H -2 (h) TO: CITY COUNCIL FROM: Public Works Department SUBJECT: PROPOSED EASEMENT FOR UNDERGROUND UTILITY PURPOSES ON THE BALBOA BAY CLUB PROPERTY (UNDERGROUND UTILITIES DISTRICT NO. 2) RECOMMENDATION: Adopt a resolution authorizing the Mayor and the City Clerk to execute a grant of easement to the Southern California Edison Company to permit the construction of three under- ground utility vaults on the Balboa Bay Club property. DISCUSSION: On September 11, 1972 the City Council directed the staff to prepare a non - exclusive easement for underground utility purposes across the front of the Balboa Bay Club property, subject to the prior approval of the Balboa Bay Club. The purpose of the easement is to permit the undergrounding of utilities along the Pacific Coast Highway between Riverside Avenue and Marino Drive. There is no room to construct three required underground vaults within the Pacific Coast Highway right of way. The three vaults will be constructed underground inside the masonry wall and underneath the parking lot. Parking will be permitted over the vaults after completion. The Balboa Bay Club, Inc. has executed the proper grant of easement. The final plan does not require an easement across the entire frontage of the property as originally proposed; but it requires three vaults instead of two vaults as originally proposed. The main conduit will be constructed inside of an abandoned water main underneath the highway. Construction is scheduled to begin October.29, 1973. S 121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING EXECUTION OF A GRANT OF EASEMENT TO THE SOUTHERN CALIFORNIA EDISON COMPANY FOR UNDERGROUND UTILITY PURPOSES ON THE BAL80A BAY CLUB PROPERTY WHEREAS, by Resolution 7929.the City Council directed the Staff to prepare a non - exclusive easement for underground utility purposes across the front of the Balboa Bay Club property, subject to the prior approval of the Balboa Bay Club; and WHEREAS, it was subsequently determined that in order to construct the underground vaults to permit the undergrounding of utilities along the Pacific Coast Highway between Riverside Avenue and Marino Drive, additional space will be required on the Balboa Bay Club property, and the Balboa Bay club has executed the'proper grant of easement; NOW, THEREFORE, BE.IT RESOLVED by the City Council of the City of Newport Beach that it hereby authorizes the Mayor and City Clerk to execute a grant of easement conveying to the'Southern California Edison Company an easement over certain real property in the'City of Newport Beach, for the purpose .of constructing underground vaults to permit the undergrounding of utilities along the Pacific Coast Highway between Riverside Avenue and'Marino Drive, said property being described as follows: Three parcels of land in the City of Newport Beach, . lying within a portion of Lot.171, Block 54 of Orvine's Subdivision, as shown on a map recorded in Book 1, page 88 of Miscellaneous Record Maps, in the office of the County Recorder of Orange County, California, described as follows: PARCEL 1. A'strip of land 6 feet in. width, the northerly line of said strip beginning at a point in the southerly line of .Coast Highway, 100.00 feet in width, distant westerly thereon 319 feet from the intersection of said southerly line with the westerly line of Tract No. 1140, as shown on a map recorded in Book 36, page 28 of Miscellaneous Maps, records of said County; thence, continuing westerly along said southerly line, a distance of 24 feet to a point hereinafter referred to as Point "A ". -1- PARCEL 2 i A strip of land 6 feet in width, the northerly line of said strip beginning at the above said Point "A "; thence, westerly.along the southerly line of said Coast Highway, a distance of 759.00 feet to the TRUE POINT OF BEGINNING; thence, continuing westerly along said southerly line, a distance of 24.00 feet to a point hereinafter referred to as Point "B ".
