TITLE: Ordinance No. 2022-7: City Council Districting Map (PA2021-035)
ABSTRACT -
For the City Council's consideration is the adoption of Ordinance No. 2022-7,
revising the City Council Districts pursuant to Charter Section 1005. The attached
ordinance was introduced and considered at the March 8, 2022, City Council
Meeting.
RECOMMENDATION:
a) Find this project statutorily exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because this action will not result in a physical change to the environment, directly or
indirectly; and
b) Conduct second reading and adopt Ordinance No. 2022-7, An Ordinance of the
City of Newport Beach, California, Changing and Redefining the City Council
District Boundaries as a Result of the United States Census Bureau's 2020
Census.
DISCUSSION:
On February 8, 2022, the City Council accepted the City Council Ad -Hoc Redistricting
recommendation to revise the Council District boundaries as a result of the Census 2020
population changes.
On March 8, 2022, the City Council introduced the attached ordinance and made no
further changes. For City Council's consideration is the proposed ordinance. If adopted,
the ordinance, along with a standardized census geographic electronic file that assigns
each district to established census geographic boundaries, will be forwarded to the
Orange County Registrar of Voters.

FISCAL IMPACT:
There is no fiscal impact in approving this item. The cost of hiring National Demographic
Corporation to assist with redistricting process was $41,000.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, CHANGING AND
REDEFINING THE CITY COUNCIL DISTRICT
BOUNDARIES AS A RESULT OF THE UNITED STATES
CENSUS BUREAU'S 2020 CENSUS
WHEREAS, Section 200 of the Charter of the City of Newport Beach ("Charter")
vests the City Council with the authority to make and enforce all laws, rules and
regulations with respect to municipal affairs subject only to the restrictions and
limitations contained in the Charter and the State Constitution, and the power to
exercise, or act pursuant to any and all rights, powers, and privileges or procedures
granted or prescribed by any law of the State of California;
WHEREAS, Section 1005 of the Charter requires the City Council to appoint a
committee to study the advisability of redistricting the City every ten (10) years following
the national census;
WHEREAS, on September 28, 2021, the City Council adopted Resolution 2021-
86, creating the Ad Hoc Redistricting Committee comprised of then Mayor Avery and
Councilmembers Dixon and O'Neill,
WHEREAS, the City retained National Demographics Corporation,
demographers experienced in drawing voting district maps that comply with the
California Elections Code Section 21620 et seq. ("Fair Maps Act") and applicable state
and federal election laws;
WHEREAS, public hearings were held by the Ad Hoc Redistricting Committee on
November 8, 2021, and December 13, 2021, in the City Council Chambers located at
100 Civic Center Drive, Newport Beach, California to consider whether the city council
district boundaries should be adjusted and to review maps prepared by National
Demographics Corporation and members of the public. A notice of the time, place, and
purpose of the public hearings were given in accordance with California Government
Code Section 54950 et seq. ("Ralph M. Brown Act") and the Fair Maps Act. Evidence
both written and oral, was presented to, and considered by the Ad Hoc Redistricting
Committee at the hearings;
WHEREAS, at the conclusion of the December 13, 2021 hearing, the Ad Hoc
Redistricting Committee voted to forward to the City Council, District Map Nos. 1, 2, 3,
5, 6, 7 and 8 with a recommendation to adopt City Council District Map No. 1;

WHEREAS, a public hearing was held by the City Council on February 8, 2022
in the City Council Chambers located at 100 Civic Center Drive, Newport Beach,
California. A notice of the time, place and purpose of the item was given in accordance
with the Ralph M. Brown Act and Fair Maps Act. Evidence both written and oral, was
presented to, and considered by the City Council at the hearing;
WHEREAS, at the meeting, the City Council reviewed and considered the
recommendation of the Ad Hoc Redistricting Committee; and
WHEREAS, a public hearing was held by the City Council on March 8, 2022 in
the City Council Chambers located at 100 Civic Center Drive, Newport Beach, California.
A notice of the time, place and purpose of the item was given in accordance with the
Ralph M. Brown Act and Fair Maps Act. Evidence both written and oral, was presented
to, and considered by the City Council at the hearing.
NOW THEREFORE, the City Council of the City of Newport Beach ordains as
follows:
Section 1: The boundaries of the seven (7) City Council Districts of the City of
Newport Beach shall be as depicted in the City Council Districts Map set forth in Exhibit
"A," further detailed in the Council Districts Map Census Block Equivalency File set forth
in Exhibit "B," and with the boundary between City Council Districts 5 and 6 further
depicted in Exhibit "C." Exhibits A through C are attached hereto and incorporated
herein by this reference.
Section 2: In adopting Ordinance No. 2022-_, it is the intention of the City
Council that the district numbers and boundaries as set forth herein shall replace and
supersede all prior district numbers and boundaries as originally established by the City
Charter and as subsequently modified by ordinance.
Section 3: The City Clerk is authorized to take any additional actions
necessary to implement the provisions of the ordinance.

Section 4: If any section, subsection, sentence, clause, or phrase of this
ordinance is for any reason held to be invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portions of this ordinance.
The City Council hereby declares that it would have passed this ordinance and each
section, subsection, sentence, clause, or phrase hereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses, or phrases be declared
invalid or unconstitutional.
Section 5: The City Council finds the introduction and adoption of this
ordinance is exempt from environmental review under the California Environmental
Quality Act ("CEQA") pursuant to Section 15320 — Class 20 (Changes in Organization
of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14,
Division 6, Chapter 3, because it does not change the geographical area in which
previously existing powers are exercised.

Section 6: The Mayor shall sign and the City Clerk shall attest to the passage
of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be
published pursuant to City Charter Section 414. This ordinance shall be effective thirty
(30) calendar days after its adoption.
This ordinance was introduced at a regular meeting of the City Council of the City
of Newport Beach held on the 8th day of March, 2022, and adopted on the 22nd day of
March, 2022, by the following vote, to -wit:
