LEGAL DESCRIPTION Lot 9, Block 11, Tract Balboa Island
On August 30, 2022, Zoning Clearance - PA2022-072 was approved authorizing the
development of a new attached 360-square-foot junior accessory dwelling unit (JADU). The
JADU will be constructed in conjunction with a new 2,082-square-foot single-family
residence.
This approval is based on the following standards.
1.The project is for a Junior Accessory Dwelling Unit
2.The project is located in the R-BI zoning district and is a permitted use.
3.There is a proposed single-unit dwelling on the lot.
4.The project is classified as the construction of a new attached JADU to a single-unit
dwelling.
5.The project complies with all conditions and applicable development standards of
Section 20.48.200 (Accessory Dwelling Units).
6.The project is located in the coastal zone, but eligible for a categorical exclusion order
(CEO). CEO No. CEO2022015 was effective on March 22, 2022.
7.A deed restriction will be recorded prior to the issuance of a building permit related
to occupancy restrictions, prohibition on the separate conveyance, and restrictions
on short-term rentals.
