Enclosed is the FAA's official position on the request for a two mile extension of the reapplication of power. Although the determination is that the delay would not be feasible, we continue to be committed to assisting you whenever possible to effect our common goal of reducing the overall noise in the adjacent communities. Please feel free to ask for our assistance should you decide to test an alternate procedure. It is our opinion that the procedure requiring an aircraft to delay its thrust an additional two miles at this location is not feasible. This position is based primarily upon safety concerns. The Orange County Airport Radar Service Area (ARSA) is scheduled for implementation in July 1989. If the Airport Manager's proposal was adopted, it could place jet departures underneath the "floor" of the ARSA. This would place departures in an unprotected area, and this does not ensure the level of safety necessary for the aircraft and the community. We suggest that -the Airport Manager pursue other avenues to enhance noise abatement procedures. For example, the current fleet of jet aircraft that operate at this airport are much quieter than aircraft were when the current departure procedure was developed. Because of this, the possibility exists that some type of a normal thrust procedure utilizing a best angle of climb might be feasible. However, any change or modification of current operating procedures must be initiated by the Airport Manager. His office is also responsible for all environmental issues and ensure that proper coordination with all affected parties is accomplished. Any proposed modification which may change the Environmental Impact Statement currently in effect will have to be judiciously managed. The Federal Aviation Administration would be able to assist in the capacity of a technical advisor. We hope that this memorandum clarifies our position on this matter. Rea Air Traffic Manager Orange County FAA Tower 18990 Ike Jones Road Santa Ana, CA 92707 Dear Tom: Thank you for your letter of February 24, 1989 in which you informed me of the FAA's determination that requiring an aircraft to delay its thrust an additional two miles past the coastline is not feasible. As you are aware my request for the determination was made on behalf of the City of Newport Beach, particularly the residents of Balboa Island. However, I am somewhat confused by Jacqueline L. Smith's memo to you of February 23, 1989 which seems to imply that airport management has responsibility for modifications to aircraft flight procedures. I am equally surprised at her position that the FAA is merely a technical advisor in such matters. In the airport's opinion, there is simply no question but that the FAA has the exclusive authority to regulate the operation of aircraft in flight, for noise abatement, safety or any other reasons. Local airport proprietors, such as the County, or any other state or local government, are preempted from implementing direct regulation of the flight procedures of aircraft operating in the navigable airspace of the United States. The position expressed in the February 23 memo is an abdication of FAA existing authority in an attempt to force the airport to assume responsibility for matters which Congress has specifically mandated that FAA control, initiate, and implement as FAA deems appropriate under the circumstances. FAA's policy is an invitation to the County to assume responsibility for matters over which it has no regulatory authority, and to assume legal and political responsibilities for matters which are exclusively under the jurisdiction, control and authority of the Federal Aviation Administration. The flight procedures currently in use at John Wayne Airport are the result of cooperation and development between the airlines, the aircraft manufacturers, and the FAA --the three entities which have the responsibility, the expertise and the authority to make the appropriate judgments.
