TERMS AND CONDITIONS OF ENCROACHMENT PERMIT
1 Encroachment Permits may be taken out by the owner of benefited property or a licensed contractor A licensed
contractor must provide a "Letter of Authorization" to allow another party to pull a permit An approved copy of the
permit and construction plan shall be kept at the lob site at all times Work which has been done prior to issuance of
a permit, is subject to rejection/fine City reserves the right to void permit if work does not commence within 30 days
after date of issuance
2 The Permittee agrees to defend, indemnify and hold the City its authorized agent, officers, representatives and
employees harmless from any responsibility, liability, suit or action of any description arising out of any accident, loss
or damage to persons or property occurring as a result of work undertaken under this permit
3 All work shall be done in accordance with the approved plans, Standard Special Provisions and Standard Drawings
of the City of Newport Beach, and in compliance with all applicable State laws and City ordinances
4 Permittee guarantees all work performed under this permit to be free of hidden and latent defects Any failures shall
be corrected within two weeks after notification to the satisfaction of the Public Works Director
5 A valid State licensed contractor must perform all construction within the public right-of-way, unless waived by the

6 All trenching and/or resurfacing shall conform to City Standard 105-L for parkway/roadway and City Standard 140-L,
in the alley, where a minimum half -alley width resurfacing shall be provided, unless otherwise directed by the Public
Works Dept Contractors shall obtain permits to perform excavation or trench work from the California Division of
Industrial Safety prior to commencing underground construction as required by State law Walls and faces of all
excavations over 5 feet in depth shall be protected by a shoring system, sloping of the ground, or other equivalent

PART IL SPECIFIC CONDITIONS AND REQUIREMENTS
1. DISCHARGE LIMITS AND CONDITIONS
a. All discharges must meet the District's Local Discharge Limits and all prohibitions in the
Ordinance before discharging to the Districts sewer. The effluent discharge shall not exceed
either the following concentration limits in mg/L at the sampling point, or originate from a
different source than that described below:

b. If monitoring shows non-compliance with the effluent discharge, Permittee is required to cease
discharge immediately and perform corrective actions as necessary with wastewater pretreatment to
meet compliance with the permit limits and the Ordinance.
c. Permittee shall make provisions to discharge at a rate that does not interfere with the operations of the
sewer system
d. Permittee shall take all necessary measures and actions, both in the design and operation of the
facility. to protect the sewer system from upset conditions and interference, such as spills and sewer
back up.
e. Permittee shall have provisions and procedures in place, such as isolation of discharge and diversion of
flow to alternate disposal sites, for temporary outages and shutdown of the sewer.
f. Pursuant to the authority set forth in Section 613 of the Ordinance, Permittee must immediately cease
all discharges to the sewer facilities if, at any time, the District, or its agent, determines that flow levels
in the sewer system may cause operation problems.
2. PRETREATMENT
Permittee shall provide all necessary pretreatment and waste minimization, and shall take all necessary
measures and install control systems to meet the District's discharge limits and prevent the discharge of
any constituent that either interferes with sewer facilities or is in violation of the District's prohibitions
3. FLOW MONITORING AND REPORTING
a. Permittee shall provide and maintain an effluent measuring system that is suitable for the application
and accurately measures and records the entire volume of wastewater discharged to the sewer system
with a minimum flow accuracy of =5%u See Effluent Flow Meter Requirements under Attachment 157
b Permittee shall obtain MONTHLY readings of the industrial wastewater volume to the sewer and submit
a report to the District on the 20th of the following month using the report form provided. (Permittee will
be provided with a form each month. Failure to receive a form from the District does not exempt
Permittee from obtaining and submitting flow data for that period.)
4. SELF -MONITORING REQUIREMENTS
Permittee shall conduct monitoring of its own discharges for the purpose of determining the status of
compliance and suitability for discharge The specific requirements are as follows

From the effective date of the permit and until the permit is terminated or revised, Permittee shall
monitor its wastewater discharge for the following parameters at the indicated frequency

B. Representative Sampling and laboratory Analyses
Samples and measurements taken as required herein shall be representative of the volume and nature
of the discharge during hours of discharge. All equipment used for sampling and analysis must be
routinely calibrated, inspected, and maintained to ensure accuracy.
C Frequency, Sampling Schedule and Due Dates for Submission of Reports
Sampling of wastewater effluent and reporting of results shall be done in accordance with the schedule
shown below. Sampling may be performed any day within the specified date range as designated in the
permit. If sampling cannot be conducted within the specified date for any valid reason, the District must
be notified in advance and in writing, of the reason(s) for the inability to sample and the new proposed
sampling date.

