Community Development 100 Civic Center Drive Newport Beach, CA 92660 Project Name: Balboa Development Project Address: 503-505 Balboa Blvd., Newport Beach, CA 92660 MODIFICATION PERMIT The requested modification is to reduce the width of the residential parking from 9’-3” to 8’-8” Justification and Required Findings 1. The requested modification will be compatible with existing development in the neighborhood. The proposed parking width is compatible with similar developments in the neighborhood. 2. The granting of the modification is necessary due to the unique physical characteristic(s) of the property and/or structure and/or characteristics of the use. In order to provide at least one Accessible parking space for the retail, the rest of the residential parking stalls should be reduced in width 3. The granting of the modification is necessary due to practical difficulties associated with the property and that the strict application of the Zoning Code results in physical hardships that are inconsistent with the purpose and intent of the Zoning Code. The area is 5130 SF, per zoning code, a minimum of a 1795.5 SF for commercial building is required, and a maximum of 5130 SF for residential. With only 54 feet wide lot, seven parking spaces, plus one Van Accessible stall cannot be accommodated. 4. There are no alternatives to the Modification Permit that could provide similar benefits to the applicant with less potential detriment to surrounding owners and occupants, the neighborhood, or the general public. Camden Dr. 4th Floor Beverly Hills, CA 90210 310-734-4764 claudio@cosidesigns.com Cosi Designs 2 There are no alternatives to the Modification Permit without removing the ADA parking stall. 5. The granting of the modification would not be detrimental to public health, safety, or welfare, to the occupants of the property, nearby properties, the neighborhood, or the City, or result in a change in density or intensity that would be inconsistent with the provisions of this Zoning Code. The project is consistent with the provision of the Zoning Code, other than the amount of parking. Sincerely, Claudio Cosi Principal, Designer Cosi Designs, Inc.
