Arlington Rd., Akron, OH 44312 RE: 1 Park Newport Drive, Newport Beach, CA 92660 APN No: 440-251-05 Dear Dawn Carrington: The above referenced property is currently located within the PC7 (Park Newport – UP1412, UP1557 Zoning District) and designated as RM (Multiple Residential) within the Land Use Element of the General Plan. The property is not located within a Planned Unit Development or an overlay district. However, the property is located within the Coastal Zone. Excerpts from the Municipal Code and General Plan are attached for your information. The properties abutting the subject parcel to the north, south, east and west are located within the PC7 (Park Newport – UP1412, UP1557) Zoning District and the General Plan land use designation is RM (Multiple Residential). At the time the building permits were finaled, the building and parking requirements were in substantial conformance with the development standards of the City of Newport Beach Municipal Code. If the subject property does not comply with the current regulations, it is considered to be nonconforming and is subject to Chapter 20.38 (Nonconforming Uses and Structures) of the Newport Beach Municipal Code. The development regulations for the site were established by Use Permit No. UP1412, which was originally approved December 5, 1968, and amended in October 18, 1973, by the Newport Beach Planning Commission. Enclosed is a copy of the associated Planning Commission minutes, which list the required conditions of approval. Also included is a copy of Use Permit No. UP2001-003 Page 2 Zoning Compliance - PA2022-0305 Tmplt: 08-15-176 (PA2001-023) approved February 23, 2001, by the Planning Director, which allowed a minor change to the site plan of Use Permit No. UP1412. During the development review plan check process and at the time the building permits were finaled, the project was determined to be in compliance with the conditions of approval specified in Use Permit No. UP1412 and the Newport Beach Municipal Code (NBMC). Research of the permit and entitlement history of the property verifies that discretionary approvals were acquired from the City of Newport Beach Planning Division for development of the property. With the exception of the discretionary approvals for signs, copies of those approvals are attached. Please contact the Planning Division for further details on any discretionary application: • Use Permit No. UP1412 Approved by the Planning Commission on December 5, 1968, to allow for 1304 dwelling units and additional ancillary facilities (recreation building, convenience shopping, etc.). • Use Permit No. UP1557 Denied by the Planning Commission on October 21, 1971, to allow for the temporary use of 11 pennant flags (2’ x 4’) with a maximum height of 15’2” in conjunction with the promotional phase of Park Newport. • Use Permit No. UP1608 Conditionally Approved by the Planning Commission on July 6, 1972, to remove temporary constructions signs, permit the installation and maintenance of a temporary sign until October 1, 1972, and remove temporary leasing signs by October 1, 1972. • Use Permit Amendment UP1412 Approved by the Planning Commission on October 18, 1973, to convert existing model apartments to transient apartments, install a film shop in the recreation area, and install an additional tennis court. • Use Permit Amendment UP1412 Withdrawn from Planning Commission agenda on July 23, 1998, to replace an existing monument sign that will amenity information to the sign, which the previous use permit did not expressly permit. • Telecommunication Permit No. TP2009-013 (PA2009-165) Approved by City Hall on September 28, 2010, to allow a telecommunications facility at the subject site. • Use Permit No. UP2001-003 (PA2001-023) Approved by the Planning Director on February 23, 2001, to allow for a minor change to the site plan of Use Permit No. 1412 related to the ancillary Page 3 Zoning Compliance - PA2022-0305 Tmplt: 08-15-176 uses associated with the apartment complex, in particular the expansion of a fitness facility to add 892 square feet. The links to these discretionary applications are provided in the attachments list shown below. The subject property does not have any active complaints on record.