2. Monthly and Weekly Frequency Deadlines
a. Samples must be collected in accordance with the requirements specified in Part 4 Section A,
as applicable.
b. Depending on the self -monitoring frequency, sampling must be conducted in the following
manner, as applicable:
(i) Monthly Self -Monitoring (if applicable)
A sample of the wastewater effluent shall be collected and analyzed a minimum of one (1)
sampling day per month. The sampling day shall be rotated to the successively different
plant operational day during each month of monitoring.
(11) Weekly Self-Morthoring (If applicable)
A sample of the wastewater effluent shall be collected and analyzed a minimum of four (4)
sampling days per month (once a week). The sampling day shall be rotated to the
successively different plant operational day during each week of monitoring.
c. Reporting of monthly and weekly self -monitoring results must be done on a monthly basis.
Self -monitoring reports must be submitted by the twentieth (20th) day of the month following
sampling.
S. FEES AND CHARGES
Permittee is responsible for paying all fees in accordance with the District's Ordinances, the District's
Board resolutions, and the Districts Board -approved policies and procedures.
6. SPECIAL CONDITIONS
a. Penittee shall provide the District's staff unrestricted access to the facility and site to inspect,
monitor, or verify compliance with the District's Permit and Ordinance requirements. Permittee shall
make provisions to allow entry to the site for the purposes outlined herein at all times.
b. Permittee shall comply with the effluent meter calibration reporting as specified in Attachment 162.

c. Permittee shall submit a Close of Project Discharge Volume Report, Attachment 255, within 30 days
of project completion.
The terms and conditions of an issued Special Purpose Discharge Permit may be subject to
modification at the sole discretion of the District, based on a determination by the District that such
modification is necessary to comply with the objectives of the Ordinance.
For the pollutants of concern listed in the Permit limits, Permittee shall have provisions in place to
add appropriate pretreatment technology for removal of these pollutants if present in the site's
wastestream(s) at concentrations that may exceed the Permit limits.
If a rain/storm event is anticipated, perrmifte may be contacted by the District to haft discharge
leading up to and during the rain event. A rainstorm event is defined as forecasted or measured
precipitation of % inch or higher which may occur in any part of Orange County. Permittee shall
contact the District's Plant 1 Control Center at (714) 593-7025 or Resource Protection Division /
Permitting Group for permission to recommence discharge after the rainstorm event has concluded.

EFFLUENT FLOW METER REQUIREMENTS
METER INSTALLATION
The District requires accurate flow measurement for compliance and/or user charges determination.
To ensure accurate flow data, the District requires a Permittee discharging under a Dry Weather Urban Runoff
Permit to provide an effluent measuring system such as an effluent flow meter, to obtain flow measurement of
the dry weather urban runoff discharged into the Districts sewer system.
Permittee shall ensure by design, proper installation and calibration of a flow
measurement accuracy within t5% of the expected range of the flow (minimum, average,
and maximum)
A. EFFLUENT METER INSTALLATION REQUIREMENTS
The following are the minimum requirements for the installation of an effluent measurement system:
1. Effluent meter equipment (primary and secondary devices) must be accessible for reading, inspection,
maintenance, and calibration.
2. Discharge to the sewer must be hard -piped. Flexible connections are not acceptable when an effluent
meter is in the line.
3. No effluent meter component will be located in areas that require confined space entry.
4. Effluent meter system shall be located such that it obtains representative flow measurement of the
discharge to the sewer.
5. Pernittee shall make all necessary provisions to ensure accurate and proper calibration of flow
metering device, such as:
- Upstream water connection to allow city water to flow through the flow metering system during
calibration.
- Calibration simulator for in -line flow meter provided or approved by the flow meter manufacturer to
simulate flow conditions and output to instrumentation.
6. The flow metering system shall have a flow recorder and totalizer.
T. Re-settable totalizers are not acceptable by the District
B. EXISTING EFFLUENT FLOW METER INSTALLATION
Upon evaluation of the accuracy of measurement and calibration results of an effluent meter installation
currently in place at Permittee's facility, the District may determine whether the metering system requires
either replacement or modification in accordance with the above minimum requirements.
C. EFFLUENT FLOW METER CALIBRATION
Whether for a new installation of an effluent flow meter or modification to an existing one, Permittee shall
perform a full hydraulic calibration and submit a report to the District in accordance with the District's
Effluent Flow Meter Calibration and Reporting Requirements and Guidelines.

