The City Council formed a City Council Ad Hoc Redistricting Committee (Committee) to study and recommend to the City Council an updated Council redistricting map based on the results of the 2020 census. For the City Council's consideration is an ordinance to introduce recommended changes to the City Council district boundaries in compliance with the City's charter, state and federal laws. RECOMMENDATION: a) Conduct a public hearing; b) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and c) Waive full reading, direct the City Clerk to read by title only, introduce Ordinance No. 2022-7, An Ordinance of the City Council of the City of Newport Beach, California, Changing and Redefining the City Council District Boundaries as a Result of the United States Census Bureau's 2020 Census, and pass to second reading on March 22, 2022. DISCUSSION: The City of Newport Beach (City) is divided into seven City Council districts. The City's Charter requires the seven City Council districts to be adjusted every 10 years to reflect changes in population following a national census. On September 28, 2021, pursuant to Charter Section 1005, the City Council appointed a Committee comprised of Council Members Diane Dixon, Brad Avery and Will O'Neill to analyze the census results in a public forum and make recommendations regarding the advisability of redistricting the City's existing seven City Council districts. 1-1 Ordinance No. 2022-7: City Council Redistricting Map (PA2021-035) March 8, 2022 Page 2 Committee Review and Recommendation The Committee held two public meetings to consider proposed changes to the Council District boundaries. The Committee reviewed the results of the U.S. Decennial Census 2020 and determined the current districts were unbalanced and did not meet the minimal 10 percent deviations for each district to be considered "equal population". Pursuant to California Elections Code Section 21620, the recent Fair Maps Act of 2020 (AB 849), and the City's Charter Section 1005, the Committee studied the current district boundaries with the following criteria set forth: • Population balance (approximately 12,100 people per district); • Geographically Contiguous; • Easily Identifiable Boundaries; • Undivided Neighborhoods & "Communities of Interest"; • Compactness of Areas; and • Maintain the current geography of the existing districts as much as possible. The Committee considered a total of 11 maps (nine submitted by the public and two submitted by the City's consultant from National Demographic Corporation). The Committee concluded that four of the public maps were non-compliant per the criteria. The Committee recommended seven maps for the City Council to consider with one map highly recommended. On February 8, 2022, the City Council conducted a study session on the seven maps and unanimously chose the map (Attachment A) that best met the Committee's goals in balancing the City's population among the seven districts. Staff Technical Changes to the Proposed Council District Map Subsequent to the February 8, 2022 Study Session, staff performed a technical review to prepare the proposed Council District Map for adoption. Staff identified an issue with the proposed boundary between District 5 and District 6 along Bayside Drive. A single census block spans from the Balboa Island Bridge to Carnation Avenue in Corona del Mar, creating an extension into District 6 (Attachment B). Staff recommends splitting the census block at EI Paseo Drive and Bayside Drive for a more logical and cohesive district boundary. Since the "census block" is the lowest measurable geographic unit, the population was interpolated based upon the existing housing units to estimate the proportion of population to remain in District 5 and added to District 6. (Attachment C). A census block split detail legal description is also attached to the ordinance to be clear on which parcels are in District 5 and in District 6. 1-2 Ordinance No. 2022-7: City Council Redistricting Map (PA2021-035) March 8, 2022 Page 3 If the ordinance is introduced with no further changes, then it will be brought back for final adoption on March 22, 2022. If adopted, the ordinance, along with a standardized census geographic electronic file that assigns each district to established census geographic boundaries, will be forwarded to the Orange County Registrar of Voters. FISCAL IMPACT: There is no fiscal impact in approving this item. The cost of hiring National Demographic Corporation to assist with the redistricting process was $41,000. