TITLE: Resolution No. 2021-124: Repealing Resolution No. 2021-32 and
Designating a Portion of 31 st Street in Cannery Village as a One -Way
Street
ABSTRACT -
On April 27, 2021, the City Council approved Resolution No. 2021-32, which changed the
designation of 30th Street and 31St Street in Cannery Village, between Lafayette Avenue
and Villa Way, from one-way streets to two-way streets. Staff has been monitoring this
change and has received concerns from local business owners on 31St Street that the
change in circulation to a two-way street has caused incidents of traffic conflicts, safety
issues and parking problems. Staff has reviewed the circulation and the operation of 31St
Street and has determined that traffic conditions would improve with this portion of 31s'
Street being restored to the previous operation as a one-way street in the westerly
direction.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2021-124, A Resolution of the City Council of the City of
Newport Beach, California, Repealing City Council Resolution No. 2021-32 and
Designating a Portion of 31s' Street in Cannery Village as a One -Way Street.
DISCUSSION:
Newport Beach Municipal Code Section 12.52.010 establishes that an ordinance or
resolution may designate any street as a one-way street, and the City Traffic Engineer
shall place and maintain signs giving notice thereof.
On April 27, 2021, the City Council approved Resolution No. 2021-32, designating
portions of 31St Street and 30th Street in the Cannery Village area as two-way streets.
Resolution No. 2021-32 is included as Attachment B.

At the time, it was decided that two-way street designations for 31st Street and 30th Street,
between Lafayette Avenue and Villa Way, would possibly better facilitate the flow of traffic
in the area. Traffic signs and markings were installed to establish the two-way operation
on the designated streets. Subsequently, local residents and business owners have
contacted staff to communicate their observations of aggressive and unsafe driving on
31 st Street. Additionally, the Police Department has noted regular incidents of wrong -way
parking.
There have been no concerns provided to staff indicating that the current two-way
operation of 30th Street, between Lafayette Avenue and Villa Way, has been a problem.
Therefore, 30th Street would remain as a two-way street.
Staff has monitored and concluded that traffic conditions can be improved by reverting
the existing two-way designation on 31 st Street, between Lafayette Avenue and Villa Way,
back to a one-way traffic operation in the westerly direction. Attachment A shows the
portion of 31 st Street with the proposed change.
A letter (Attachment D) was mailed to the area residents/property owners notifying them
of the proposed change. As of the writing of this staff report, no responses to the letter
have been received.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2021-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, REPEALING CITY
COUNCIL RESOLUTION NO. 8195 AND DESIGNATING
PORTIONS OF 30TH STREET AND 31ST STREET IN
CANNERY VILLAGE AS TWO-WAY STREETS
WHEREAS, Section 12.52.010 (Placement of Appropriate Signs) of the Newport
Beach Municipal Code ("NBMC") directs the City Traffic Engineer to place and maintain
signs giving notice of any street or alley designated one-way by the NBMC, ordinance or
resolution;
WHEREAS, on February 11, 1974, the City Council approved Resolution No. 8195
designating portions of 31St Street and 30th Street in the Cannery Village. area as one-way
streets; and
WHEREAS, a review of new traffic data indicates that a change in street
designation would facilitate the overall flow of traffic in the Cannery Village area.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby repeal Resolution No. 8195 and
designates 30th Street between Lafayette Avenue and Villa Way, and 31St Street between
Lafayette Avenue and Villa Way as two-way streets.
Section 2: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 3: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 4: The City Council finds the adoption of this resolution is exempt from
environmental review under the California Environmental Quality Act ("CEQA") pursuant

to Section 15301 of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because the project involves a negligible change in traffic circulation.
Section 5: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.

On April 27, 2021, the City Council approved changing the designation of 31" Street and
301" Street, between Villa Way and Lafayette Avenue, to a two-way street.
Since the change was made, Public Works Department staff has received concerns from
locals and business owners on 31" Street that the change in circulation to a two-way
street has caused incidents of traffic conflicts, safety issues and parking problems. Staff
has reviewed the circulation and the operation of 31" Street and has determined that
traffic conditions would improve with this portion of 31" Street being restored to the
previous operation as a one-way street in the westerly direction. No changes are proposed
for 30`h Street.
The City Council will be considering this item at their meeting scheduled for November
30, 2021 in the City Council Chambers, 100 Civic Center Drive, Newport Beach. If you
