the following account:

ENVIRONMENTAL REVIEW:
On November 24, 2020, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance
of existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
