TITLE: Balboa Pier and Channel Place Park Restrooms Rehabilitation
Project (Project No. 20F02) — Notice of Completion for Contract
No. 8700-1
ABSTRACT:
On September 14, 2021, the City Council awarded Contract No. 8700-1 for the Balboa
Pier and Channel Place Park Restrooms Rehabilitation project to AIIInOne Construction,
Inc. The work is now complete and staff requests City Council acceptance and close out
of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

The project at Channel Place Park included removing and disposing of existing
improvements, installing new sinks, urinals, and partitions; epoxy coating the floor;
painting the interior; patching the roof beams; and installing new copper roofing, awning,
and flashing materials. The work completed at Balboa Pier restrooms consisted of
replacing missing roof tiles, installing new sheet metal flashing at eaves, and replacing all
wire mesh ventilation screens.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:
Original Bid Amount: $ 135,910.00
Actual Cost of Bid Items Constructed: $ 135,910.00
Total Change Orders: $ 20,338.90
Final Total Contract Amount: $ 156,248.90
The final total contract amount was $156,248.90, which was approximately 14.96 percent
higher than the original bid amount. This cost increase was primarily due to extensive
additional wood rot that had to be repaired in portions of the roof structure. An additional
change order was executed to replace the exterior lights with new lights to reduce glare
at the request of the adjacent property owners.

Product shortages caused substantial delays to the construction completion. The items
of work that were impacted, however, did not prevent the utilization of the restrooms and
the actual closure time of the restrooms to the public was not impacted. The contractor
demonstrated sufficient efforts to try and overcome the material delivery issues. Due to
the restrooms being operable and the delays being out of the contractor's control, no
liquidated damages were assessed due to the schedule delays. Additional completion
days were granted to cover the supplier caused delays in procurement.

ENVIRONMENTAL REVIEW:
On September 14, 2021, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301, Class 1(a) and (d)
(alterations involving partitions, plumbing and conveyances; restoration of deteriorated or
damaged facilities) of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, because it has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
