Good Afternoon Mr. Jurjis, My name is Andy Fathollahi, and I am the appellant for Agenda Item No. 18 (Appeal of CDP for 20 Bay Island). I originally appealed this application to allow my neighbors and I more time to discuss and consider their plans for their new home at 20 Bay Island. I was optimistic that discussion amongst neighbors would result in a project that benefitted our small island community, and avoided impacts to surrounding homes. Unfortunately, despite my best intentions it has become apparent that my neighbors are not interested in discussing or revising their plans. This is disappointing, but it is there decision. We are a community of neighbors, and in the interest of getting along I have decided to withdraw my appeal. I appreciate your help and the excellent work your staff performed on this application and the subsequent appeal. I consider myself fortunate to be a resident of Newport Beach, and it is nice to know that we have such professional and courtesy employees at the City working on our behalf. The new owners want to tear down the existing home and build a new one. I'm urging you to give this one a second look. City Staff did no historic resources assessment or evaluation of any kind. They concluded that the demolition would not impact any coastal resources. But, historic resources are coastal resources. Staff finds it exempt from CEQA pursuant to Section 15303, Class 3, and further finds that none of the exceptions to the exemption apply, because the "project location... is not identified as a historical resource." But it doesn't need to be "identified": California Code of Regulations 14 Sec. 15300.2 (f) Historical Resources. A categorical exemption shall not be used for a project which may cause a substantial adverse change in the significance of a historical resource. Staff also claims that the project does not have the potential to degrade the visual quality of the Coastal Zone or result in significant adverse impacts to public views, while acknowledging that it's visible to the public. Please see the history of the home below. It was designed by architect Gilbert Stanley Underwood in 1930 for the Chandler Family (LA Times). It is located on Bay Island in Newport Beach with commanding views of the turning basin. Underwood is known for his "Parkitecture" having designed the majestic Ahwanhee Hotel in Yosemite, the Jackson Lake Lodge in Jackson Hole, The Sun Valley Lodge and many other National Park lodges and government buildings. Many of his buildings are on the National Register. Little has changed on Bay island since the land was purchased by Rufus Sanborn in 1903 for $350. The 23 lots have been owned by a cast of characters from Moses Sherman, Sam Tustin (founder of Tustin, CA), Madame Helena Mojeska and Warren Buffett's other half, Charlie Munger. It would be a huge loss for Newport Beach and the Bay if this home is torn down. Dear Planning Commission Members, On July 7th you approved a coastal development permit (CDP) allowing the demolition of an existing single-family residence located at 20 Bay Island. I think it's possible that you made that decision without the correct information. 20 Bay Island was designed by master architect Gilbert Stanley Underwood in 1930 for the Chandler Family (LA Times). It is located on Bay Island in Newport Beach with commanding views of the turning basin. Underwood has (20) structures listed on the National Historic Register. Known for his "Parkitecture ", he completed many noteworthy projects for the National Park Service including the majestic Ahwanhee Hotel in Yosemite, Old Faithful Lodge in Yellowstone, the Jackson Lake Lodge in Frand Teton National Park, The Sun Valley Lodge as well as 17 Union Pacific train stations, 20 post offices (including the amazing Terminal Annex in Los Angeles), 2 major Federal buildings and the U.S. State Department Building. At one point, Newport Beach had a Historic Resources Inventory (see attached). Bay Island is on it. I'm asking that you consider that Staff made a mistake in not completing a historic evaluation/assessment of this property. The is a home by a master architect and it would be a huge loss for Newport Beach and the Bay if torn down. Next Tuesday (8/23/22), The City Council is hearing an appeal of your decision. Please write to City Council and ask that they instruct staff to do a historic evaluation/assessment of this property so that decisions can be made with ALL the facts. Hello council - I am writing to say that I think the home on Bay Island that is being proposed to be torn down by Brandon Architects should be saved. The city of Newport Beach needs to shift from allowing any historic home to be torn down to a city that honors the architectural past and nature of the city. At some point this town will look like a city of white boxes with its history and character stripped for the sake of making a buck. I have bought several homes in Newport Beach over the past 20 years and have modified them and improved them without tearing them down - there is a thoughtful approach to development that seems to be lost in this city and it is time to fight for it in the hope of saving some of the older historical structures. I am working on saving a home in Carmel, CA - a city with as wealthy homeowners as Newport Beach - but a city that values history and the landscape of their town. It is disheartening to see that we cannot even save a beautiful example of Underwood's work on Bay Island. Please please reconsider allowing this home to be torn down. The owners can surely remodel and make a wonderful new home for themselves. Tearing down this home would be a travesty. Good afternoon, Council. I've been made aware of a request to possibly teardown a home on Bay Island designed by the historically significant architect, Gilbert Stanley Underwood. Underwood is responsible for many of the most iconic American structures in our nation. Among them The Ahwahnee Lodge, The Jackson Lake Lodge, The Sun Valley