TITLE: Appointments to the Aviation Committee
ABSTRACT -
The Aviation Committee District 3 member seat and the District 4 member seat are
currently vacant. It is the desire of Council Member Duffy Duffield (District 3) and Mayor
Pro Tem Muldoon (District 4) to make appointments, subject to City Council confirmation.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Confirm Council Member Duffy Duffield's appointment of Elizabeth Braley as the
District 3 Member to the Aviation Committee; and
c) Confirm Mayor Pro Tem Kevin Muldoon's appointment of Ron Rubino as the
District 4 Member to the Aviation Committee.
DISCUSSION:
At the March 26, 2019 City Council meeting, the City Council adopted Resolution
No. 2019-26, which amended the membership of the Aviation Committee and states, in
part, that the Aviation Committee shall consist of seven members, one from each City
Council District, nominated by the District Council Member and confirmed by the City
Council; an at -large member, nominated by the Mayor and confirmed by the City Council;
a member of the General Aviation community, nominated by the Mayor and confirmed by
the City Council; and a resident of Newport Coast, nominated by the Mayor and confirmed
by the City Council if the District 6 or District 7 seats are not filled by a Newport Coast
resident.

Pursuant to City Council Policy A-2 (Boards, Commissions and Committees) and the
Maddy Act, an Unscheduled Vacancy Notice for both member seats was posted in the
City Clerk's Office, Central Library, on the City's bulletin board in the Council Chambers,
and on the City's website on September 15, 2021. The City Clerk's Office also published
the notice on September 18, 2021 in the Daily Pilot. The applications are attached as
Attachment A.
Subsequent to reviewing the applications, the following nominations are being brought
before the City Council for confirmation:
Council Member Duffield has nominated Elizabeth Braley to fill the District 3 Member seat.
Mayor Pro Tem Muldoon has nominated Ron Rubino to fill the District 4 Member seat.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
