Please support our Restaurants in the City by continuing the outdoor dining .The last two years have been very difficult
for this business sector. Too many restaurants have closed their doors and put many family's out of work .We have great
restaurants on Balboa Island and they have been able to survive and thrive having the ability to serve outside their

As a past Balboa Island merchant association participant and member of the Amelia's Restaurant family, I couldn't be
happier with the business Royal Hen has built. Not only is the food delicious and service top notch, the Royal Hen takes
every opportunity to support the local community.
In the recent years, the outdoor seating on Marine Avenue has added an additional feature to welcome in diners and
add to the warm ambiance. There has been no inconvenience to people walking by on the sidewalk, and the people
sitting at their tables are only a positive attribute to the island "feel" of hospitality and warmth.
I hope the dining al fresco will be allowed to remain as it only offers upside to the business and benefit to the
atmosphere which Balboa Island merchants has been trying to accomplish for years.

Dear Council Members,
I am writing you to ask you to vote to continue outdoor seating on Balboa Island. I have lived on the Island for the past 16
years. Two years ago when the restaurants had to close, we did everything to try to support them starting with take-
out. With take-out and everyone eating at home, we lost the interaction with our island neighbors.
Then came the ability to eat outdoors. The restaurants were able to spread out tables and still be financially viable. With
the ability to use outdoor space, they can still have the same number of tables as they did pre -pandemic. No one wants
to sit as close to each other as we once did!
The exciting point is we got our Island "vibe" back. The fact that we live in a climate where we can help the restaurants
and create a fun safe environment all year round is terrific. We have been at the Royal Hen one to two nights per week
for the last year and a half. We engage with the tourists, the locals, the animal walkers. Everyone is able to get through
on the sidewalk, even on the busiest of nights.
Thank you for supporting the restaurants and outdoor seating so far and Please Support going forward. We are not past
the COVID spread and we do not want to lose any of the great restaurants that we have on the island and in Newport as a
whole!!

We have been coming and staying on Balboa for 2 months for the past 14 years. One of the great aspects to this year's
stay has been the increase in outdoor dining. I realize that this decision was probably originally made due to the Covid
situation but it has been a great dining addition which we have really enjoyed. I would hate to see it go away after
people have become accustomed to it while at the same time helping the restaurants attract additional business.

Outdoor tables in our community and especially on Balboa Island has been spectacular. Please continue to allow !
My husband and I recently moved to the island and never want to leave for dinner or shopping. We always choose
local vendors like the Royal Hen and Ciao because of the outdoor atmosphere, gracious hosts and amazing food.
The CA climate is so mild and the island hosts guests who do not cause noise or block walkways, perfect for
sidewalk dining.
We really enjoy being able to enjoy the beautiful weather while dining. Please consider making this a permanent
option for our local restaurants on Balboa Island.

We are writing in support of outdoor dining to continue here on Balboa Island for our local establishments like the Royal Hen and
others along Marine Avenue. It has been an added benefit to us islanders to support our local businesses and dine al fresco, especially
as the weather improves. Since we also walk the island and Marine Avenue quite regularly, we've noticed that the sidewalks are even
cleaner as the restaurants take extra care to make their dining experience memorable, and that includes sweeping and cleaning in
front of other storefronts in addition to their own.
We sure hope to continue outdoor dining here on Balboa Island!

I wanted to send you a comment in reference to item SS3 Outdoor Dining in the Public Right of Way from
Balboa Island to the Newport Pier Area:
I am the marketing manager for a business directly impacted by this issue. When the pandemic hit many
customers were nervous to eat inside. Having the parklet was a genius move by the City of Newport
Beach; adding a way for people to eat socially distanced and outdoors actively helped restaurants during
this very challenging time. Having a place for people to sit and eat AT the restaurants not only helps with
drawing customers back, but the parklets also draw in new visitors who like to enjoy the outdoor
ambiance created by the parklets. The parklets also cause customers to stay longer which causes them to
buy more food which ultimately generates more tax revenue, so I see this as a win-win. I respectfully ask
the Council to support allowing businesses to continue having outdoor dining parklets in the public right of
way through the Covid 19 pandemic.

