To: All City Council Members Reasons why we don't need a convenience store on PCH and Avocado. (PA2019-027) 1. 1 have attached a petition that was submitted prior to the planning commissions vote. It voices the objection of over 400+ members of the community regarding the 76 plans. 2. As the owner of Korker Liquor, I witness the constant struggle of delivery truck drivers attempting to find parking. Whether it is from my own deliveries or nearby businesses, parking on PCH in front of Korker is already an issue. The 76 market will demand a higher amount of deliveries, where will all the semi trucks park? The amount of parking space on his lot is insufficient and does not designate a proper and safe area for trucks to park. 3. There are enough alcohol establishments fulfilling the communities needs in the area. 4. A convenience store selling beer and wine will negatively impact Korker Liquor. It would be unwise for the city to approve of these plans at the detriment of a long standing family business directly next door. Corona del Mar does not need more new construction which will further impact PCIS traffic and create a busy parking lot during longer business hours. There is presently a busy liquor/convenience store right next door to this proposed project, which is open 12 hours a day. The proposed project would also encourage loitering and evening noise like similar convenience stores in the area. Dear City Clerk: Please route my comments to the Public Comments section of the agenda package for the Planning Commission's review of the PA2019-027 - CdM 76 Service Station CUP UP2019-004. I am firmly opposed to the granting of the CUP. The current use of the site for a gas station with reasonable but limited hours of operation is consistent with the property's location in the business corridor along East PCH. Converting the use to one that will most likely primarily feature the sale of merchandise, including beer and wine, with almost certainly, longer hours of operation, is not a welcomed development. A liquor store is already located on the adjacent block. The retail sale of gasoline and provision of auto service has long enhanced the community. The conversion of use for even higher traffic retailing of food, beer, wine and merchandise, with longer hours of operation and increase traffic and noise, is not what local residents in the area favor. This is not the kind of thing that is needed or wanted in Corona del Mar. We are a family oriented community and a stop and go place like this that sells liquor is not in keeping with the community and neighborhood feel of the community. Most of the businesses in the area are single stand alone and not chains or Quick Stop places like this. I live but two blocks from this and walk by this location daily. I also feel that putting such a liquor place immediately next to Korker Liquor will put such financial strain on a business that has been serving local residents for year and probably put them out of business. We as a small close knit community must patronize and preserve our small community identity and a local color. This HUGE new structure would be the FIRST thing that someone would see of CDM as they come down PCH . Please vote this down. The addition of another convenience store location with extended hours (late night) will cause harm to the area, increasing traffic endangering pedestrians. This area of CDM is very family oriented and has a lot of pedestrian traffic that will be put at risk. Further, the late hours and addition of alcohol sales in this proposal will attract a potential negative element to the area and surrounding homes. This would be an eyesore on CDM village. Korker liquor next door already has everything this store would sell. We both know this would be devastating to this small business. We already lost Coco's to a chase bank and I am upset seeing all of our small business get kicked out. There are way too many banks in CDM and it is super unnecessary, but that is besides the point. Living in the flower streets I love Korker liquor and am tired of these big corporations coming in trying to take over. Now you represent our district and you need to be an advocate for your district's voters that elected you .The original project was overwhelming opposed by the adjoining CDM village ,Irvine Terrace residents and surrounding businesses. The issues that were raised at that time have not improved and many have gotten worse in the intervening years. NO VARIANCES to city code were part of the original plan. Now we have the current project that was approved by City Planning ...a project which has deviations from the municipal code as well as exceptions for business operations. There is NO REASON or justification to grant any variances and give special treatment to one business over the valid objections of so many residents who will be directly impacted.The purpose of a city code is to equally protect all parties. The precedents that would be set would be damaging to the entire city as well as those directly affected. As residents we are concerned that a comprehensive traffic study was not done and strongly feel one should be conducted before going forward. The intersection is extremely congested with increased traffic both vehicle and pedestrian ,the newly created dedicated bike lane , bus stop, and permitted UTurns . Avocado has become a bypass street when PCH is congested.... mornings ,evenings and weekends. Many times a day we have difficulty exiting Irvine Terrace onto PCH . Minimum landscaping standards were waived which would mitigate the light pollution and visual impact to the nearby neighborhood. The choice of exterior surface materials as specified is "standard minimart" not consistent with the quality of building materials that is required by city code. The Assistant City Attorney indicated that you DO have oversight in that regard during the Planning Commission meeting on October 7th. The addition of extended hours of alcohol sales till 11:00 and operating hours from 6:00 a.m. to midnight would be detrimental to our residential neighborhood No other commercial business of this type is located so close to homes in the city. We presently have citywide an increasing problem with homelessness that you are addressing as Council members but the hours of operation combined with the proximity to the Metro bus station will contribute to creating a public nuisance for late night loitering. Input from the NBPD was part of the approved plan but their record of calls for service to "minimarts" were only for onsite calls in the comparisons and not for calls in the adjacent neighborhoods. Crime in a residential neighborhood feels worse than in other areas. A late night convenience store operating near a major arterial is not recommended