TERMS AND CONDITIONS OF ENCROACHMENT PERMIT
1 Encroachment Permits may be taken out by the owner of benefited property or a licensed contractor A licensee
contractor must provide a "Letter of Authorization" to allow another party to pull a permit An approved copy of the
permit and construction plan shall be kept at the job site at all times Work, which has been done prior to issuance of
a permit, is subject to rejection/fine City reserves the right to void permit if work does not commence within 30 days
after date of issuance
2 The Permittee agrees to defend, indemnify and hold the City, its authorized agent, offices, representatives and
employees harmless -from any responsibility, liability, suit or action of any description arising out of any accident, loss
or damage to persons or property occurring as a result of work undertaken under this permit
3 All work shall be done in accordance with the approved plans, Standard Special Provisions and Standard Drawings
of the City of Newport Beach, and in compliance with all applicable State laws and City ordinances

HOLD HARMLESS STATEMENT
I understand that I am locating minor encroachments within the City Right-of-
Way/Easement. As property owner it is my responsibility to maintain the
encroachments. I will be responsible for replacing the improvements if the City
removes them for maintenance of utilities or other public need. I shall indemnify
and hold the City harmless for any liability associated with the minor

2018 BLANKET ENCROACHMENT PERMIT

GENERAL
Per Section 13.20.080, Subsection C, of the City Municipal Code, the Public Works
Director is issuing a Blanket Encroachment Permit to the above named Utility Company.
This Blanket Encroachment Permit, referred to as "Permit", will be valid from January 1,
2018 to December 31, 2018. All work covered under this Permit shall start and terminate
within said time period unless dates are modified by the City.
The Utility Company to which this Permit is issued will be referred to as "Utility" and their
authorized contractors will be referred to as "Contractor".
The Utility and Contractor shall comply with all terms and conditions of the Permit and the
additional terms and conditions listed in Exhibit "A" of this document, the requirements of
Chapter 13.20 of the City Municipal Code, City Council Policies, and City Standard Special
Provisions and Drawings. Failure to comply with these items may result in work stoppage
and/or revocation of this Permit.
The City reserves the right to modify and/or revise all or a portion of this Permit and will
provide the Utility a thirty (30) day notice of any changes to this Permit.
WORK TO BE COVERED UNDER PERMIT
The work to be covered under this Permit includes the following:
1. Excavations for utility service connections.
2. Excavations for the location of trouble in utility conduits or pipes and for making
repairs thereto.
3. Emergency Work which is defined as any repair work activity that requires
immediate attention which will result in disruption in continuous utility service
and/or risk of life and property.
4. Non -excavation maintenance work of existing facilities.
The City will have final determination whether the proposed work will be covered by this
Permit or will require a separate encroachment permit.
PROCEDURE
In general, the Utility shall notify the City a minimum of 24-hours in advance of all
construction work to be completed under this Permit. Utility shall provide the City with
pertinent information with regards to the work to be completed under this Permit such as
drawings, standards, traffic control plans, start and completion dates, contractor
information, 24-hour contact information, etc. This information can be submitted to the
City by fax, mail, e-mail, or dropped off at the Permit Center in City Hall. The City will
review the submittals to determine if the work will be covered under this Permit or will
require a separate encroachment permit and if any additional items will be required to be
submitted.
Upon request from the City, Utility shall provide a periodic activity report of work performed
under this Permit for the purpose of final inspection and closure. All trench restoration
work will need to be inspected. Work will be considered complete after permanent paving
repairs have been completed.
FEES
Per Section 13.20.080, Subsection C, of the City Municipal Code, Utility shall be
responsible for all fees related to this Permit. In general, the fees to be charged under
this Permit include a Permit processing fee, inspection fees for trench restoration work
(temporary and permanent), traffic control, etc., and plan checking fees. Currently, the
Permit processing fee is $241 and the inspection and plan checking fees are $165 per
hour and may be subject to change. City shall periodically bill the Utility for inspections
performed for work completed under this Permit.
INDEMNIFICATION
The Utility agrees to defend, indemnify and hold the City, its authorized agent, officers,
representatives and employees harmless from any responsibility, liability, suit or action of
any description arising out of any accident, loss or damage to persons or property
occurring as a result of work undertaken under this Permit.
ACKNOWLEDGEMENT
The Utility has read and reviewed all terms and conditions of this Permit, all pertinent City
ordinances and policies, and Underground Service Alert requirements and agrees to
comply and be bound by all the terms, conditions, and provisions in this document.