My comments are in regards to item SS3 Outdoor Dining in the Pubic Right of Way from Balboa Island to the Newport
Pier Area:
I am a resident of Newport Beach and frequent the Newport Peninsula and know the challenges in running a restaurant
during this pandemeic. I know the pandemic has been very difficult on businesses in our community. As a resident of
Newport Beach, I enjoy the outdoor dining and wish it would continue. If businesses want to continue to utilize their
outdoor dining area, I sure hope our city council lets it continue- small businesses could really use a break!
Neighboring cities such as Laguna Beach and Huntington Beach have adopted a policy such as the one being presented
today.
There must be some way to justify certain businesses being able to keep the outdoor or dining. Lets figure out a way to
make it work. A blanket No is easy but its not the right way. Too many restaurants have barely survived and taking away
their outdoor dining option is not what being a business friendly city is all about.
We're Newport beach where we pride ourselves on visitors enjoying "being outside".

What a great weekend. The weather is fantastic and the buzz of Super Bowl and our Rams is in the air. We
should start seeing a lot of Bengals fans around Balboa Island this week who are in town for the game.
I am writing in support of Sidewalk Patio Seating on Marine Avenue.
If any of you have come on down for lunch / dinner and sat outside, you know the beautiful / Italian / French
ambiance you get by eating under the beautiful Eucalyptus trees.
Thanks to all our wonderful eateries and the ability to have outside dining, we have the option to eat outside or
inside with limited capacity / space to stay safe as we navigate these trying times under COVID. Orange
County has lost over 6,000 lives due to COVID and we want to be as safe as possible, while still being able to
participate in life and live our best lives, which includes supporting our local businesses / restaurants.
I would ask that we are at least permitted until the end of the 2022 to evaluate and see what ordinances may
need to be enacted or adjusted for the best interest of all parties.

Sidewalk Patio Seating on Marine Avenue
Dear City Council Members,
I am writing to add input to the "study session" to discuss the current situation for permits for
outside sidewalk seating on Marine Avenue next Tuesday February Stn
We have been very fortunate to have been allowed temporary outside seating permits over the
last year or so due to COVID Emergency Permits from the City.
Those permits essentially ended December 31, 2021 and we were asked to provide an
application for outside seating to continue until December 31, 2022.
This outdoor seating became imperative for our financial survival during COVID and we are
extremely grateful for this allowance. We have seen how loved this seating has become and we
truly believe it adds great charm and vitality to Balboa Island.
I have been told the City has certain concerns and I'd like to address them from our experience:
1. Issue of ADA(wheelchair accessibility) due to chairs and tables outside
-we have not had one issue with people unable to pass through or complaining about this,
to the contrary people in wheelchairs greatly enjoyed being able to sit outside and not have
to maneuver into restaurants
-even on busiest days of Halloween and Boat Parade Foot traffic, pedestrians had no trouble
getting through
-the actual tree wells of the Historic Eucalyptus trees reach further into the sidewalk than
our tables
-our tables outside still leave a 6 foot and in some cases 7 foot of sidewalk space to walk
through *please see attached photos
2. Issue of insurance and City Liability
-we are required to carry extra insurance policies for those outside areas and free the city
from liability
-we are happy to carry this insurance at any rate city declares necessary going forward
3. Cleanliness of Sidewalks
-our area of sidewalk is actually cleaner than other areas as we clean, sweep and pick up
any animal deposits around trees before and after every service, leading to cleaner
sidewalks overall
4. Will need more parking as outside seating adds capacity
-actually since COVID we are basically taking seating from inside and placing them outside
so our basic capacity has stayed the same, thus parking space needs are not increased.
Customers are no longer willing to sit as close as they once did inside or sit inside at all as
they did prior to COVID therefore the inside seating is greatly reduced and we need outside
seating to accommodate and maintain financial viability.
5. Using public property for business
-this is true but in general provides more tax revenue for the city and allows restaurants the
chance to make up much needed lost revenue and keep employees employed
-other cities are assessing a cost for parking spaces or square footage and we are open to
that as well
6. Heaters and Trees
-1 do realize some restaurants had placed heaters too close to trees which resulted in
unfortunate damage, guidelines were provided from the city to keep heaters at least 5ft
from trees and since then from my experience no more issues have been reported
I would ask that we are at least permitted sidewalk use until the end of the 2022 to evaluate
and see what ordinances may need to be enacted or adjusted for the best interest of all
parties.

