I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Makana Nova, Senior Planner Jenny Tran, Assistant Planner II. REQUEST FOR CONTINUANCES The Zoning Administrator reported that Item Number 4 is removed from the Calendar and will be re-noticed for a future hearing date. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF SEPTEMBER 29, 2022 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 716 Orchid Development, LLC Tentative Parcel Map (PA2022-0164) Site Location: 716 and 716 ½ Orchid Avenue Council District 6 Jenny Tran, Assistant Planner, provided a brief project description stating that the applicant is requesting approval of a tentative parcel map for residential condominium purposes and that the existing duplex has been demolished and a new duplex is under construction. Ms. Tran added that the property complies with all applicable development standards and that the project is exempt from CEQA under Class 15 for Minor Land Divisions. She further adds that the project is not within the coastal zone. Ms. Tran discussed several conditions for public improvements that are outlined in the Conditions of Approval. Additionally, Ms. Tran clarified a correction to Conditions of Approval items number 11, 12, 14, 15, and 16 as it reads “prior to the issuance of final building permits” and has been corrected to read as “prior to the recordation of the parcel map.” She concluded that the staff is recommending approval of the application. Applicant Sumeet Srivastava, on behalf of 716 Orchid Development LLC, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the project as proposed. Action: Approved as Amended ITEM NO. 3 Bay Shores Hotel Lot Merger (PA2022-139) Site Location: 1800 and 1806 West Balboa Boulevard Council District 1 Makana Nova, Senior Planner, provided a brief project description stating that the proposed lot merger would consolidate four underlying parcels for the existing Bay Shores Hotel. The project also includes an interior and exterior renovation of the motel, where no change to the existing 25-key count is proposed, roof decks would MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 10/13/2022 Page 2 of 2 be added/expanded, and a new stair and elevator access is proposed. The land use for the fourth parcel on the project site was changed to a commercial General Plan and Zoning land use in 1998, however, the accompanying land use maps were never updated to match this entitlement. The General Plan, Coastal Land Use Plan, Zoning Code, and Local Coastal Program land use maps will be updated to match these entitlements in the upcoming General Plan Land Use Element update. Public improvements are not triggered as part of a lot merger and no change in land use density/intensity is proposed that would trigger the requirement for a coastal development permit under the proposed lot merger. The project qualifies for a CEQA exemption under Class 5 (Minor Alterations in Land Use Limitations). Ms. Nova closed her statement by summarizing that one public inquiry was received asking about the scope of the proposed motel remodel. Applicant Christian Kessler of Advanced Civil Group, on behalf of the Bay Shores Hotel, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the lot merger as proposed. Action: Approved ITEM NO. 4 DISH Wireless Coastal Development Permit (PA2021-301) Site Location: 2865 (CS) East Coast Highway Council District 6 Action: Removed from Calendar. VI.
