Staff has received construction bids for the 2021-2022 Playground Refurbishment Program and requests City Council approval to award the work to R.E. Schultz Construction, Inc. (R.E. Schultz) of Orange, CA. The project will focus on two West Newport playgrounds (located near the tennis courts and Orange Street) needing maintenance due to the age of the equipment and rubber surfacing. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301—Class 1 (rehabilitation of deteriorated facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project results in no expansion of an existing use; b) Approve the project plans and specifications; c) Award Contract No. 8716-1 to R.E. Schultz for the base bid price of $326,790, and Additive Bid Item No. 1 for $4,000 for a total bid price of $330,790, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $33,079 (approximately 10 percent) to cover the cost of unforeseen work not included in the original contract. DISCUSSION: As part of the FY 2021-2022 Playground Refurbishment Program, staff identified two of the West Newport playgrounds (located near the tennis courts and Orange Street) as needing maintenance due to the age of the equipment and rubber surfacing. 6-1 2021-2022 Playground Refurbishment Program — Award of Contract No. 8716-1 (22P01) July 12, 2022 Page 2 The improvement is necessary in order to maintain desired safety levels and accessibility compliance. The two playgrounds will receive new play equipment with shade structures and new rubber surfacing. The design of the play equipment includes components that are accessible from the ground level and elevated components that will be accessible via a transfer platform. Staff developed contract documents accordingly and put the project out for public bids. At 10 a.m. on May 18, 2022, the City Clerk opened and read the following bids: BIDDER BASE BID TOTAL ADDITIVE BID ITEMS TOTAL BID AMOUNT LOW R.E. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. Additionally, R.E. Schultz holds a City of Newport Beach on -call maintenance/repair services agreement for playground equipment and installation services. Pursuant to the contract documents, the contractor will have 125 consecutive working days (80 days for procurement and 45 days for construction) to complete the project.
