TITLE: Ocean Piers Maintenance Project (Project No. 22H03) — Notice of
Completion for Contract No. 7884-2
ABSTRACT:
On November 16, 2021, the City Council awarded Contract No. 7884-2 for the Ocean
Piers Maintenance Project to Associated Pacific Constructors, Inc. The work is now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

This project included underwater and above water/under deck repairs at Newport and
Balboa Piers based on previously conducted pier inspections. The work included additive
bid items for repairing three additional bents at each of the piers.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:
Original Bid Amount: $ 578,770.00
Actual Cost of Bid Items Constructed: $ 578,770.00
Total Change Orders: $ 144,032.78
Final Total Contract Amount: $ 722,802.78
The final total contract amount was $722,802.78, which was approximately 24.9 percent
higher than the original bid amount. This cost increase was primarily due to identifying
additional areas on the pier structures that required repair. These items included
additional bolt and connection plate replacements, replacement of an additional pile that
was found to have been broken off since the initial inspection, and additional deck
concrete to fill in the void left by the removal of the prior restaurant at the end of Newport
Pier. The award established a contingency amount of $57,877 to cover the cost of
unforeseen work and the City Manager authorized an additional encumbrance of
$86,815.00 pursuant to Council Policy F-14. The additional funds raised the available
contingency amount to 125 percent of the original award.

ENVIRONMENTAL REVIEW:
On November 16, 2021, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 (minor alterations of
existing public facilities with negligible expansion) of the CEQA Guidelines, California
Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant
effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