Lodge to name a few. He also designed The San Francisco Mint, the U.S. Courthouse in LA, the U.S. Post office in downtown LA, etc. I happen to own the only home he ever designed for himself, located in the Hollywood Hills. Historically significant, we are carefully restoring the home. To allow someone to tear down such a home would be a shame for all of us, destroying what's left of our architectural heritage and history in California. Appeal of Gannon Residence, 20 Bay Island Dear Mayor Muldoon and Council Members Avery, Blom, Brenner, Dixon, Duffield, and O'Neil: On Tuesday, August 23, 2022, City Council is hearing an appeal of the Planning Commission approval (Resolution PC2022-017) of a Coastal Development Permit (CDP) for 20 Bay Island. We are writing to bring your attention to the City staff's analysis of the project which paved the way for the CDP approval by the Planning Commission and which now threatens an historic resource. The July 7, 2022 Staff Report (Gannon Residence PA2021-305) states that City staff found the project exempt from the California Environmental Quality Act pursuant to Section 15303 under Class 3 (California Code of Regulations, Title 14, Division 6, Chapter 3) and found that none of the exceptions to the exemption apply because "the project location does not impact an environmental resource... and is not identified as a historical resource." Further, staff concluded that "facts to support the findings in the draft resolution are sufficient to demonstrate that the project would not impact any coastal resources..." Yet there is considerable evidence that the existing residence at 20 Bay Island is an historic resource and a coastal resource. Why is it an historic resource? The 20 Bay Island residence was built in 1930 for May Chandler Goodan and Roger Goodan and it was designed by master architect, Gilbert Stanley Underwood (1890-1961). Among Underwood's major buildings are Silverwoods, one of the original office towers on Los Angeles' Miracle Mile, the U.S. Courthouse in downtown Los Angeles, the Ahwahnee Lodge at Yosemite National Park and several other National Park lodges. By the time Underwood received the Newport Beach commission he had designed 17 Union Pacific train stations. Beginning in the mid-1930s, Underwood was contracted by the federal government to design 20 post offices including Terminal Annex in Los Angeles. His distinguished 40-year career culminated in his role as Chief Architect of the General Services Administration, the federal agency that manages federal -owned properties. Today, at least 20 buildings designed by Underwood are on the National Register of Historic Places. Preserve Orange County 615 N. He designed his own home on Lake Hollywood Drive in Los Angeles in a Period Revival style but the influences of Modernism are evident in the smooth plaster surfaces and lack of ornamentation. Underwood took a similar pared -down approach with the Bay Island residence. Its wood frame construction, red brick foundation and chimney, and wood shiplap siding were combined in a simplified adaptation of the Colonial Revival style of a "Cape Cod" vernacular popular in coastal communities on both coasts in the 1930s and 1940s. A review of the City's permit record and evidence provided by previous owners indicate that the house has not undergone any significant exterior modifications since its original construction date over 90 years ago. Based on an assessment from the public -right-of-way, maintenance of the property has been deferred for several years but it retains its integrity of location, setting, materials, design, workmanship, feeling and association and therefore continues to convey its historic significance. Bay Island itself was identified in the 1992 Historic Resources Inventory by the City's Ad Hoc Historic Preservation Advisory Committee as a Class 3 "local historic site" that is "a building, structure, object, site or natural feature of local significance only. The property is representative of historic/architectural themes of local importance." The inventory was never approved by City Council but the list is a guide to the historic resources in the city that would only have become more historic not less as time has passed. Did City Staff pause to ask if a residence that dates to the period when the Bay Island community was established could itself be historic? CEQA and the Coastal Act It is our considered view that the residence's age, intact Colonial Revival style and association with master architect Gilbert Stanley Underwood would qualify if for the California Register of Historical Resources under Criterion 3 for embodying the "distinctive characteristics of a type, period, region or method of construction or represents the work of a master or possesses high artistic values." (https://ohp.parks.ca.gov/?page id=21238). If the residence is eligible for the state's register then as far as CEQA is concerned 20 Bay Island would be an historic resource. Contrary to the City staff's finding, a resource does not have to be "identified" on an inventory, survey, or register to be historic. A resource has to be "eligible" for the California Register and pursuant to California Code of Regulations 14 Sec. 15300.2 (f) Historical Resources, a categorical exemption shall not be used for a project which may cause a substantial adverse change in the significance of an historic resource. Based on the evidence, City staff should have required a historical evaluation of the residence before determining the project exempt. Moreover, if the house is an historic resource, then it is also a coastal resource and therefore the impact of the project on what the California Coastal Act (Public Resources Code, § 30000 et seq.) refers to as "community character' and the integrity of architectural resources should have been considered. The Newport Beach Register of Historic Property is inactive. The City's policy "K-2" sets out the procedure for nominating a property to the local