Project application details are included here below and in the various required attachments. Project Site Plans Project Description: The proposed scope of work involves the installation of a new unmanned rooftop wireless facility on an existing 48’ tall building. The proposed facility will consist of three fully screened sectors of antennas (six antennas total) in three unique locations on this building rooftop. Equipment cabinets will be contained within a new 5’x7’ location behind screening. Each sector of antennas will contain up to four remote radios (RRU) for a total of 12 RRUs. The proposed installation is fully screened to match the existing Verizon Wireless facility on site. With the use of FRP screening, this site will mimic existing building texture and be absent from public view. PA2022-0268 City of Newport Beach October 25, 2022 Page 2 of 3 Use Permit Justification & Findings: Chapter 20.52 of the Zoning Code authorizes the Planning Commission or the Hearing Officer to approve, conditionally approve, or disapprove applications for a Conditional Use Permit; and the Zoning Administrator to approve, conditionally approve, or disapprove applications for a Minor Use Permit. To approve or conditionally approve a use permit, the hearing body must make the following findings provided by Section 20.52.020 F. 1. The use is consistent with the General Plan and any applicable specific plan. This proposal is consistent with the General Commercial/J2 Land Use designation for commercial uses. 2. The use is allowed within the applicable zoning district and complies with all other applicable provisions of this Zoning Code and the Municipal Code. This project proposal is allowable in the General Commercial/J2 zoning district with the approval of a Conditional Use Permit. The GC/J2 zone is intended to provide a range of neighborhood-serving retail and service uses along street frontages that are located and designed to foster pedestrian activity. Our project will not limit that intent. 3. The design, location, size, and operating characteristics of the use are compatible with the allowed uses in the vicinity. The project design is integrated into the design of the building and is completely absent from public view. Rooftop wireless sites exist in general commercial zones throughout the city and are compatible with typical commercial building activities and uses. 4. The site is physically suitable in terms of design, location, shape, size, operating characteristics, and the provision of public and vehicle (e.g., fire and medical) access and public services and utilities. The rooftop wireless facility easily blends into the surrounding aesthetic, the rooftop equipment will be screened from view and match other similar screen walls in terms of massing and bulk. The site will operate 24/7/365 but will be a silent and unobtrusive rooftop tenant. The site will not impact public services, public utilities, or any form of vehicular access. 5. Operation of the use at the location proposed would not be detrimental to the harmonious and orderly growth of the city, or endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, safety, or general welfare of persons residing or working in the neighborhood of the proposed use. The proposed project is like many prior projects approved in the City of Newport Beach and will not create any hazard and negative impact on public health, safety, etc. The provision of wireless communications is widely regarded as a benefit to PA2022-0268 City of Newport Beach October 25, 2022 Page 3 of 3 public health and safety and improves the general welfare of communities by enhancing communication options for mobile and stationary users of voice and data technologies.
