1221 West Coast Highway -- Balboa Bay Club
The undersigned request that the Honorable City Council
reconsider the issuance of the above- referenced Permit for the
construction of a 66 -unit apartment (motel) at 1221 West Coast
Highway, Newport Beach, along the shore of lower Newport Bay,
Said Permit was apparently applied for on December 14, 1971, the
City staff checked the plans, approved the plans on January 24,
1972, and the Permit was issued on June 19, 19 2. Were informed
.,1 a 5,
that no hearings were held prior to issuance"', f the Permit and
that no substantial construction has commenced as yet.
It is respectfully requested that the Council take the
following action:
(a) At your nest meeting, or immediately, if possible,
notify the Building Department to cancel the building
permit, pending reconsideration of the issuance of the
Permit.
(b) Obtain an Environmental Impact Report.
(c) Place this Use Permit on your calendar for a hearing.
(d) Notice this matter for a hearing, by posting and other
public notices required for a public hearing.
The undersigned contend that the aforesaid Permit is invalid
and not in the best interests of the city because of the following:

(a)
There was no compliance with the provisions of the

California Environmental Quality Act of 1970,,designated
3
as Public Resources Code Sections 21000 through 211511
4
inclusive, and in particular, that:

(1) The City has no environmental element of a general
6
plan and no finding was made that either the decision
7
of the City or the use permitted was in accord with
8
any conservation element.
9
(2) No Environmental Impact Report was made and the City
10
Council did not request or require one.
11
(3) The use contemplated by said permit will have a sig-
12
nificant effect on the environment.
13
(4) The permit and its granting was a project the City
14
intended to carry out.
15
(b)
The high density is contrary to previous policy estab-
16
lished by the Council pending adoption of a General Plan.
17
This precedent allows too much population to exist on the
18
already crowded West Coast Highway area, in violation of
19
the City's announced policy to enhance the unique resi-
20
dential qualities and character of our city.

(c)
The granting of the aforesaid permit is invalid and an
22
abuse of discretion by the Council because the construc-
23
tion is inconsistent with the purposes for which the
24
property leased by the Balboa Bay Club was granted to the
25
City, inasmuch as the motel covered by the permit is not
26
a public recreational use, but rather, furthers the use
27
of said property by a private club, contrary to the
28
express request of the donor of the property, and is,

therefore, an improper and invalid use of said property
and constitutes a breach of trust by the City. Said
construction on this public property should be the sub-
ject of a public hearing prior to the granting of a
permit.
It is respectfully requested that the Council cancel the
aforesaid permit and schedule the matter for public hearing after
obtaining the necessary Environmental Impact Report, and that a
public hearing be held on the question of whether the proposed
use of the said property is consistent with the conditions under
which the property was acquired by the City.
In view of the need for a prompt decision by the Council in
this matter, it is requested that a reply be provided within ten
days from the date of this request.
