Regarding question 1): There are no size limits for conversions.
Regarding question 2): The City cannot prohibit ADUs and JADUs under §65852.2(e)(1).
Please send us a map of your Very High Fire Hazard Severity Zone.

Hello,
Can you please help us out on the following questions?
1. On conversion of space within a single-family residence, are we still allowed to apply the
maximum unit size of 850 s.f. for one bedroom and 1,000 s.f. for two bedroom?
2. Portions of the City are within a Very High Fire Hazard Severity Zone. Due a public safety
concern, we would like to prohibit new ADUs from locating on parcels within the zone.
Government Code Section 65852.2(a)(1)(A) allows the City to designate areas based on public
safety; however, Government Code Section 65852.2(e)(1) appears to conflict with this by stating
the City shall approve the four types of ADUs/JADUs ministerially. Can the City prohibit the
ADUs and JADUs, including the four types listed in §65852.2(e)(1) within the Very High Fire
Hazard Severity Zone?