My comments are with reference to item SS3 Outdoor Dining in the Pubic Right of Way from Balboa Island to the
Newport Pier Area:
As a business directly impacted by this issue, I respectfully ask the council to support allowing businesses to continue
having outdoor dining in the public right of way, especially through the Covid 19 pandemic. Neighboring cities such as
Laguna Beach and Huntington Beach have all adopted a policy such as the one being presented today. While these
parklets do occupy a few parking spaces, any negative impact to the Newport Beach visitor is nominal. The public
enjoyment of these dining areas far outweighs any distress caused by the loss of parking spots. As a business owner, I
understand that the city does forgo income generated from these parking spots. I would understand if the city chose to
charge my business for this opportunity to continue occupying these spots.

Greetings to you all,
As a Balboa Island resident for 14 years (I know - not a long time considering some of my 80 year
old neighbors grew up in the same house that they now live), I have certainly watched our
neighborhood change. Some for the good - some not so good.
With the shutdowns revolving around the Covid outbreak two years ago, I was a huge proponent of
"Shop Local" and "Order Your Food To -Go" and make sure to "Tip Those Delivery People Heavily."
That's how we got through it. Well - mostly. Many shops on the island, in Newport, across the
county, and our great country closed due to lack of business during this terrible time.
Ok - getting to the point. PLEASE allow for the continued use of sidewalks for outdoor dining on
Balboa Island - and for the rest of Newport Beach as well. It has been s000 beneficial - bringing a
little light and joy and helping develop new friendships along the sidewalk.
*Some points that were raised about blocking passersby - especially in wheelchairs ... not valid. I
literally walk that sidewalk several times a day (did I mention that I love to support our Island
shops?) and never have I seen someone not be able to get by due to tables on the sidewalk. Literally
- it is simply not an issue.
*Another issue is how to keep the sidewalks clean. Every restaurant I patronize cleans the sidewalk
just as they would if there was a spill or trash inside their restaurant. I mean, look at Royal Hen.
Their sidewalk area is spotless. It is constantly cleaned. Again, this is simply not a real issue. Now
we can look at ... spilled ice cream and Balboa Bars as tourists stroll the sidewalks. And folks from
other Newport neighborhoods who walk their dogs here, let them poop and pee right on the
sidewalk in front of a shop or someone's front door (mine, lol), and just keep on strolling. Let's deal
with these people and punish them. Not the restaurants.
*Also, I have no problem with restaurants using the sidewalk even though they are public property.
I mean, at least I know that Royal Hen is willing to pay a stipend for the benefit of using the
sidewalk. Additionally, cities all over the WORLD use public sidewalks for cafe seating. It gives the
Island a wonderful vibe and the tourists and neighbors love it. How quaint! Would you rather see
EMPTY sidewalks? and NO tourists or diners?
*In fact, todays Orange County Register has a big article on the best places to enjoy patio dining in
Orange County. If the local newspaper has researched it, thinks it is a great idea and is telling
millions of readers to go out and enjoy, then I think we should listen.

Hi,
As a resident on Balboa Island I am writing to the City Council regarding the extension of the permits for
outside seating on Marine Avenue to have them continue until December 31, 2022.
This outdoor seating became imperative for our financial survival during COVID and we are extremely grateful
for this allowance. We have seen how loved this seating has become and we truly believe it adds great charm
and vitality to Balboa Island.
1. Issue of ADA(wheelchair accessibility) due to chairs and tables outside
People in wheelchairs greatly enjoyed being able to sit outside and not have to maneuver into restaurants
2. Issue of insurance and City Liability
Required to carry extra insurance policies for those outside areas and free the city from liability
3. Cleanliness of Sidewalks
Sidewalk is actually cleaner than other areas as they clean, sweep and pick up any animal deposits around
trees before and after every service, leading to cleaner sidewalks overall
4. Will need more parking as outside seating adds capacity
Since COVID we are basically taking seating from inside and placing them outside so our basic capacity has
stayed the same, thus parking space needs are not increased. Customers are no longer willing to sit as close
as they once did inside or sit inside at all as they did prior to COVID therefore the inside seating is greatly
reduced and we need outside seating to accommodate and maintain financial viability.
5. Using public property for business
True but in general provides more tax revenue for the city and allows restaurants the chance to make up
much needed lost revenue and keep employees employed
6. Heaters and Trees
Guidelines from the city to keep heaters at least 5ft from trees

