Local Coastal Program Amendment No. LC2019-007
Amendment to Setback Map S-1A - West Newport
Request to amend the Implementation Plan (IP) of the City’s Local Coastal Program to
revise Setback Map No. S-1A to adjust the required setbacks for property located at
6501/6503 Seashore Drive. In conjunction with the amendments, this action would revoke
Variance No. VA0012 and Modification No. MD2343 previously authorized for the site
permitting setback encroachments for the existing dwelling. Although no new
development is proposed, the amendments would establish setbacks and buildable area
applicable to future development of the property comparable with other properties in the
vicinity.
Proposed Amendments
Development setbacks for the property at 6501/6503 Seashore Drive are depicted on
Setback Map S-1A - West Newport as set forth in Section 21.80.040 (Setback Maps) of
the Newport Beach Municipal Code (NBMC). This proposal would amend Section
21.80.040 of the NBMC to change the setback map to match the surrounding properties.

Notice of Availability
Pursuant to Section 13515 of the California Code of Regulations, review of the draft LCP
amendment was made available and a Notice of Availability was distributed on February
14, 2020. The notice was sent to all persons and agencies on the Notice of Availability
mailing list, posted on the City’s website, and made available for review at City Hall and
City library locations.

Public Participation
The proposed LCP amendment, and related Zoning Code Amendment, underwent the
public review process that included multiple noticed public hearings as follows:
February 20, 2020 Planning Commission- Noticed Public Hearing
April 14, 2020 City Council- Noticed Public Hearing
April 28, 2020 City Council- 2nd Reading of Ordinance (Zoning Code Amendment)
The project was presented to the Planning Commission on February 20, 2020, at a
noticed public hearing. At the conclusion of the hearing, the Planning Commission voted
6-0 to recommend approval of the proposed amendments to the City Council.
The project then proceeded to the City Council where it was approved on April 14, 2020,
and with a second reading of the ordinances related to the Zoning Code amendment and
LCP amendment on April 28, 2020. Upon Coastal Commission’s approval of the changes
to Setback Map No. S-1A, the City’s ordinances will take effect.
Notice of the public hearings was published in the Daily Pilot, the local adjudicated
newspaper, mailed to all owners of property within 300 feet of the boundaries of the site
(excluding intervening rights-of-way and waterways), and posted on the subject property
at least ten days before the scheduled meeting. Copies of the proof of publication is
attached.
Environmental Review
The project is exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15305 under Class Class 5 (Minor Alterations in Land Use Limitations) of the
CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it is a
minor change to the setbacks (a land use limitation). The site does not have an average
slope that exceeds 20 percent and this action will not result in a change to the land use
or density. Furthermore, none of the exceptions listed in CEQA Guideline Section 15300.2
apply
Summary