EXHIBIT "A"
ADDITIONAL TERMS AND CONDITIONS
This Permit will have these additional terms and conditions as well as those stated on the Permit
and the requirements of Chapter 13.20 of the City Municipal Code. In the event of a discrepancy,
the City shall make the final determination over the terms and conditions to this Permit.
GENERAL REQUIREMENTS:
1. A minimum of 24-hour notice shall be provided to the City prior to performing any work
under this Permit. Any work performed without prior approval/notification is subject to
rejection and/or immediate Permit revocation and work stoppage.
2. Contractor performing the construction work under this Permit shall have a City Business
License in addition to the required State Contractor's License and Workers Compensation
Insurance.
3. All restoration work for jobs under this Permit shall be guaranteed for a period of one (1)
year.
4 Emergency Work
• During Business Hours (generally defined as Monday to Friday from 7:30 am to
5:30 pm) - The Utility shall immediately notify the Public Works Department at (949)
644-3311 of any Emergency Work to be performed in the public right-of-way.
• During Non -Business Hours - The Utility shall notify the City's Police Department
Dispatch at (949) 644-3717 of any Emergency Work to be performed in the public
right-of-way.
5. Where Utility work will be affecting non-standard private encroachments in the public right-
of-way, Utility shall make arrangements with the affected property owner(s) for repair or
replacement of the non-standard private encroachments.
6. Streets and alleys with moratoriums on excavations will require additional pavement
restoration per City Standards and/or as determined by the Public Works Inspector. For
street moratorium status, contact the Public Works Department at (949) 644-3311 or
check the City's website at www newportbeachca.gov.
7. Utility and/or Contractor shall be responsible for protection of all excavations during non -
construction hours. Non-skid steel trench plates shall be used. Steel trench plates may
be required to be recessed. Temporary pavement shall be maintained by the Utility and/or
Contractor until permanent paving is placed. Final pavement restoration shall be
completed 10 days after completion of Utility work.
8. Work within beach sensitive areas including but not limited to the West Newport area,
Balboa Peninsula, Balboa Island, and the Corona Del Mar area (East Coast Highway
between Jamboree Road and Newport Coast Drive, Bayside Drive, Fernleaf Avenue
ramp, Ocean Boulevard, and Marguerite and Poppy Avenues south of East Coast
Highway) shall be allowed at the discretion of the City on a case by case basis during the
following periods:
• March 19, 2018 to April 20, 2018 — Spring Break
• May 25, 2018 to September 10, 2018 — Summer months
• December 17, 2018 to January 2, 2019 — Holiday season
9. Utility shall coordinate all activities under this Permit with the City and all other contractors
working within the vicinity. All City projects shall take precedence over Utility's work.
10. Coordinate all City street sweeping with the City's Municipal Operations Department,
Operations Support Division at (949) 718-3481. Should City street sweeping be restricted
at any construction location, Utility and/or Contractor shall provide street sweeping in said
location to the satisfaction of the City.
TRAFFIC REQUIREMENTS:
1. Traffic Control Plans
• Major Streets — For a Major Street identified in Table 1, a traffic control plan shall
be submitted and approved by the City for all work performed under this Permit.
The traffic control plan shall be prepared in accordance with the latest edition of
the Work Area Traffic Control Handbook (WATCH) and/or the California Manual
on Uniform Traffic Control Devices (CA MUTCD) and shall be prepared by a
California Registered Professional Civil Engineer. Under the discretion of the City
Traffic Engineer, traffic control plans may be required to be prepared by a
California Registered Professional Traffic Engineer.
• All Other Streets — Traffic control plans are not required unless requested by the
City. Traffic control shall adhere to the latest edition of the WATCH.
2. Temporary No Parking Zones
If a temporary No Parking zone is required for the work covered under this permit:
• Utility and/or Contactor shall submit a Temporary Street Closure permit application
and obtain City -issued temporary No Parking signs. Utility and/or Contractor shall
be responsible for the cost of the temporary No Parking signs which currently cost
$0.80 per sign.
• Utility and/or Contractor shall post temporary No Parking signs at the work site a
minimum of 48-hours in advance to the start of work.
• Utility and/or Contractor shall contact the City's Police Department Parking Control
Division at (949) 644-3717 for temporary No Parking sign posting verification for
enforcement.
3. Utility and/or Contractor shall notify the City if their work will affect any traffic signal and/or
traffic signal loops detectors. Contractor shall be responsible for replacing traffic signal
loops damaged as a result of the construction work within 72-hours of completion of
permanent pavement repairs. Replacement of traffic signal loop detectors shall be
coordinated with the Traffic Engineering Division.
4. Contractor shall be responsible for replacement of roadway striping and markings
removed during construction. At the discretion of the City, the Contractor may be required
to install temporary striping within 24-hours of its removal.
