RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Adopt Resolution No. 2022-74, A Resolution of the City Council of the City of Newport Beach, California, Establishing the Citizens' Residential Crime and Burglary Advisory Committee; and c) Direct the City Clerk to advertise for the citizen members of the Committee. DISCUSSION: At the request of Mayor Kevin Muldoon at the September 27, 2022 City Council meeting, the City Council considered placing a resolution on a future agenda that, if adopted, would create a three -member ad hoc Citizens' Residential Crime and Burglary Advisory Committee (Committee) to provide input and make recommendations to the City Council to help prevent or deter residential crime and burglary in Newport Beach. The Council voted unanimously, 7-0, in favor of staff bringing forward a resolution for its consideration. Over the past few years, Newport Beach has experienced a number of high -profile residential crimes and burglaries, some involving South American Theft Groups (SATGs) as well as other domestic Organized Theft Groups (OTGs). 4-1 Resolution No. 2022-74: Establishing an Ad Hoc Citizens' Advisory Committee to Provide Input and Make Recommendations that will Address Residential Crime and Burglary October 25, 2022 Page 2 The Newport Beach Police Department has taken a number of proactive steps to address the issue. These include partnering with neighboring police departments as well as regional law enforcement taskforces assigned to SATGs and OTGs to develop real-time intelligence; allocating additional police personnel to affected neighborhoods through directed enforcement of both uniformed patrol officers and undercover detectives based on actionable crime analysis; working in coordination with the Orange County District Attorney's Office Residential/Commercial Burglary Vertical Deputy District Attorney to tailor prosecution of suspects affiliated with SATGs and OTGs; and educating community members through public speaking events and press releases via the police department's Crime Prevention Specialist and Press Information Officer, respectively, on how to identify criminal behavior and SATG/OTG activity, as well as prevent their homes from being targeted by burglars. While there has been significant success with the Police Department's efforts (including close to 200 arrests for residential crime and burglary in the past two years), a more comprehensive approach is proposed. There is a wealth of knowledge and expertise in the community and working with residents to help address this issue will provide the City Council with a greater perspective and action plan to respond to this crime trend. The Committee would be comprised of three community members with a background in public safety or criminal justice. The Mayor shall form an ad hoc Appointments Committee, which shall be comprised of the Mayor and two (2) Council Members to review the community member applications. Selection of the three community members will follow Council Policy A-2: Boards, Commissions and Committees. The Committee's goal is to develop a plan to prevent or deter residential crime and burglary in Newport Beach that shall follow the process set forth herein: a) Provide recommendations to the City Council regarding educating the public on steps that can be taken to prevent or deter residential crime and burglary. b) Provide recommendations to the City Council regarding the addition, modification, or elimination of programs, policies, or procedures to prevent or deter residential crime and burglary. c) Provide recommendations to the City Council regarding the availability of non- profit and community -based programs, policies, or procedures to prevent or deter residential crime and burglary. d) Provide recommendations to the City Council regarding the availability and allocation of funding for programs, policies, or procedures to prevent or deter residential crime and burglary. e) Such other matters as directed by the City Council. The Committee will sunset when this work is completed or June 30, 2023. The Committee could also terminate sooner or be extended by action of the City Council. FISCAL IMPACT: There is no fiscal impact related to the establishment of the Citizens' Residential Crime and Burglary Advisory Committee. 4-2 Resolution No. 2022-74: Establishing an Ad Hoc Citizens' Advisory Committee to Provide Input and Make Recommendations that will Address Residential Crime and Burglary October 25, 2022 Page 3 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. ► Is] IIs] I►Les The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2022-74 4-3 ATTACHMENT A RESOLUTION NO. 2022- 74 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING THE CITIZENS' RESIDENTIAL CRIME AND BURGLARY ADVISORY COMMITTEE WHEREAS, the City Council establishes various committees from time to time for the purpose of advising the City Council on matters of importance; WHEREAS, the City Council recognizes the importance of residential safety and security, and the value of educating the public on preventative measures that may be taken to protect residences from crime and