Staff has received construction bids and requests City Council approval to award the work to Associate Pacific Constructors, Inc. (APC), of Morro Bay, CA. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (minor alteration of existing public facilities with negligible expansion) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential to have a significant effect on the environment; b) Approve the project drawings and specifications; c) Award Contract No. 7884-2 to APC for the total bid price (includes additive bid items) of $578,770, and authorize the Mayor and City Clerk to execute the contract; d) Establish an amount of $57,877 (10%) to cover the cost of unforeseen work not included in the original contract; and e) Approve Budget Amendment No. 22-022 appropriating $140,000 from Tidelands Capital Fund unappropriated fund balance to Account No. 10001-980000-22H03 (Tidelands Maintenance fund). 17-1 Ocean Piers Maintenance Project — Award of Contract No. 7884-2 (22H03) November 16, 2021 Page 2 DISCUSSION: The City's two ocean piers, Newport and Balboa, were originally built in 1940. While the 19 -year-old concrete decks are relatively maintenance free, the timber support structures below the decks are continuously impacted by the ocean waves, tides and the harsh marine environment. Therefore, the City's Capital Improvement Program biennially funds the inspection, maintenance and repair of these two piers. The pier inspections, conducted by COWI North America (COWI) from December 13, 2020 to February 10, 2021, identified two damaged piles at each of the piers. A recent high swell destroyed one of the damaged piles at Balboa Pier, which then required an emergency pile removal in order to prevent further damage to the pier. This contract will replace the remaining three damaged piles (one on the Balboa Pier and two on the Newport Pier). Additionally, the inspections showed severe corrosion and significant deterioration on timber and pile hardware throughout both piers. The work necessary for the completion of the contract consists of underwater and above water/under deck repairs at Newport and Balboa Piers based on the pier inspections conducted by COWI. Staff developed bidding documents and advertised for pier maintenance and repair project (above water/under deck repairs) which includes work at Newport Pier Bents 30, 34-47 and Balboa Pier Bents 17, 21, 25, and 31-47. The bid package also included additive bid items for repairing three additional bents at each of the piers. At 10 a.m. on October 6, 2021, the City Clerk opened and read the following bids: BIDDER BASE BID LOW Associated Pacific Constructors, Inc. $ 478,770 2nd Jilk Heavy Construction, Inc. $ 760,880 The apparent low bidder, APC, possesses a California State Contractor's License Classification "A" as required by the contract documents. A check of APC's references indicates satisfactory completion of similar past projects for the City, including dredging and emergency and maintenance work at Newport and Balboa Piers. Additionally, APC recently completed a three-year City On -Call Maintenance contract for Harbor Maintenance. APC's base bid costs came in approximately 1.3 percent higher than the Engineer's Estimate of $472,400. Upon review, the bid received from APC is cost competitive and within marketplace conditions for this specialty work. Considering the competitive pricing received, staff recommends adding the additive bid items as described above. Pursuant to the contract documents, APC has 100 consecutive working days to complete the project and it must be completed no later than May 19, 2022. Failure to complete the work within the specified time will result in liquidated damages set at a daily sum of $2,500. 17-2 Ocean Piers Maintenance Project — Award of Contract No. 7884-2 (22H03) November 16, 2021 Page 3 FISCAL IMPACT: Upon approval of the budget amendment, contract costs will be funded from the Tidelands Maintenance fund ($279,848 from 10001-980000-22H03) and Tidelands Capital fund ($360,152 from 10101-980000-17H03) for a total budget of $640,000.