My name is Nez Balelo a resident of Balboa Island and a business man who does a lot of business in the OC area.
Since Covid unfortunately hit everyone , especially businesses and more particularly restaurants, we all rallied and did
what we could to support our local economy - our brethren .
Outside seating and allowing restaurants to accommodate quite a few patrons is vital on so many fronts and continues
to be because this virus just doesn't feel like it's going away.
Lifting outside seating is limiting half of the areas clientele from dining and supporting these loyal restaurants and it's so
important we continue to show these business's support .
Personally I do a lot of business in the evening with clients and potential clients and having outside availability to respect
the virus and allow us to support the restaurants but allow us some normalcy as well, is critical moving forward to show
our local economy they have our support.
Please don't take away what half of our society views as a valuable asset to dine outside and stay relatively safe .

Hello:
My name is Kenny Wagener. I am an 8+ year resident of Balboa Island and saw the island weather the pandemic and —
for the most part- make it through. Outdoor dining helped that. I needed outdoor dining. I was working from home
and not interacting with anyone. My trip down to Wilma's Patio five times a week gave me a good meal and the needed
human interaction I needed to keep some normalcy.
But what was discovered during that period is the high demand for dining on the sidewalks. I believe it adds to the
charm and atmosphere and lets local dining establishments showcase their cuisine without prospective patrons needing
to walk inside. People strolling by glance down at the plates and their interest is piqued.
Mine is in favor of continuing outdoor dining. It lets our local businesses "peak the peaks" — they can expand their
dining during periods of high demand and shrink them when the island is quiet. With high labor costs and the ongoing
economic uncertainty I feel we as a community should do what we can do to keep these valuable community assets
viable for the months and years to come.

I'm Pete Weitzner, longtime resident of Balboa island. First, thank you all for your service. Really. Much
appreciated in these contentious times.
As an Island resident, I have seen what outdoor dining has done for our community. In a word, it's been a
GODSEND. It's helped save businesses and jobs. It's restored the joie de vie, as it's so much more conducive to
neighbors engaging each other at dinner, and in town. It doesn't detract from the aesthetic, just the opposite.
And I know it's no coincidence, I see more people dining out during the week, with the addition of outdoor
dining. The next person I talk to who's in opposition to outdoor/sidewalk dining, will be the first.
Please approve and make permanent, this important asset to our community, to the tax base, to our

As a very happy Balboa Island resident, I am writing to you in reference to your consideration of the continued
allowance of outdoor dining on our Island. I strongly believe the "al fresco" dining has added a lovely. quaint feeling to
our community. I know it started as a health issue in response to the spreading of the awful Covid 19. It also also a way
for the restaurants to stay open and thrive. I believe that most people will agree with me and support our local
restaurants and merchants to continue with the outdoor dining. They offer a safe and healthy environment for us to
gather, enjoy a good meal, and promote a strong economy here on the Island.
The evenings on Marine Avenue are especially beautiful with the lights, heat lamps, and table settings adorning the
sidewalks! I've also noticed that the sidewalks and streets are cleaner due to the restaurant's contant upkeep!
For the past 2 years, I have not heard any negative comments about our new dining arrangements; quite the contrary -
people love it! I for one would love to see more enhancements such as planters and more lighting!
I am asking that you set policy to allow the continuance of outdoor dining on Balboa Island.

It is important that you to provide our local restaurants with the ability to thrive as we continue to experience

important to our heath and the camaraderie it brings dining together on the sidewalk area. It also supports our
restaurants financially when they have suffered so long to remain open for us.

