Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Antony Brine, City Traffic Engineer, tbrine@newportbeachca.gov PHONE: 949-644-3329 TITLE: Resolution No. 2022-27: Overnight Parking Prohibition on Old Newport Boulevard ABSTRACT: Staff has been observing a number of vehicles parking long-term along Old Newport Boulevard between 15th Street and Hospital Road. There have been a number of litter, pollution and safety issues associated with the long-term parking. A resolution has been prepared to prohibit overnight parking between 10 p.m. and 6 a.m. daily on both sides of this segment of Old Newport Boulevard. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2022-27, A Resolution of the City Council of the City of Newport Beach, California, Prohibiting Overnight Parking on Old Newport Boulevard between 15th Street and Hospital Road. DISCUSSION: Overnight and long-term parking has become a problem along Old Newport Boulevard south of 15th Street. There have been issues with littering, pollution, dumping of waste, and safety concerns. A resolution has been prepared that, if adopted, would prohibit overnight parking on Old Newport Boulevard between 15th Street and Hospital Road from 10 p.m. to 6 a.m. There are numerous medical offices along this segment of Old Newport Boulevard, with most closing at 5 p.m. There is only one business that closes at 9 p.m. There will be no impacts to business parking. Staff believes the prohibition of overnight parking should eliminate the potential for continuing problems. 6-1 Resolution No. 2022-27: Overnight Parking Prohibition on Old Newport Boulevard May 10, 2022 Page 2 FISCAL IMPACT: Cost for installing signage will be approximately $3,000 for materials and labor. There are sufficient funds in the operating budget to absorb these costs. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENTS: Attachment A — Resolution No. 2022-27 Attachment B — Location Map 6-2 ATTACHMENT A RESOLUTION NO. 2022- 27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA PROHIBITING OVERNIGHT PARKING ON OLD NEWPORT BOULEVARD BETWEEN 15th STREET AND HOSPITAL ROAD WHEREAS, Section 12.44.160 of the Newport Beach Municipal Code provides that the City Council shall by resolution designate streets or portions of streets on which the parking or standing of vehicles after 6:00 P.M. and before 6:00 A.M. the next day is to be prohibited; and WHEREAS, the City Council shall designate in the resolution the days of the week and the exact hours during which such prohibition shall be in effect; and WHEREAS, the City Council has determined that it is reasonable and in the public interest to prohibit overnight parking on Old Newport Boulevard as hereinafter provided. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby resolve that the parking of vehicles shall be prohibited on Old Newport Boulevard between 15th Street and Hospital Road daily from 10:00 P.M. to 6:00 A.M. Section 2: The City Traffic Engineer is authorized and directed to cause signs to be posted on Old Newport Boulevard giving notice of the parking restrictions enacted by this resolution, which shall be immediately enforceable after such signs have been posted. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. o c, Resolution No. 2022 - Page 2 of 2 Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. ADOPTED this 10th day of May, 2022.
