TITLE: Resolution No. 2022-47: Certification of Results of Special Municipal
Election of June 7, 2022
ABSTRACT:
A Special Municipal Election was held and conducted on Tuesday, June 7, 2022. The
Orange County Registrar of Voters Office has certified the returns of the special election
and, pursuant to California Elections Code Sections 9269 and 10263, the governing body
shall adopt a resolution reciting the fact of the election and the other matters enumerated
in California Elections Code Section 10264.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2022-47, A Resolution of the City Council of the City of Newport
Beach, California, Reciting the Facts of the Special Municipal Election Held on
Tuesday, June 7, 2022, and Declaring the Result and Such Other Matters as Provided
by Law.
DISCUSSION:
On October 21, 2021, the City Council adopted Resolution No. 2022-103 calling the City
of Newport Beach's (City's) Special Municipal Election to be held on June 7, 2022, for the
submission of a proposed amendment to the City Charter to the electors, Measure B —
Direct Election of the Mayor by the Voters. Additionally, Resolution No. 2022-104 was
adopted requesting the Orange County Board of Supervisors consolidate the Special
Municipal Election with the June 7, 2022 Statewide Direct Primary Election and provide
election services through the Registrar of Voters Office.
On June 7, 2022, the Special Municipal Election was conducted, and the Orange County
Registrar of Voters canvassed the returns and certified the results of the election.
California Elections Code Section 10262(b) requires the City Council to certify the election
results no later than the next regularly scheduled City Council meeting following the
Orange County Registrar's presentation to the City of the final canvass of the returns.

The Certificate of the Registrar of Voters, which is attached to and referenced as
Exhibit 1 to Resolution No. 2022-47, contains a report of the number of votes cast for
Measure B (10,859 "Yes" votes and 15,385 "No" votes).
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2022-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, RECITING THE
FACTS OF THE SPECIAL MUNICIPAL ELECTION
HELD ON TUESDAY, JUNE 7, 2022, AND DECLARING
THE RESULT AND SUCH OTHER MATTERS AS
PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted in the City of
Newport Beach, California, on Tuesday, June 7, 2022, as authorized by Section 3 of
Article XI of the Constitution of the State of California, Section 1001 of the Newport Beach
City Charter, Section 1415(a)(2) and 9255(b)(1) of the California Elections Code, and
Resolution No. 2021-103 of the City Council of the City of Newport Beach;
WHEREAS, as authorized by Elections Code Section 10400 et seq., the special
election was held and consolidated with the Statewide Direct Primary Election held the
same day;
WHEREAS, notice of the special election was given in time, form and manner as
provided by law; that voting precincts were properly established; that election officers
were appointed and that in all respects the election was held and conducted and the votes
were cast, received and canvassed and the returns made and declared in time, form and
manner as required by the provisions of the Elections Code of the State of California for
the holding of elections in charter cities; and
WHEREAS, the County Election Department canvassed the returns of the special
election and has certified the results to this City Council.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The Certificate of Registrar of Voters to Result of the Canvass of the
Statewide Direct Primary Election Returns is received, attached hereto as Exhibit 1, and
made a part of and incorporated herein by this reference.
Section 2: That the whole number of Vote Center ballots cast was 3,292 and
the whole number of vote -by -mail ballots cast was 24,350, making a total of 27,642 ballots
cast in the City.
Section 3: That the measure voted upon at the special election is as follows:
Measure B (Direct Election of the Mayor by the Voters)
Section 4: That the number of votes given at each precinct and the number of
votes given in the City for and against Measure B are listed in the Certified Statement of
the Votes Cast at the Statewide Direct Primary Election June 7, 2022, attached hereto as
Exhibit 2, and incorporated herein by this reference.

Section 5: The City Council declares and determines that, as a result of the
special election, a majority of the voters voting on Measure B did not vote in favor of
Measure B, and that the measure was not carried and shall not be deemed adopted and
ratified.
Section 6: The City Clerk shall enter on the records of the City Council of the
City, a statement of the results of the special election, showing.. (1) the whole number of
ballots cast in the City; (2) the measure voted upon; and, (3) the number of votes given
at each precinct for or against Measure B.
Section 7: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 8: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.

Section 9: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
