TITLE: Resolution No. 2022-18: Reestablishing the City Council Homeless
Ad Hoc Committee

The Newport Beach City Council formed a Homeless Ad Hoc Committee (Committee) in
November 2019 to analyze issues related to people experiencing homelessness. The
Committee expired on December 31, 2020. Staff is recommending that the Committee be
reestablished and be responsible for evaluating the contracted services associated with
the City of Newport Beach (City) homeless outreach program.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2022-18, A Resolution of the City Council of the City of Newport
Beach, California, Reestablishing the Newport Beach City Council Homeless Ad Hoc
Committee.
DISCUSSION:
The Homeless Ad Hoc Committee (Committee) was formed by the City Council in
November 2019 to analyze issues related to people experiencing homelessness. The
Committee expired on December 31, 2020, without making a recommendation to the City
Council.
The City has since further developed its homeless outreach program and expanded the
services available to individuals experiencing homelessness in the community. At the
January 29, 2022 City Council Planning Session, Council discussed the program and the
contracted services provided. Council members expressed interest in evaluating whether
the City's existing services were adequately serving individuals experiencing homeless in
Newport Beach.

Should the City Council reestablish the Committee, it would be comprised of Council
Members Brad Avery, Joy Brenner and Will O'Neill, and be responsible for evaluating the
contracted services under the City's homeless outreach program. The services include,
but are not limited to, City Net, the Costa Mesa Temporary Bridge Shelter, the Be Well
OC Mobile Crisis Unit, the Trellis International Community Impact Team, and Permanent
Supportive Housing. The Committee would expire upon making its recommendations to
the full City Council or on December 31, 2022, whichever occurs first.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, REESTABLISHING
THE NEWPORT BEACH CITY COUNCIL HOMELESS AD
HOC COMMITTEE
WHEREAS, on March 26, 2019, the City Council adopted Resolution No. 2019-
25 establishing a City Council/Citizens' Committee known as the Newport Beach
Homeless Task Force ("Task Force") to study the impacts of homelessness on the City
of Newport Beach ("City") and develop solutions to end homelessness;
WHEREAS, on May 14, 2019, the City Council adopted Resolution No. 2019-42,
increasing the membership of the Committee to three (3) councilmembers and seven
(7) residents;
WHEREAS, on September 14, 2019, the City Council adopted Resolution No.
2019-85 declaring a shelter crisis pursuant to Senate Bill 850 as codified in California
Government Code Section 8698.2;
WHEREAS, as a result, on November 12, 2019, the Task Force recommended
that the City Council reconstitute the character, membership, and purpose to form a City
Council ad hoc committee ("Committee")-,
WHEREAS, on November 19, 2019, the City Council adopted Resolution No.
2019-100 reconstituting the character, membership, and purpose of the Committee;
WHEREAS, pursuant to Resolution 2019-100 the Committee expired on
December 31, 2020 without making a recommendation to the City Council;
WHEREAS, in the interim, the City has significantly expanded services to
individuals experiencing homeless;
WHEREAS, at the January 29, 2022 City Council Planning Special Meeting, the
City Council expressed interest in evaluating whether the City's existing programs
adequately serve individuals experiencing homeless within Newport Beach particularly
in the wake of COVID-19; and
WHEREAS, the City wishes to reestablish the Committee.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:

Section 1: The Committee shall be comprised of three (3) councilmembers.
Council Member Avery, Council Member Brenner, and Council Member O'Neill shall
serve as members of the Committee. The term of the appointed members of the
Committee shall be indefinite pending City Council action or expiration of the Committee
as set forth in this resolution.
Section 2: The sole purpose and responsibility of the Committee shall be to
evaluate whether the City's established contract services, including but not limited to,
City Net, Costa Mesa Temporary Bridge Shelter, Be Well OC Mobile Crisis Unit,
Permanent Supportive Housing and/or Trellis International Community Impact Team
adequately serve individuals experiencing homeless within Newport Beach.
Section 3: The Committee shall function as an ad hoc committee and shall not
be subject to the Brown Act.
Section 4: The Committee shall expire upon making its recommendations to
the entire City Council, at a noticed public meeting of the City Council, or December 31,
2022, whichever occurs first.
Section 5: If any section, subsection, sentence, clause or phrase of this
resolution is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The
City Council hereby declares that it would have passed this resolution and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 6: The recitals provided in this resolution are true and correct and are
incorporated into the substantive portion of this resolution.
Section 7: The City Council finds the adoption of this resolution is not subject
to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2)
(the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6,
Chapter 3, because it has no potential for resulting in physical change to the
environment, directly or indirectly.

Section 8. This resolution shall take effect immediately upon its adoption by
the City Council, and the City Clerk shall certify the vote adopting this resolution.