METER CALIBRATION REQUIREMENTS
GENERAL
Permittee shall provide an effluent flow measuring device that is suitable for the application and that measures
and records the entire volume of wastewater discharged to the sewer system within a minimum accuracy of t
5% at all times.
IL FLOW MEASURING DEVICE
- The flow measuring devices must be equipped with a recorder and totalizer that continuously record
the volume, time and date of flow discharged to the District's sewer system. The District will not
accept a flow meter that has a resettable totslaer.
- The flow measuring system must accurately measure the expected range of the flow (minimum,
average, and maximum) with a minimum accuracy of t 5%.
III. CALIBRATION REQUIREMENTS
To ensure proper operation and continued accuracy of the flow -measuring device, Permittee is required to
calibrate and maintain the measuring device. Permittee is required to meet, as a minimum, the following
requirements:
Calibration shalt be conducted under the dimatAupervision of an engineer registered in the
State of California, and in accordance with procedures prepared by the registered engineer.
The engineer conducting the calibration shall certify the calibration report submitted to the
District
A. Hydraulic Calibration
Hydraulic calibration must check and calibrate the entire flow meter system and its components. The
calibration of the full system shall include calibration of all associated instruments and
appurtenances. Hydraulic calibration requires that the system be checked by:
1. Comparing a known flow induced into the system independent of the installed flow -metering
device at the facility.
2. Performing the calibration with instrumentation and method with a minimum accuracy of t2% or
better.
3. Testing and calibrating the flow -metering device at minimum, average, and maximum daily flow
discharged to the sewer system.
4. Using appropriate manufacturer's certified calibration curves or data for the flow meter device used
at the facility.
5. Conducting in -line flow meter calibration using a calibration simulator system provided or approved
by the manufacturer to simulate flow conditions and output to instrumentation.

B. Instrument Calibration
Instrument calibration must set the accuracy of the measuring and recording instrumentation by:
1. Testing at minimum, average, and maximum flows that represent actual daily flow conditions.
2. Conducting the calibration using appropriate procedures approved by a California Registered
Professional Engineer.
C. Calibration Frequency and Reporting Schedule
1. All effluent flow meters must be hydraulically calibrated within 30 days from the day of initial
permit issuance.
2. All calibrations must be performed aver installation, in situ (in line).
3. The calibration report including all appropriate information and data must be submitted to the
District within 30 days following the calibration.
4. All follow-up calibrations shall be performed in accordance with the District's schedule. Hydraulic
calibration must be performed upon permit renewal and the report submitted with the renewal
application.
IV. EFFLUENT FLOW METER MAINTENANCE
The District requires permittees that operate effluent flow meters to have a program of regular maintenance to
ensure proper operation of the meters and a continued minimum accuracy of t5%, which as a minimum,
includes:
- All parts of the flow metering device that require cleaning should be cleaned at least once a month.
- Accurate records of any cleaning or maintenance of the meter must be kept and made available upon
the District's request.
V. CALIBRATION REPORT
Permittee shall provide to the District all the calibration test and maintenance information accompanied by a
certification of test results signed by a Califomia Registered Professional Engineer performing the calibration and
affixed with the engineer's current Registered Engineer stamp. The report shall also be certified by Pernittee's
responsible officer or designated signatory.
Failure to provide the certification and all the information required accurately and completely
will be a violation of permit conditions and may result In enforcement actions, including
penalties for failure to report.

EFFLUENT FLOW METER CALIBRATION REPORT INSTRUCTIONS
Company Information: The company name, sewer address, and mailing address as listed in the permit.
1. Effluent Flow Meter Location:
♦ Describe the location of the effluent meter. Provide a sketch thatshows the location, piping, and
device arrangement.
2. Effluent Meter Description:
♦ Check the appropriate box(es) to identify the type of flow meter.
3. Flow Measuring System Details:
♦ Provide the effluent flow meter specification, including the size and brandof devices and range,
instrument span and range, contact closure frequency, etc. and any additional information pertinent tc
the calibration.
4. Provide the average and the back flows used by the calibration engineer to determine the calibration
flows. The flows must be the current maximum and average flows of the facility. The flow meter
system must be tested at a minimum of three (3) differentknown flow rates, such as the actual,
minimum, average, and maximum flow rates discharged.
S. Calibration Results:
♦ Complete the hydraulic and instrumentation calibration results table.
♦ Submit to the District a copy of all data collected, any calculations peformed, and any other
information pertinent to the calibration.
6. Method of Calibration:
♦ Provide a complete and detailed description of the method of calibration, including a description
of any special pieces of equipment used.
♦ In case of an in -pipe flow meter, provide a description of the calibrator/simulator used. If the
calibration is performed at the manufacturer's facility, Permittee must provide the name of the
facility, address, contact person for the manufacturer, and telephone number.
♦ Manufacturer's certified calibration curves or data, or recent laboratory curves or data, must be
submitted for any manufactured flow metering device used to check the calibration of the flow
monitoring system.
♦ Comparison of the effluent flow monitoring system with incoming water meter readings is
not acceptable as a valid calibration check
7. Corrective Measures:
♦ All effluent flow monitoring systems must indicate, record, and totalize within t5% of the actual
discharge flow rate. If the system does not perform within these limits, appropriate corrective
action must be taken. Prior to any major system modifications, a description and plans, if
necessary, of the proposed modifications shall be submitted to the District for approval. Any
minor adjustments or parts replaced should be described in the report submitted to the District.
