REQUEST
938 Sandcastle Drive
BACKC,ROUND: INITIAI, REQUEST
• April 1, 2022 - Property owner, Mario Marovic requested the
removal of the Magnolia grandiflora at 938 Sandcastle Drive
• The purpose of the request was due to damage to public
infrastructure and private property damage.
• Also, future plans to rehabilitate the landscaping on the property.
INITIAL INSPECTI: FIPZDINC%,S
• Tree appears healthy and vigorous.
• Work history shows curb patching
conducted in 2015 and 2017. No work
history of panel replacement but
appears this was conducted.
• Minor current damage to public
infrastructure. Sidewalk is even and a
light grind appears on the edge of one
panel.
STAFF DENIAL
• The condition of the tree did not meet the requirements for removal
listed under Council Policy G-1 (Sec. III, Item C*)
• The City tree is dead, diseased, dying, or
hazardous, and presents a liability to the City.
• A dead tree is one that has been assessed by the
CityArborist and found to have deceased.
• Diseased trees are defined as those trees that
cannot be cured by current arboricultural
methods, are in an advanced state of decline, and
have no prospect of recovery.
• Dying trees are those that have no prospect of
recovery. Hazardous trees are defined as those that
are defective, have a potential to fail, and would
cause damage to person and property upon
failure.
REFORESTATION PROCESS
• Applicant was advised of Reforestation as a potential
option.
G-1, Section V, Item A "Description of Reforestation":
Reforestation is defined as the concept of systematically
replacing Problem or Standard Trees which are creating
hardscape and/ or view problems and cannot be properly
trimmed, pruned or modified to alleviate the problem(s) they
create, or those which have reached their full life and are
declining in health; or are simply the wrong species of trees for
the planted location.
• Applicant attained the Harbor View Hills South
approval, and the item was placed on August 2, 2022,
the Parks, Beaches, and Recreation (PB&R)
Commission Agenda.
• Applicant offered to pay for the removal of the tree and
the planting of a 36-inch box Western Redbud tree. �*
BARKS BEACHES & RECREATION COMMISSION:
AUGUST 2, 2022
• There was no public comment
regarding the item.
• Of the four Commissioners present,
PB&R Commissioners voted 3 in favor
and 1 abstained to deny the
Reforestation request.
• Commission denied the request,
citing:
• The good condition of the tree
• The minor nature of the current
damages and,
• Future repairs could be
conducted while preserving the
Magnolia tree.
BASIS FOR APPEAL TO COUNCII,
• Following the PB&R Commission
Meeting, The Parks and Trees
Superintendent met with the applicant
and Council Member Brenner to explain
the Commission proceedings and
discuss their alternatives.
• Council Member Brenner is requesting
this PB&R Commission's decision be
brought before the full Council for
further review.
• Recommended Options:
• Uphold PB&R Commission
decision to preserve the tree.
• Agree w/ Apelet and allow the
tree to be removed and replaced