Balboa Island had been beaten and battered financially over the past few years, COVID has taken its toll on all of us. The
dining establishments need two be able to utilize the outdoor dining spaces previously used. This provides a safe open
air atmosphere. The Ferry has suffered tremendously over the past month being unable to take cars. We need people to
have every reason to visit Balboa Island, please be the hero our restaurants need and approve outdoor dining. Thank

I am in support of continuing to allow parklets from Balboa Island to the Newport Pier area.
One of the few benefits of the pandemic was the addition of these parklets to local restaurants, enabling customers to
enjoy eating outdoors. My family and I frequently choose to dine at restaurants with this option and enjoy the alfresco
dining experience.

My comments are in regards to item SS3 Outdoor Dining in the Pubic Right of Way from Balboa Island to the Newport
Pier Area:
I am a resident of Newport Beach and frequent the Newport Peninsula. I know the pandemic has been very difficult on
businesses in our community. As a resident of Newport Beach, I enjoy the outdoor dining and wish it would continue. If
businesses want to continue to utilize their outdoor dining area, I sure hope our city council lets it continue- small
businesses could really use a break!
Neighboring cities such as Laguna Beach and Huntington Beach have adopted a policy such as the one being presented
today.
My brother-in-law and sister-in-law, Laura and Jerry Marroquin, have opened up 22nd Street Pizza on the peninsula
during the pandemic. I know their outdoor dining area is vital to their business. Please help them and all the small
businesses with outdoor dining on the peninsula. Please allow them to keep their outdoor dining areas.

Dear council
As a 40+ year resident of CDM, I am strongly in favor and asking you please DO NOT remove the wonderful
improvement to our community of outdoor sidewalk dining on Balboa Island!
This seating has more benefits than obstacles. It has enhanced the desirability of the island 10 fold. It gives you a reason
to want to go! It is a 100 percent positive for the island. It allows the city to benefit and gives the small restaurants and
businesses a chance to thrive during a pandemic. It keeps people employed.
Please find a way to keep the best thing that's happened to Balboa Island ever. This is nothing new. The most quaint and
famous historical cities and towns enjoy sidewalk dining. It's common. There must be a way. Who could possibly want to
add more disappointment to our little community? Haven't we all been through so much already?

I am writing in advance of the council agenda item set for Tuesday, February 8th regarding the evaluation of
outdoor/patio seating for restaurants situated on Balboa Island.
The pandemic has been incredibly challenging on businesses as we all know. Newport Beach has led the Orange County
market by staying focused on supporting our local businesses to help them get back on their feet after the devastating
effects of the closures that have taken place throughout the past 2 years.
The outdoor dining and patio seating that has been afforded to restaurants during this time has been essential and
continues to be essential for our restaurants to thrive.
Many people are still asking for outdoor seating options and will not patronize restaurants that do not offer that as an
option or have adequate outdoor seating available. We have patronized several restaurants on the balboa peninsula
throughout the pandemic and the outside seating areas have only enhanced the experience, both at the restaurant but
the overall energy and liveliness of the peninsula. There is a sense of community that has been established, people
laughing, eating and enjoying their times together. We have LOVED having the outdoor seating available and would
highly recommend that you continue to support our restaurants and allow outdoor patio seating to continue.

As a resident of Newport Beach and a frequent diner at restaurants in Orange County, I feel it is imperative to continue
to allow outdoor dining at resultants that do not have a existing place to do same. Since the start of the current
pandemic, I have not eaten indoors in a restaurant, I have howeve enjoyed very much eating at restaurants, like the
Royal Hen on Balboa Island, where they have created a lovely and safe outdoor dining atmosphere. I have health issues
that put me at high risk of becoming seriously ill if I were to get Covid, therefore it is a matter of health for me. But I
must also mention we live in a community where outdoor dining during the whole year is a gift, and taking it away will
not only be a hazard to those of us with health concerns, but also financially hurt those restaurants that do not have a
place to dine outdoors.

As long-time residents of Newport Beach we would like to encourage you to continue allowing on a permanent basis the
sidewalk dining that has become such a welcome part of our City. Originally allowed in an effort to provide some
"normalcy" in an otherwise abnormal last year or more, it begs the question "Why haven't we allowed this before?". It
seems to have added additional charm and attractiveness to the community providing a source of comfort, community
and neighborhood charm that has enhanced an already amazing City.