register yet City planning staff are not well- informed about the process. Only ten properties are listed on the local register — mostly added in the 1980s and 1990s- and it was last updated in 2014, when the Goldenrod Avenue Footbridge was added. The City does not subscribe to the state's Mills Act program thus denying its residents the opportunity for property tax relief. Mills Act gives owners of historic buildings and houses an incentive to maintain them in exchange for a property tax rebate. This would encourage historic preservation throughout the City and high property values are not an excuse not to pursue the program. Santa Monica, Palo Alto and Pasadena administer successful Mills Act programs. The City's inventory is alarmingly incomplete. The residence at 20 Bay Island would have met the 50-year threshold at the time the survey was conducted, yet it is not listed on the 1992 inventory. With an architect as significant as Underwood, a proper survey would have included him and have documented the integrity of the residence. What other buildings were missed at that time and what buildings that have achieved 50 years since 1992 are being overlooked because the City does not do a routine update? Residents should be concerned that any historic building constructed after 1945 is being ignored by their City yet this was an important era for the development of Newport Beach. For example, several important architects were engaged here in the postwar period such as William Pereira, William Cody, and J. Herbert Brownell. Districts such as Irvine Terrace, Cameo Shores and Newport Center were designed with the principles of Modernist planning and architecture. The Stuft Shirt on East Coast Highway (now A'maree's) was designed in 1961 by the architecture firm of Ladd & Kelsey which was based in Newport Beach at the time and went on to design the award -winning Pasadena Art Museum (now Norton Simon Museum). Yet when the Newport Village Mixed -Use project was being considered in its early stages, the project plans did not include the Stuft Shirt and the City was unaware at that time that the Stuft Shirt was historic. Today, thanks to the efforts of residents of Newport Beach and others, the building's integrity as an historic resource cannot be ignored. I spend a good deal of time in Newport Beach and am concerned about preservation of its remaining historic resources and today, specifically, about the property at 20 Bay Island. As you have been apprised, the residence at 20 Bay Island was designed by nationally renowned architect Gilbert Stanley Underwood and retains integrity. It is possible that staff did not know of its architectural pedigree when it found the project exempt from CEQA and concluded also that the project would not impact coastal resources. The project is not, however, exempt from CEQA. Staff err when they claim that the project "has no potential to have a significant effect on the environment" and states as a reason that the "project site ... is not identified as a historic resource" (Staff Report, August 23, 2022, p. 4 - 5). Substantial evidence in the record provided by Krista Nicholds, who is the executive director of Preserve Orange County and meets the Secretary of the Interior's Professional Qualification Standards in architectural history, indicates that the property is eligible for the California Register of Historical Resources under Criterion C, and thus it needs to be treated as a historic resource for purposes of CEQA. Historic resources enjoy environmental protections under CEQA. "Generally a resource shall be considered 'historically significant' if the resource meets the criteria for listing on the California Register of Historical Resources" (14 California Code of Regulations § 15064.5(a) (3)). A property need meet only one of the four criteria to be eligible for listing on the California Register (Public Resources Code §5024.1). Under CEQA: (b) A project with an effect that may cause a substantial adverse change in the significance of an historical resource is a project that may have a significant effect on the environment. (1) Substantial adverse change in the significance of an historical resource means physical demolition, destruction, relocation, or alteration of the resource or its immediate surroundings such that the significance of an historical resource would be materially impaired. (2) The significance of an historical resource is materially impaired when a project: (A) Demolishes or materially alters in an adverse manner those physical characteristics of an historical resource that convey its historical significance and that justify its inclusion in, or eligibility for, inclusion in the California Register of Historical Resources" (14 CCR § 15064.5). Obviously the demolition of Goodan House qualifies as substantial adverse change in its significance that would disqualify it for the California Register. A categorical exemption cannot be used for such a project (14 CCR § 15300 (2)(f)). Moreover, the evidence of the property's historical significance precludes a finding that the project would not impact any coastal resources, which include cultural, scenic, and manmade resources as well as natural resources. It is unfortunate that Newport Beach lacks incentives that encourage property owners to treasure remarkable buildings like Goodan House and does not identify historic properties in a comprehensive way. But the lack of preservation policies doesn't change the obligations under CEQA. I ask that you require preparation of an Environmental Impact Report to disclose project impacts and study alternatives to demolition. More broadly, it would be wonderful to see the city develop programs to encourage owners to maintain and celebrate historic properties. Thank you for your consideration. The Appeal did not claim that the existing home was a historical resource. Late allegations about the home and its alleged historical importance began last week. These claims have no merit.
