TITLE: Central Library Boiler and Civic Center Hot Water Heater
Replacement Project (Project No. 221`02) — Notice of Completion for
Contract No. 8730-1
ABSTRACT:
On March 22, 2022, the City Council awarded Contract No. 8730-1, Central Library Boiler
and Civic Center Hot Water Heater Replacement Project, to F.M. Thomas Air
Conditioning, Inc. (F.M. Thomas) of Brea, California. This project replaced the existing
boiler and hot water heater at the Central Library and Civic Center, respectively. The work
is now substantially complete and staff requests City Council acceptance and closeout of
the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice
of Completion has been recorded in accordance with applicable portions of the Civil
Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.

The work necessary for the completion of this contract consisted of removing and
replacing the existing Central Library (1000 Avocado Avenue) boiler and the existing Civic
Center (100 Civic Center Drive) hot water heater, which were both at the end of their
service lives and were showing signs of failure. The scope also included installing seismic
anchorage and reusing existing electrical circuits. The replacement equipment meets the
current 2019 California Title 24 Energy code requirements. The project also included one
change order to add an in -line filter in order to reduce the amount of sediment deposits in
the new boiler.
The contract has been completed to the satisfaction of the Public Works Department and
the Library Services Department. A summary of the construction cost is as follows:

The Central Library Boiler and Civic Center Hot Water Heater Replacement Project was
included within the FY 2021-22 CIP Budget. Funds for the construction contract were
expended from the following account:

The Facilities Maintenance Master Plan (FMMP) includes a comprehensive condition
assessment of all City of Newport Beach (City) facilities and prioritizes capital repairs
and/or major maintenance based on a variety of factors including current condition and
age of facilities. This program funds a variety of capital repair and maintenance projects
in an effort to keep City facilities is good condition.
ENVIRONMENTAL REVIEW:
On March 22, 2022, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 Class 1 (maintenance of
existing public mechanical equipment) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because this project has no potential to have a significant
effect on the environment.
