20.30.o6o Height Limits and Exceptions.
C. Increase in Height Limit.
1. Procedure. The base height limits established in Part 2
of this title (Zoning Districts, Allowable and Uses, and
Zoning District Standards) may be increased within
specified areas with the adoption of a Planned Community
District, adoption of a specific plan, or approval of a
planned development permit, or site development review.
The maximum height limit is notuaranteed by right and
shall require ap. proval of a discretionary action when all
app licable findings are met in compliance with subsection
(C)(p3) of this section (Required Findings). Height limits
established as part of an adopted planned community shall
not be subject to this subsection.
2. Height Limit Areas. The height limit areas shall be as
follows:
a. R -A, R-1, R -BI and R-2 Zoning Districts Height Limit
Area. In this height limit area the base height unit for
structures with gat roofs is twenty-four (24) feet (including
guardrails and parapet walls) and the base hei ht limit for
structures with sloped roofs is twenty-nine (29feet. The
height of a structure may be increased up to a maximum of
twenty-eight (28) feet with a flat roof or thirty-three (33) feet
with a sloped roof through the approval of a discretionary
application as provided above. This height limit applies in all
R -A, R-1 R -BI, and R-2 Zoning Districts as shown on the
Zoning fVlap.

Y : Prior to issuance of final buildin ermits the Applicant shall record
a ee noti ication with the County 'Recorder's Office approved as to
form by the Office of the City Attorney, consistent with NBMC Section
20.48.130.1 (Deed Notification). The Deed Notification shall state that
residential units are located in a mixed-use project or in a mixed-use
zoning district and that an owner may be subject to impacts, including
inconvenience and discomfort, from lawful activities occurring on the
Project or zoning district (e. . noise, late night hours, live entertainment
hting, odors, high pedestrian activity levels, etc.). The Deed
fVotification shall also state that the project is located across the street
from businesses currently operating as Muldoon's Irish Pub located at
202 Newport Center Drive, Red -O Restaurant located at 143 Newport
Center Drive, and Fig and Olive located at 151 Newport Center Drive,
which feature open-air courtyards, live music, DJs, bands, food service,
special events, and guests using adjacent parking lots.
#4 The deed notification Ianquage contained in Condition of Approval
No. 3 shall be copied into the CC& 's for the project.
#Prior to buildin ermit final the Applicant shall prepare a written
isc osure statement. T e written disclosure statement shall be
provided to owners and tenants prior to sale, lease, or rental of a
residential unit in the proposed mixed-use development consistent with
Section 20.48.130.H (Notification to Owners and Tenants) of the
Municipal Code.
#26 Deliveries and refuse collection for the facility shall be prohibited
between the hours of 10:0o p.m. and Too a.m. on weekdays and
Saturdays and between the hours of 10:0o p.m. and g:oo a.m. on
Sundays and Federal holidays, unless otherwise approved by the
Director of Community Development, and may require an amendment
to this Use Permit.
