TITLE: American Legion Bulkhead Wall Repair (Project No. 16H 11) — Award
of Contract No. 7659-1

Staff has received construction bids for the American Legion Bulkhead Wall Repair and
requests the City Council's approval to award the construction contract to Applied
Restoration, Inc. The project includes installing a new external steel wale beam along the
length of the existing bulkhead to provide additional structural stability and to increase its
useful life.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301, Class 1 (Existing Facilities - maintenance of existing public
facilities involving negligible or no expansion of use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3 because it has no potential to have
a significant effect on the environment;
b) Approve the project plans and specifications;
c) Award Contract No. 7659-1 to Applied Restoration, Inc. for the total bid price of
$991,600, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish a contingency of $99,200 (approximately 10 percent of total bid) to cover the
cost of unforeseen work not included in the original contract.
DISCUSSION:
The City of Newport Beach (City) owns the property at 215 15'" Street, and leases the
premises, including the marina, to the American Legion. As part of the Rhine Channel /
American Legion dredging project in 2011, the City agreed to study the feasibility of
repairing or replacing the existing vertical bulkheads at the property. A study was
conducted in 2018 which originally identified a need to strengthen the existing wall and
suggested installing a new tie -back system throughout, as well as replacing the concrete
cap along the top of the bulkhead wall so as to anchor the new tie -back rods. However,
the cap replacement component would then facilitate the need for other ancillary
upgrades which included installing a new Americans with Disabilities Act (ADA) gangway,
in addition to significantly modifying the existing float system and piles to accommodate
this larger gangway. The gangway modification added substantial cost to the project.

As a result, staff reviewed the approach of repairing the existing wall through value
engineering and identified an alternate design which includes attaching a wale beam
along the exterior bulkhead surface, just below the existing concrete cap, via a series of
tiebacks. This approach eliminated the cap replacement option which therefore eliminated
the costly gangway replacement and corresponding marina modifications. Although this
modified and simplified approach has an anticipated reduced lifespan (25-35 years vs.
75 years for full cap replacement), the savings to the City of approximately $1.0 million is
significant. In the future, the bulkhead will eventually require replacement and the access
to the adjacent marina upgraded to meet ADA standards.
Permits have been secured from the California Coastal Commission, Santa Ana Regional
Water Quality Control Board, and the Army Corps of Engineers.
At 10 a.m. on April 21, 2022, the City Clerk opened and read the bids for this project:

The City received four bids for this project. The low bid was 26% percent below the
Engineer's Estimate of $1,345,000. The lowest bidder, Applied Restoration, Inc.
possesses a California State Contractor's License Classification "A" as required by the
project specifications. A review of references for Applied Restoration, Inc. shows
satisfactory completion of concrete contracts for the City and other municipalities.
The proposed project includes distributing construction notices to affected residents and
businesses; creating a landside storage area in the American Legion parking lot adjacent
to the bulkhead; installing a steel wale beam along the exterior of the bulkhead; installing
tiebacks through the steel wale beam into the soil; repairing minor concrete spalling along
the existing bulkhead cap; and adjusting the interior marina headwalk to accommodate
the protrusion of the new steel wale beam.
Staff recommends awarding this construction contract to Applied Restoration, Inc.
Pursuant to the contract specifications, the contractor will have 140 consecutive working
days to complete the work. Work is scheduled to start in September 2022, after the Labor
Day holiday, to avoid construction during the American Legion's busy summer season,
and is anticipated to be substantially complete by the Christmas Boat Parade.
The project plans and specifications will be available for review at the May 24, 2022, City
Council meeting or upon request.
FISCAL IMPACT:
The Fiscal Year 2021-22 adopted Capital Improvement Program budget includes
sufficient funding for the award of this contract. Staff recommends establishing $99,200
(approximately 10 percent of total bid) for contingency purposes and unforeseen
conditions associated with construction. The following funds will be expensed.

NOTICING -
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item). In addition, staff has
coordinated with the American Legion on timing and design, and they are supportive of
the project. And lastly, the Harbor Commission reviewed the original project scope (cap
replacement) in October 2020 as required per Council Policy H-1 (Harbor Permit Policy).
