NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 100 CIVIC CENTER DRIVE, NEWPORT BEACH ZOOM THURSDAY, SEPTEMBER 16, 2021 REGULAR MEETING – 10:00 A.M. I. CALL TO ORDER – The meeting was called to order at 10:00 a.m.

II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF AUGUST 26, 2021
The Zoning Administrator stated that he would be incorporating suggested corrections to the minutes he
received in the form of written correspondence from Mr. Jim Mosher. Action: Approved as Amended IV. PUBLIC HEARING ITEMS ITEM NO. 2 Newport Homes LLC Residence Coastal Development Permit No. CD2021-022 (PA2021-112) Site Location: 114 East Ocean Front Council District 1
Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit to allow the demolition of an existing single-unit residence and the construction of a
new three-story, 2,640-square-foot, single-unit residence including a 364-square-foot, attached two-car garage. The proposed development also includes additional appurtenances such as walls, fences, patios,
hardscape, drainage devices, and landscaping. The finished floor elevation of the first floor of the proposed structure is 12.7 feet North American Vertical Datum of 1988 (NAVD 88), which complies with the minimum
9.0-foot (NAVD 88) elevation standard for new structures and exceeds the minimum requirements for sea level rise (10.9 feet NAVD 88). The proposed single-family dwelling and accessory structures conform to all
applicable development standards and local coastal program requirements.
Applicant Masum Azizi, Architect on behalf of the Newport Homes LLC, stated that he had reviewed the draft resolution and agrees with all of the required conditions.
The Zoning Administrator clarified with Melinda Whelan that Condition of Approval No. 9 had inadvertently
been included and should be removed.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as Amended
ITEM NO. 3 440 Fernleaf LLC Residential Condominiums Tentative Parcel Map No. NP2021-008 and
Coastal Development Permit No. CD2021-029 (PA2021-151) Site Location: 440 and 440 ½ Fernleaf Avenue Council District 6 Patrick Achis, Assistant Planner, provided a brief project description stating that the request is for a tentative
parcel map and related coastal development permit. The parcel map will allow each unit of an under-construction duplex to be sold individually as condominiums. No deviations from Title 19 are requested. The

project has been conditioned to require public improvements, including the reconstruction of sidewalks, curbs, and gutters along the Fernleaf Avenue and Second Avenue frontages, as needed, as well as the undergrounding of utilities, consistent with Title 19 (Subdivisions) of the Newport Beach Municipal Code
(NBMC). A 10-foot radius corner cut-off at the corner of Fernleaf Avenue and Second Avenue shall be dedicated to the City of Newport Beach for street purposes. The proposed wall that is located within the corner cut-off area shall be removed from the dedication area. Prior to building permit final and subsequent to the recordation of the Parcel Map, the applicant shall install a new 36-inch box tree within the Fernleaf Avenue and Second Avenue frontages.

the public hearing was closed. Action: Approved ITEM NO. 4 502 Begonia Residential Condominiums Tentative Parcel Map No. NP2021-009 and Coastal Development Permit No. CD2021-030 (PA2021-152) Site Location: 502 and 502 ½ Begonia Avenue Council District 6
Patrick Achis, Assistant Planner, provided a brief project description stating that the request is for a tentative parcel map. The parcel map will allow each unit of an under-construction duplex to be sold individually as
