Home My WebLink About2022-49 - Confirming the Sewer Service Fee Report for Fiscal Year 2022-23 and Authorizing Collection of the Fee Through the Orange County Tax RollRESOLUTION NO. 2022-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CONFIRMING THE SEWER FEE REPORT FOR FISCAL YEAR 2022-23 AND AUTHORIZING THE COLLECTION OF THE FEE THROUGH THE ORANGE COUNTY TAX ROLL WHEREAS, Section 200 of the City of Newport Beach ("City") Charter vests the City Council with the authority to make and enforce all laws, rules and regulations with respect to municipal affairs subject only to the restrictions and limitations contained in the Charter and the State Constitution, and the power to exercise, or act pursuant to any and all rights, powers, and privileges, or procedures granted or prescribed by any law of the State of California; WHEREAS, in 1992, the City of Newport Beach ("City") adopted a sewer use fee ("Sewer Fee") as set forth in Chapter 14.24 (Sewer Connection, Permits) of the Newport Beach Municipal Code ("NBMC") to cover the cost incurred in providing sewer services in the City; WHEREAS, the Sewer Fee is adjusted from time to time in accordance with Article XIID, Section 6 of the California Constitution and California Government Code Section 53750 et seq. ("Proposition 218") including, most recently in 2017, via City Council Resolution No. 2017-61; WHEREAS, California Health and Safety Code Section 5470 etseq. authorizes the City to collect sanitation and sewer system solid waste rates on the tax rolls, in the same manner and at the same time as its general taxes by causing a written report to be prepared each year and filed with the clerk, which identifies the parcels and the amount of the charge to each parcel identified for the year ("Sewer Fee Report"); WHEREAS, on July 8, 2022, the City mailed notices to the record owner of each parcel identified in the Sewer Fee Report and caused notice of filing the report in accordance with California Health and Safety Code Section 5473.1; and WHEREAS, a duly noticed public hearing was held by the City Council on July 26, 2022, in the Council Chambers located at 100 Civic Center Drive, Newport Beach, California. A notice of time, place and purpose of the public hearing was given in accordance with California Government Code Sections 6066 and 54950 et seq., and Health and Safety Code Section 5470 et seq. Evidence, both written and oral, was presented to, and considered by, the City Council at this public hearing including giving the responsible person and owner of the property an opportunity to raise objections or protest placement of the Sewer Fee on the tax rolls. Resolution No. 2022-49 Page 2 of 3 NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council has heard and considered all objections and protests to the Sewer Fee Report prepared pursuant to Section 5473 of the Health and Safety Code and finds that protests have not been made by a majority of owners of separate parcels of property described in the Sewer Fee Report. Therefore, the City Council has determined to adopt the Sewer Fee Report and collect said Sewer Fee on the Orange County Tax Roll through procedures established by the Orange County Assessor's Office. Section 2: The City Clerk or her designee is directed to send a copy of Sewer Fee Report and this resolution authorizing collection of the Sewer Fee on the tax roll to the Orange County Assessor's Office on or before August 10, 2022, with a statement endorsed on the Sewer Fee Report under her signature that the report has been finally adopted by the City Council of Newport Beach, and take any other actions necessary to effectuate this resolution. Section 3: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 4: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: The City Council finds adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Resolution No. 2022-49 Page 3 of 3 Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
