SUBJECT: CORPORATION YARD, ACQUISITION OF PROPERTY AT THE SOUTHEAST CORNER
'OF`'"SUPERIOR AVENUE AND INDUSTRIAL WAY
RECOMMENDATION:
Authorize the City Manager to negotiate the purchase of the property
at the southeast corner of Superior Avenue and Industrial Way.
DISCUSSION:
The subject property is part of the estate of the late Mr. Louis R.
Benny and is the only remaining undeveloped property adjacent to the City
Corporation Yard.
The General Services Director feels that the property would be a
valuable addition to the Corporation Yard site; with the principle uses to
be to provide direct vehicular access to Industrial Way, and increased park-
ing area.
We have been advi.sed by Mr. David M. Garland, Co -executor for the
estate of Mr. Benny, that the co -executors for the estate have accepted an
offer from another party for the property, subject to Ordnge County Superior
Court confirmation. The hearing for confirmation of the sale, which is
subject to overbids in open court, has been continued to October 12, 1976
at the request of the City to allow time for the Council to consider the
authorization to the staff for purchase negotiations.
Information regarding the property is summarized below:
1. Appraisal. Mr. Philip Jackson, MAI, has prepared an appraisal of
the 150' x 150' parcel; and concludes that the fair market value
is $65,000.00.
2. Acquisition. Co -executors for the estate of Mr. Benny have
accepted an offer of $65,000.00 from another purchaser.
3. Encumbrances. The southerly side of the parcel is encumbered
by a 30 foot wide easement for its full length. Facilities
within the easement include power lines, sanitary sewer, 30 inch
diameter City of Newport Beach water line, etc. It is almost
certain also, that there is a substantial -amount of trash fill
buried beneath the surface fill, similar to. that which exists on
much of the Corporation Yard site.
4. Dedication and public improvements. A 20 foot wide strip of right
of way will have to be dedicated along the Superior Avenue frontage.
Standard street improvements to be constructed along the Superior
and Industrial Way frontages are estimated to cost $10,000.

5. Jurisdiction. The entire parcel is within the City of Costa Mesa.
Coordination with Costa Mesa will be needed regarding site devel-
opment, access, channelization on Industrial Way and Superior
Avenue, etc.
6. Uses. The property could be used for vehicular access to. Industrial
Way; parking; storage; and possibly light frame buildings which do
not impose a substantial foundation load, and for which foundation
settlement would not be a significant problem. The estimated cost
of improving the entire site for parking and vehicular access is
on the order of $15 - $18,000.

Dear John:
.After our discussions concerning your possible purchase of the above
property, I talked to your appraiser, Phillip Jackson. I told
Ex. Jackson that it was very itiportant to the Estate that we. receive
an offer immediately from the City because of the cash needs of the
Estate.
Since the Estate has not received any offer from the City for the
property, the co -executors of the Estate sold the property subject
to court conformation to Jim Poteet who has property nearby.
Of course, the sale is subject to overbids in open court. The hearing
for conformation of the sale to Mr. Poteet will be heard on September 21,
1976, at 9 :00 a.m. , in Department 3 of the Orange County Super.".or Court,
located at 700 Civic Center Drive NJest, Santa. Ana, California.
In the event: that the City decides to make a bid iti open court, I suggest -
that you have a representative present at the above time and place.