according to various law enforcement agencies including the FBI. Increased delivery schedules for servicing the new business have not been considered in the application. Would deliveries be before and after operating hours which would further disrupt the peace and tranquility of our neighborhood? Lastly the proposed business is located at the most visible instesection in the city.. just down the street from our City Hall, Central Library .entrance to Fashion Island ... the cultural and business hub of our city. A minimart with standard minimart design is certainly not the image for the gateway to our city and the CDM Village. We can do better. It is possible Kroker could get into a pricing war with the CDM Market, and sell all of Hamid's brands for beer and wine at 15% less than Hamid's CDM Market price. Is this what we want to see at the entrance to our city? Store signs and banners alerting customers shopping at Hamid's CDM Market will cost them more. Kroker liquor (Garen Yegenian Owner) shared this information Hamid wants to duplicate a 7-11 store footprint and name it CDM Market > There is nothing to stop him in the near future to change this to a 7-11 convenience store if he can secure the franchise The station will be changed from Union 76 to Shell because of a falling out with Union 76 over late payments Applicant agreed to shut down beer and wine sales for the first year at 9:00 PM. Applicant has hired a recently departed city council person to help him walk this through the planning commission and city council for approval. It would be helpful to better understand the motivation behind this request and the demise of the full service gas station. Hamid Kiampur had a very successful repair business with (3) bays servicing Mercedes, BMW's, and other pricey cars and employed (3) full time mechanics. The candy and chips sold from the little mini market were just plus sales for their gas and successful repair business. So what happened to the repair business? .... One day about (2)+ years ago they stopped all service and repairs on these cars and closed down the operation. Hamid claimed people no longer needed their cars repaired due to leases and warranties, even though most all of the cars at his station were out of warranty. His customers were looking for a lower repair price than taking a car out of warranty to the dealer. They also sold a lot of tires and batteries from the neighborhood full service station. I had two of my vehicles serviced here and purchased a battery. This was all in place when Hamid purchased the station from Tom, who was the original owner of the Union 76 station. The main reason the leases and warranty argument does not hold water is the Chevron station on the corner of Pacific Coast Highway and McArthur is constantly busy with repairs requiring a staff of mechanics. So really..... What went wrong with the license with the State to repair cars for Hamid? This left him with only the gas and sundries to pay the overhead and make a profit. Hamid's Union 76 gas prices were always $.40 cents a gallon higher than the other station in the South end of Corona Del Mar. He seems to cater to only those that were not concerned about the cost of filling up the tank. I walk by this station every day and I can tell you it is still not very busy, so this must be a last resort to get this station more profitable so he can sell it. Moore in the mailbag section questioning the thinking of the Planning Commission approving the applicants request to add a 7-11 style store to the Union 76 gas station at Pacific Coast Highway and Avocado Avenue. This was initially discussed in early August, 2020 when Korker's Liquor Store started gathering signatures to oppose a 7-11 being added to the Union 76 station. There were numerous emails about opposition from the community to this request from Hamid to go before the Planning Commission with his request. Coast Hwy (the "Korker Liquor"building) immediately adjacent to the subject property. I do not own the business. I have several objections to the applicant's request for a CUP and a CDP for the proposed expansion of the convenience store as well as the permitting of the store for the off sale of beer and wine. As discussed in the staff report, the applicant has requested numerous exceptions to the City's Service Station design criteria and the set back requirements for the property. Of particular significance is the request to encroach into the 10 foot setback immediately adjacent to my property. The current service station building and convenience store is already non -conforming to current City standards and construction in the setback will only make it more so. The goal of the City should be to encourage property owners to become more conforming, not less conforming. There should be more than adequate square footage to operate a convenience store with the remaining size of the building. I also object to the lot size waiver. Again this is only being forced by the allowance of the expansion of the convenience store into the setback area. The granting of an additional off sale liquor license is also problematic. As noted in the staff report, the crime rate in the project's statistical area already exceeds the City wide average. Currently, the number of alcohol related crimes in the area is equal to or greater than the nearby areas. The report prepared by the Police Department clearly states, "Undue concentration exists in this location in regards to both crime and alcohol license saturation." (Staff Report page 68, Police Report Page 4) Adding an additional off sale liquor establishment directly adjacent to a residential neighborhood will only increase the number of alcohol related crimes, making the area more problematic than it already is. As noted in the report, there is already a liquor store, Korker Liquor, immediately adjacent to the service station property, which can adequately serve the needs of the local population as well as the travelling public. The Police Report also contains a chart which shows the calls for service at other gas station and convenience store locations around the City as having a substantially higher number of calls for service than similar businesses that do not have alcohol sales (Staff Report Page 68, Police Report page 4). There is no additional benefit provided by adding an additional off sale liquor license in this location and the potential for significant detriment. To whom it may concern; Hello Councilwoman Joy Brenner Please vote no to the business expansion which includes longer operating hours 6am-12am, liquor sales, skirting required city requirements on all businesses for adequate set backs/vegetation, building 2 story from existing 1 story to site lines and multiple tenants/businesses w limited parking.