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Ordinance No. 2022-7 and Proposed City Council Redistricting Map Attachment B — Census Block 1023 — Full Census Block (Including all of District 5) Attachment C — Census Block 1023 — (Split Between District 5 and District 6) 1-3 Attachment A Ordinance No. 2022-7 and Proposed City Council Redistricting Map 1-4 ORDINANCE NO. 2022- 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, CHANGING AND REDEFINING THE CITY COUNCIL DISTRICT BOUNDARIES AS A RESULT OF THE UNITED STATES CENSUS BUREAU'S 2020 CENSUS WHEREAS, Section 200 of the Charter of the City of Newport Beach ("Charter") vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges or procedures granted or prescribed by any law of the State of California; WHEREAS, Section 1005 of the Charter requires the City Council to appoint a committee to study the advisability of redistricting the City every ten (10) years following the national census; WHEREAS, on September 28, 2021, the City Council adopted Resolution 2021- 86, creating the Ad Hoc Redistricting Committee comprised of then Mayor Avery and Councilmembers Dixon and O'Neill, WHEREAS, the City retained National Demographics Corporation, demographers experienced in drawing voting district maps that comply with the California Elections Code Section 21620 et seq. ("Fair Maps Act") and applicable state and federal election laws; WHEREAS, public hearings were held by the Ad Hoc Redistricting Committee on November 8, 2021, and December 13, 2021, in the City Council Chambers located at 100 Civic Center Drive, Newport Beach, California to consider whether the city council district boundaries should be adjusted and to review maps prepared by National Demographics Corporation and members of the public. A notice of the time, place, and purpose of the public hearings were given in accordance with California Government Code Section 54950 et seq. ("Ralph M. Brown Act") and the Fair Maps Act. Evidence both written and oral, was presented to, and considered by the Ad Hoc Redistricting Committee at the hearings; WHEREAS, at the conclusion of the December 13, 2021 hearing, the Ad Hoc Redistricting Committee voted to forward to the City Council, District Map Nos. 1, 2, 3, 5, 6, 7 and 8 with a recommendation to adopt City Council District Map No. 1; 1-5 Ordinance No. 2022 - Page 2 of 4 WHEREAS, a public hearing was held by the City Council on February 8, 2022 in the City Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A notice of the time, place and purpose of the item was given in accordance with the Ralph M. Brown Act and Fair Maps Act. Evidence both written and oral, was presented to, and considered by the City Council at the hearing; WHEREAS, at the meeting, the City Council reviewed and considered the recommendation of the Ad Hoc Redistricting Committee; and WHEREAS, a public hearing was held by the City Council on March 8, 2022 in the City Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A notice of the time, place and purpose of the item was given in accordance with the Ralph M. Brown Act and Fair Maps Act. Evidence both written and oral, was presented to, and considered by the City Council at the hearing. NOW THEREFORE, the City Council of the City of Newport Beach ordains as follows: Section 1: The boundaries of the seven (7) City Council Districts of the City of Newport Beach shall be as depicted in the City Council Districts Map set forth in Exhibit "A," further detailed in the Council Districts Map Census Block Equivalency File set forth in Exhibit "B," and with the boundary between City Council Districts 5 and 6 further depicted in Exhibit "C." Exhibits A through C are attached hereto and incorporated herein by this reference. Section 2: In adopting Ordinance No. 2022-_, it is the intention of the City Council that the district numbers and boundaries as set forth herein shall replace and supersede all prior district numbers and boundaries as originally established by the City Charter and as subsequently modified by ordinance. Section 3: The City Clerk is authorized to take any additional actions necessary to implement the provisions of the ordinance. 1-6 Ordinance No. 2022 - Page 3 of 4 Section 4: If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional. Section 5: The City Council finds the introduction and adoption of this ordinance is exempt from environmental review under the California Environmental Quality Act ("CEQA") pursuant to Section 15320 — Class 20 (Changes in Organization of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it does not change the geographical area in which previously existing powers are exercised. 1-7 Ordinance No. 2022 - Page 4 of 4 Section 6: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be published pursuant to City Charter Section 414. This ordinance shall be effective thirty (30) calendar days after its adoption.
