TITLE: Concrete Replacement Program (FY 2021-22) — Award of Contract
No. 8722-1 (22R06)
ABSTRACT:
Staff has received construction bids for this year's Concrete Replacement Program
project and requests City Council approval to award the construction contract to Grigolla
& Sons Construction Co., Inc. (Grigolla & Sons). This project will replace deteriorated
concrete sidewalks, driveways, curbs and gutters, and access ramps in the Newport
Heights neighborhood, Mariner's Park, and Dover Shores neighborhood. This project also
includes concrete walkway improvements at Lido Park.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301(c), Class 1 (maintenance of existing public facilities
involving negligible or no expansion of use) of the CEQA Guidelines, because this
project has no potential to have a significant effect on the environment;
b) Approve the project drawings and specifications;
c) Award Contract No. 8722-1 to Grigolla & Sons Construction Co., Inc. for the total bid
price of $644,390, and authorize the Mayor and City Clerk to execute the contract;
and
d) Establish a contingency of $63,000 (approximately 10 percent of total bid) to cover the
cost of unforeseen work not included in the original contract.

At 10 a.m. on September 30, 2021, the City Clerk opened and read the bids for this

The City of Newport Beach (City) received six bids for this project. The low bidder, Grigolla
& Sons, possesses a California State Contractor's License Classification "A", as required
by the project specifications. A review of references for Grigolla & Sons shows
satisfactory completion of similar contracts for the City and other municipalities.
The low bid was 2.7 percent below the Engineer's Estimate of $662,600. The majority of
the bids were very competitive and close to the Engineer's Estimate.
The proposed project includes replacement of deteriorated concrete sidewalks,
driveways, curbs and gutters, and access ramps within the Newport Heights
neighborhood, Mariner's Park, and Dover Shores neighborhood. Improvements to the
deteriorated concrete walkway at Lido Park are also included as part of this project.
Pursuant to the Contract Specifications, the Contractor will have 60 consecutive working
days to complete the work. Work is scheduled to start in late November 2021. Tardy
completion of the project will be assessed liquidated damages at $1,000 per calendar
day.
FISCAL IMPACT:
The adopted FY 2021-22 Capital Improvement Program budget includes sufficient
funding for this project. Project savings from past fiscal years' Concrete Replacement
Program will be used to supplement the current adopted Capital Improvement Program
budget. The following funds will be expensed:

Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1, (maintenance

Guidelines, because this project has no potential to have a significant effect on the
environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
