SUBJECT: ACQUISITION OF 203 34TH STREET (Southeasterly 65 feet of Lot 23,
Block 134, Lake Tract, Newport Beach)
RECOMMENDATION:
If desired, authorize staff to retain an appraiser to determine
the fair market value of 203 34th Street.
DISCUSSION:
Attached is a letter from Mrs.*Violet (Summers) East requesting that
the City purchase her property at the northwesterly corner of 34th Street and
Balboa Boulevard. Mrs. East has been trying to sell her property for some
time but has not been successful. She feels this is due to the possibility of
future widening of Balboa Boulevard..
In October, when Mrs. fast first made her request, the staff pointed
out that the City had no money budgeted for right-of-way acquisition and would
not be able to make any purchases in the 1980-81 fiscal year. Mrs. East con-
tacted the Public Works Department again in January and requested that her
property be acquired as soon as possible. If an appraisal is made at this
time, it would provide the information necessary to determine if sufficient
funds can be made available in 1981-82 fiscal year for the purchase.
This parcel would need to be acquired if Balboa Boulevard is widened
between 32nd Street and 44th Street.
The attached sketch shows parcels along Balboa Boulevard which have
been acquired by the City, and the parcel proposed for acquisition. Eleven
parcels have been acquired and nine parcels remain to be acquired.
If an appraisal of the property is authorized, the appraisal fee of
$2,000 to $2,500 would be funded from the budgeted Gas Tax Project for prepar-
ing EIR's and preliminary plans for future street widening projects.
The structure at 203 34th Street is currently occupied by the owner.
If the City decides to purchase the property, the owner may be eligible for
relocation assistance.

Dear Mr. Webb:
On behalf of our client, Violet Summers East, we request
that the City of Newport Beach formally accept our client's
agreement to sell the above property to the City of Newport Beach
for the cash sum of $16.5,000.00.
It is our understanding that this matter will be set on the
calendar for acceptance by the City Council on December 14,,1981.
As we have discussed in our telephone conversation, time is
of the essence due to pending Bankruptcy proceedings.

Dear Sir:
Several months ago you had an appraisal, made on property at
203 34th Street, owned by Violet Summers East. Philip S.
Jackson came up with a figure of $165,000.
As you know we hold the 3rd trust deed on this property, and
we filed a foreclosure .along with the 1st and 2nd trust deed
holders. We were stopped-from.going to foreclosure.sale by
Mrs. East filing a bankruptcy. We went'to court and got a
release of the stag and now the title company has scheduled
an auction sale for December 18, 1981.
Is it possible that the city can bid on * the sale, .or' will they
buy the property from me for that price if I get title to it?
It is very important that we dispose of the property immediately
if we happen to get title as we cannot afford to bring the two
prior trust deeds current or pay them off*
A quick reply with a statemBnt of what you can do, so that we
can plan a course of action will be greatly appreciated.

RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE ACQUISITION
OF PROPERTY AT 203 34TH STREET AND
ACCEPTANCE OF A GRANT DEED FROM THE OWNER
THEREOF
WHEREAS, there will be delivered to the City of Newport
Beach a certain Grant Deed wherein the owner or owners grant(s)
to the City of Newport Beach the following described real
property in connection with the acquisition by the City of
Newport Beach that certain real property located at 203 34th
Street, Newport Beach, California, to wit:
The southeasterly 65 feet of Lot 23 in Block
134 of Lake Tract in the City of Newport
Beach, County of Orange, State of California
as shown on a map recorded in Book 4, Page 13
of Miscellaneous Maps, records of Orange
County, California.
WHEREAS, it is to the best interests of the City of
Newport Beach to accept said Grant Deed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said Grant Deed be and hereby is
accepted; and
BE IT FURTHER RESOLVED that the City Clerk be and
hereby is authorized and directed to execute said Grant Deed and
attach thereto a Certificate of Acceptance and to consent and
cause said document to be recorded in the Orange County
Recorder's Office.
ADOPTED this day of DEC 14 ,' 1981.
