ZC2022-007 (PA2022-069) APPLICANT: Jill Wallace LOCATION: 813 West Balboa Boulevard LEGAL DESCRIPTION Lot 9, Block 7, East Newport Tract On March 28, 2022, Zoning Clearance No. ZC2022-007 (PA2022-069) was approved authorizing the development of a 273-square-foot Accessory Dwelling Unit (ADU) within the first-floor level a rear detached structure. The ADU will be constructed in conjunction with a remodel of the existing duplex. This approval is based on the following standards. 1. The project is for an Accessory Dwelling Unit. 2. The project is located in the R-2 zoning district and is a permitted use. 3. There is a multi-unit development (duplex) on the lot. 4. The project is classified as the conversion of an internal portion of an existing multi- unit dwelling or accessory structure. 5. The project complies with all conditions and applicable development standards of Section 20.48.200 (Accessory Dwelling Units). 6. The project is located in the coastal zone, but exempt for the following reason: the scope of the remodel does not involve the addition of greater than 10 percent gross floor area or height. Nor does the structural alteration involve the replacement of more than 50 percent of the exterior structural members that would deem this project a new structure. 7. A deed restriction will be recorded prior to the issuance of a building permit related to occupancy restrictions (if applicable), prohibition on the separate conveyance, and restrictions on short-term rentals.
