Good afternoon Mayor Avery and members of the City Council,
At your meeting of November 30, 2021, I will be addressing the City Council during
Item III, Public Comment, to introduce Smart Coast California (SCCa). Our firm
provides coastal planning consulting services to SCCa, a nonprofit organization which
advocates for the collaborative stewardship of the coast and is dedicated to community
sustainability, property rights and the environment. SCCa has a statewide membership
of over 90,000 and acknowledges the imperative planning effort underway to prepare our
communities for rising seas. We have had the opportunity to become involved in the
Local Coastal Programs for several local jurisdictions, most recently the County of Santa
Barbara, and the Cities of Half Moon Bay and Carlsbad, and are collaborating with
regional organizations as well. We have prepared a brief presentation for you, which has
been condensed from a more detailed version, which we have attached to this cover letter
for your review.
The presentation includes the following SCCa adopted policies: Managed Retreat,
Existing Development, Regulatory Takings, Rolling Easements, and Tiered Response.
SCCa's goal is to help local governments certify LCP Amendments updated for sea level
rise that reflect these policies.
• While managed retreat can be a commonsense land use practice where feasible, such
as in rural areas, the practice of managed retreat should not be applied to areas that
cannot accommodate relocation of developments and those that prohibit property
owners from defending their homes, businesses and related infrastructure. Property
owners must be allowed to defend their properties from coastal hazards when retreat is
not feasible.
• SCCa opposes any jurisdiction, including the California Coastal Commission, from
adopting regulations referring to January 1, 1977 as the date defining what qualifies as
existing development in the proposed statewide interpretations or local
programs/plans for sea level rise. This date is not constituted by law or regulation and
would restrict property owners from defending their properties. SCCa supports defining
"existing" as referring to development in existence prior to the certification of the LCP
Amendment, such as in Carlsbad's draft policy LCP-7-P.20 A.
• SCCa advocates including in LCP Amendments explicit provisions for just compensation
of property owners confronting prohibitions on protecting their property and other
regulatory takings. Property owners who are prohibited from defending their property,
and those whose property is subject to a regulatory taking, have the right to
compensation at fair market value and related costs at the time of taking, according to
principles in the California and U.S. Constitution as well as the Coastal Act itself. Funding
mechanisms must be in place before the adoption of any regulation resulting in this
taking.

• Mandates for rolling easements raise similar concerns pertaining to a regulatory taking.
Policies imposing rolling easements must contain provisions for just compensation of all
related costs of the regulatory taking, as well as a funding mechanism in place prior to
effectuating the policy, when rolling easements would preclude the economically viable
use of a property
Tiered Response is a planning principle that institutes certain defined policies if, and
only if, there are specific thresholds of sea level rise that are observed, measured and
documented, as opposed to relying only upon projections. There are multiple options
that can be incorporated into a tiered response policy including, but not limited to,
beach nourishment, kelp forests, offshore reefs, groins, submerged breakwaters and
community seawalls. These options should be adopted as preferred alternatives to
managed retreat in areas that cannot accommodate
Creative on- and offshore solutions show tremendous promise to protect our
communities, while actually improving the beaches and enhancing the marine habitat.
These solutions are beyond the reach of individual property owners, and will require a
concerted effort by Federal, State, and local governments. With both ocean and bay
frontage, creative solutions for Newport Beach are critical. The combined efforts of
Local and State jurisdictions, with the support of organizations like SCCa, will yield a
resilient framework to prepare us for Sea Level Rise, protecting both our cherished
communities and precious environment.
We invite you to join the growing coalition of local jurisdictions who are speaking out in
support of the more balanced policies discussed above. Please contact us with any

With the December 12th annual organizational meeting of
the City Council fast approaching, coupled with the
negotiating that is currently taking place behind the scenes
related to the selection of Mayor Pro -Tem, a number of
citizens concerned about the rumored possibility of
Councilman Noah Blum being selected by the Council
majority for this office is rising.
Concern stems from Council Policy A-1, Rules of Decorum
where It states, "Each Council Member shall conduct himself
or herself with decorum". Several observable and
documented actions and behaviors on the part of
Councilman Blum have occurred both before and since his
election that violate this code of ethics.
To be specific, at the last Council Meeting in October, and
the first meeting in November, Councilman Blum was
observed carrying in to the Council Chambers what
appeared to be carryout cups of coffee that he sipped during
both meetings. At the October meeting he offered a cup to
Councilman Duffield who accepted the cup. Upon inspection
of the cups following the meetings there was evidence that
these empty cups contained wine. The drinking of alcohol
during a Council Meeting is clearly in violation of the Rules of
Decorum where it is specifically states that "Each Council
member has a duty to respect and adhere to high ethical
conduct in performance of public duties".
A second statement in CP A-1 states that "Each Council
Member has a duty to represent and work for the common
good of the City and not for any private interest". Clearly the
violations that Councilman Blum has received in relation to
COVID-19 at his place of business do not reflect working for
the common good of the community. Moreover, his
introduction of a Resolution having to do with masks wearing
on the part of NMUSD students reinforced his personal
interest and position on opposing COVID-19 prevention
measures. This action had absolutely nothing to do with the
business of our City.
And finally, CP A-1 states that Council Members have a duty
to "refrain from abusive conduct". His use of inappropriate
language during comments made at the last meeting in
October is clear evidence of subjecting the public to his
abusive conduct.
Councilman Blum has absolutely no business serving in the
position of Mayor Pro -Team in 2022. His experience on
Council is limited; his behavior does not represent or please
the community. He is using his office to pursue his own
personal ideology, and as a result, the public will not tolerate
his serving as as mayor pro -tem.
It is time that the Council consider censoring Councilman

his personal interest and position on opposing COVID-19 prevention
measures. This action had absolutely nothing to do with the business of our
City.
And finally, CP A-1 states that Council Members have a duty to "refrain from
abusive conduct'. His use of inappropriate language during comments
made at the last meeting in October is clear evidence of subjecting the
public to his abusive conduct.
Councilman Blum has absolutely no business serving in the position of
Mayor Pro -Team in 2022. His experience on Council is limited; his behavior
does not represent or please the community. He is using his office to pursue
his own personal ideology, and as a result, the public will not tolerate his
serving as as mayor pro -tem.
It is time that the Council consider censoring Councilman Blum.