burglaries; WHEREAS, the City Council desires to respond to rising concerns of residential crime and burglaries within the community by considering the addition or modification of programs, policies, or procedures to prevent and deter residential crime and burglaries, WHEREAS, the City Council recognizes that its residents have a wide diversity of backgrounds, including but not limited to, experience and expertise in public safety and criminal justice, which is a valuable resource that can be utilized to provide advice and recommendations to prevent and protect against residential crime and burglaries; and WHEREAS, the City Council desires to establish an ad hoc citizens' advisory committee comprised of residents with backgrounds in public safety and criminal justice to provide input on community education, preventative measures, deterrence and the adoption or modification of programs, policies, or procedures to address residential crime and burglaries. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council hereby creates the Citizens' Residential Crime and Burglary Advisory Committee ("Committee") to provide input and make recommendations to the entire City Council on community education, preventative measures, deterrence, and the adoption or modification of programs, policies, or procedures to address residential crime and burglaries. Resolution No. 2022- Page 2 of 3 Section 2: The Committee shall be an ad hoc advisory committee and shall be subject to the Brown Act. The term, qualification of appointees, selection of appointees, appointment process, membership, and responsibilities shall be done in conformance with this resolution and Exhibit "A", which is incorporated herein by reference. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. 4-5 Resolution No. 2022- Page 3 of 3 Section 6: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. Harp City Attorney Attachment: Exhibit A - Description of the Citizens' Residential Crime and Burglary Advisory Committee Wo EXHIBIT A CITIZENS' RESIDENTIAL CRIME AND BURGLARY ADVISORY COMMITTEE AUTHORIZATION: Established by Resolution No. 2022- adopted on October 25, 2022. MEMBERSHIP: Three (3) residents appointed by the Mayor and confirmed by the City Council. MEMBERSHIP TERM: The Committee shall expire on June 30, 2023, unless terminated sooner by action of the City Council. MEETINGS: The Committee shall meet regularly, with the schedule determined by the Committee. QUALIFICATIONS OF Appointed Committee Members shall: APPOINTED MEMBERS: A. Be a resident of the City of Newport Beach ("City"); B. Be a registered voter in the City; C. Have a background in public safety or criminal justice, D. Be appointed by the Mayor; and E. Be Confirmed by the City Council. COMMITTEE The Committee shall have a Chairperson and a Vice ORGANIZATION: Chairperson appointed by the Mayor. SELECTION OF Selection of Committee Members shall be done as APPOINTED MEMBERS: follows: A. The City Clerk shall prepare a notice letting members of the public know of the opportunity to serve on the Committee and the application process. The notice shall include, but not be limited to, details regarding what information is necessary to be considered for appointment, where to apply, and the application deadline. 4-7 B. The application notice shall be published at least once in a newspaper of general circulation in the City and posted in the City's normal posting location for agendas, as well as the Newport Beach Public Library located at 1000 Avocado Avenue. C. The deadline to submit applications for the Committee shall be one (1) week after the application notice is published in a newspaper of general circulation in the City. D. The Mayor shall review the applications, the applicants' answers to any questions, and conduct any necessary interviews. E. After the applications have been reviewed and any necessary interviews conducted, the Mayor shall inform the City Clerk of the names of the members to be appointed to the Committee and the City Clerk will submit the names of the appointees to the City Council, at an open and noticed meeting, to be considered for confirmation by the City Council. F. Except as otherwise required by law, the process for selecting, appointing, and confirming members to the Committee shall follow the process set forth herein. PURPOSE & A. Provide recommendations to the City Council RESPONSIBILITIES regarding educating the public on steps that can be taken to prevent and deter residential crime and burglary; B. Provide recommendations to the City Council regarding the addition, modification, or elimination of programs, policies, or procedures to prevent and deter residential crime and burglary; C. Provide recommendations to the City Council regarding the availability of non-profit and community - based programs, policies, or procedures to prevent and deter residential crime and burglary; D. Provide recommendations to the City Council regarding the availability and allocation of funding for programs, policies, or procedures to prevent and deter residential crime and burglary; and E. Such other matters as directed by the City Council.
