TITLE: Slurry Seal Program (Project No. 21 R04) — Notice of Completion for
Contract No. 7893-1
ABSTRACT:
On March 9, 2021, the City Council awarded Contract No. 7893-1 for the Slurry Seal
Program project to American Asphalt South, Inc. The work is now complete and staff
requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The Slurry Seal Program project included distributing construction notices to affected
residents and businesses; clearing existing pavement of debris, soils and other loose
materials; removing existing traffic striping, pavement markings, and raised pavement
markers; weed removal and crack sealing; edge grinding; placing asphalt slurry seal;
placing asphalt seal coat; installing new traffic striping, pavement markings and raised
pavement markers; and other incidental items of work necessary to complete the work
within the Balboa Peninsula, Newport Village, Lido Isle, West Newport, and Superior
Heights communities. The project also included seal coating and striping two large
city -owned parking lots at Balboa Pier and Newport Pier.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final contract cost was $1,038,865.53, which was approximately 0.35 percent lower
than the original bid amount. This minor cost decrease was primarily due to the deletion
of edge grinding at locations where grinding was not necessary and the removal of seal
coating a portion of the Newport Pier parking lot since it was occupied by outdoor dining
during the pandemic. Change orders for the project were for additional seal coating of the
parking lot at the corner of Newport Boulevard and 32nd Street, slurry sealing two
pedestrian pathways along the beach sand area, and slurry sealing Via Lido across the
Lido Isle bridge.
Additional time was granted to the contractor to complete the change order work.
Because of the location of this project, the contractor was directed to not work during the
busy summer season to minimize public inconvenience.

ENVIRONMENTAL REVIEW:
On March 9, 2021, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance
of existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
