NOTICE OF INCOMPLETE COASTAL DEVELOPMENT
PERMIT APPLICATION FILING

Please be advised that after reviewing the subject application, your submittal has been
deemed incomplete and further information is required before we are able to proceed
with the application process.
The following documentation is required to complete the application:
1. Property Development Standards.
Please be advised, the project as designed does not comply with all required property
development standards identified in Newport Beach Municipal Code (NBMC)
Chapter 21.30 (Property Development Standards). Redlines and the plan check
correction sheet are available at City Hall for pickup. Please include the redlined plan
set in your resubmittal.
2. Plant Selection and Grouping.
The project is located within 50 feet of a beach area. Please have landscape
professional add note to plans that no prohibited plant types (per the California
Invasive Plant Council and California Native Plant Society) are proposed.
3. Construction Pollution Prevention Plan (CPPP).
As this property is within 200 feet of a beach or bay, please provide a Construction
Pollution Prevention Plan (CPPP) in compliance with Newport Beach Municipal Code
(NBMC) Section 21.35.030. The CPPP shall describe the temporary best
management practices (BMPs) the development will implement to minimize erosion
and sedimentation during construction, and to minimize pollution of runoff and coastal
waters by construction chemicals and materials. The level of detail provided to
address the plan’s requirements shall be commensurate with the type and scale of

development, and the potential for adverse water quality and hydrologic impacts to
coastal waters.
4. Preliminary Geotechnical Report.
As this property is located within a coastal hazards area subject to liquefaction,
please provide a copy of the preliminary geotechnical report for this project.
5. Coastal Hazards Report.
The Coastal Hazards Report states that the bay water elevation will reach
approximately 10.70 NAVD88 in approximately 75 years (i.e. the life of the structure)
however the report states that the bulkhead shall be raised immediately to 11.80
NAVD88 in some places and 12.88 NAVD88 in others. This requires raising the
bulkhead more than 42” from the existing elevation of 8.59 (lowest point). Please
revise the report to explain why the bulkhead must be raised higher than the 10.90
NAVD88 standard set by the City of Newport Beach to provide flood protection.
6. Miscellaneous
A Project Review Request has been routed to the Building Division and Public Works.
Their comments will be given to you as soon as they become available.
Please be aware, a Waiver of Future Protection will likely be required as a condition
of approval for this project in accordance with Section 21.30.015(E)(5). This is a
recorded agreement waiving any potential right to future protection devices to
address threats from natural hazards for the economic life of the development.
Upon verification of completion, the application will be processed and scheduled for a
Zoning Administrator Hearing. Should you have any questions regarding submittal
