The purpose of this memorandum is to clarify the meaning and intent of Condition No. 21 that reads
as follows:
21. A minimum of two (2) on-site parking spaces shall always be made available for the
restaurant’s use. The two (2) parking spaces shall be maintained in an approved
configuration providing on-site parking spaces, as approved by the Building Division
and Public Works Department to meet accessibility requirements, if deemed
necessary or appropriate.
As approved through Conditional Use Permit no. UP2020-198 (PA2020-356), the project plans
showed two parking spaces in the rear for the restaurant use and one parking space for the
residential use above. Subsequent to the Use Permit action, the applicant received accessibility-
related comments from the Building Division to provide a van accessible space and access aisle.
This resulted in the restriping of the lot and the loss of one commercial parking space in the rear of
the building.
As approved under Plan Check No. 1233-2021, the project will provide one commercial parking
space that complies with current Building Division requirements.
Updated project plans are attached to memorialize the revision to the parking layout.
