TITLE: Concrete Alley and Street Replacement Project (No. 21 R07) — Notice
of Completion for Contract No. 7753-2
ABSTRACT:
On October 13, 2020, the City Council awarded Contract No. 7753-2 for the Concrete
Alley and Street Replacement Project (No. 21 R07) to S&H Civilworks. Subsequently, on
November 10, 2020, the City Council approved a contract change order with S&H
Civilworks to complete the remaining work from the Concrete Street Pavement
Reconstruction Project (No. 18R21). All work is now complete and staff requests City
Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The original scope of work for this project included removing the existing alley and street
pavement; constructing new concrete pavement; reconstructing deteriorated concrete
alley approaches, sidewalks, and curbs and gutters; installing new pavement striping; and
performing other appurtenant and incidental items of work in Utility Underground
Assessment District No. 117 (Corona del Mar), Lido Village, and West Newport.
On November 10, 2020, the City Council approved a contract change order with S&H
Civilworks in the amount of $924,732 and a contract time extension of 60 working days
to complete the remaining work from the Concrete Street Pavement Reconstruction
project (No. 18R21). Upon approval of this change order, the contract amount increased
from $1,288,025 to $2,212,757 and the contract time increased from 80 working days to
140 working days. The added scope of work included the removal and reconstruction of
the concrete street pavement on Montero Avenue and Alvarado Place, as well as
construction of a new storm drain system for both streets. New parkway landscaping and
irrigation systems were also installed on Montero Avenue as part of the project.
All the contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:
Original Bid Amount: $ 2,212,757.00
Actual Cost of Bid Items Constructed: $ 2,015,048.13
Total Change Orders: $ 70,342.38
Final Contract Cost: $ 2,085,390.51
The final contract cost was $2,085,390.51, which was approximately 5.8 percent lower
than the original bid amount. This cost decrease was primarily due to the final field
measured concrete quantities being slightly lower than the estimated quantities.

S&H Civilworks completed the approved change order work on Montero Avenue and
Alvarado Place, as well as the alley reconstruction work in Assessment District No. 117,
prior to Memorial Day 2021. Due to the large summer crowds typically seen in the West
Newport and Lido Village areas, construction during the summer in these areas was
prohibited. Reconstruction of the streets and alleys in the West Newport and Lido Village
areas commenced after Labor Day 2021 and was substantially completed on
November 4, 2021.

FISCAL IMPACT:
The majority of the funding for this alley pavement replacement project came from utility
undergrounding bonds and water and wastewater enterprise funds associated with the
replacement of pavement affected by their respective utility trenching. Funds for the

* AD 117 is bond funding from a resident requested and approved self-assessment for
undergrounding of specified overhead Utility lines.
* Orange County Transportation Authority (OCTA) provides Measure M funding,
generated through a 1/2 cent sales tax, to the City for transportation improvements
projects.
ENVIRONMENTAL REVIEW:
On October 13, 2020, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(b)(c) (maintenance of
existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
