TITLE: Confirmation of Citizen Appointments to the Finance Committee
ABSTRACT:
Membership on the Finance Committee includes seven members, three Council
Members appointed by the Mayor, and four citizen members appointed by the Council
Members not on the Finance Committee, subject to confirmation by the City Council.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Confirm Council Member Brad Avery's appointment of Nancy Scarbrough, Council
Member Robyn Grant's appointment of Keith Curry, and Council Member
Lauren Kleiman's appointment of Allen Cashion to serve on the Finance Committee
until June 30, 2023.
DISCUSSION:
Subject to confirmation by the City Council, the Finance Committee consists of seven
members: three Council Members appointed by the Mayor and four citizen members
appointed by the Council Members not on the Finance Committee.
Council Member Joe Stapleton served as a citizen member on the Finance Committee
from February 2017 until his election to the City Council. In anticipation of him no longer
being able to serve as a Finance Committee citizen member since he is a Council Member
and pursuant to the Maddy Act and City Council Policy A-2 (Boards, Commissions and
Committees), the City Clerk posted the Notice of Vacancy on Wednesday, December 14,
2022, in the City Clerk's Office, at the Central Library, on the digital bulletin board in the
City Council Chambers, and on the City of Newport Beach website, and published the
notice in the Daily Pilot on Saturday, December 17, 2022. As per the notice, applications
were accepted by the City Clerk's Office until noon on Wednesday, January 4, 2023.

On January 10, 2023, Mayor Noah Blom appointed himself, Mayor Pro Tern Will O'Neill
(Chair), and Council Member Stapleton as the three Council Members seated on the
Finance Committee. Council Member Stapleton's appointment as a Council Member on
the Finance Committee created a citizen member vacancy and changed Council Member
Brad Avery's position as a Council Member on the Finance Committee to a Council
Member that appoints a citizen member.
Council Member Avery requests Council confirmation to have Nancy Scarbrough serve
as his citizen appointee to the Finance Committee. She was initially appointed by former
Council Member Joy Brenner in June 2021 and served as her citizen appointee. Council
Member Avery's appointment of Ms. Scarbrough creates a citizen appointee vacancy for
Council Member Lauren Kleiman.
Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk posted a second
Notice of Vacancy on Wednesday, January 4, 2023, in the City Clerk's Office, at the
Central Library, on the digital bulletin board in the City Council Chambers, and on the City
of Newport Beach website, and published the notice in the Daily Pilot on Saturday,
January 7, 2023. As per the notice, applications were accepted by the City Clerk's Office
until noon on Wednesday, January 18, 2023, or until filled.
Following a review of the applications, Council Member Kleiman desired to appoint
Allen Cashion to serve on the Finance Committee until June 30, 2023.
On January 20, 2023, John Reed resigned from his position on the Finance Committee.
He was appointed by former Council Member Kevin Muldoon as his citizen appointee in
February 2019.
Pursuant to the Maddy Act and City Council Policy A-2, the City Clerk posted a third
Notice of Vacancy on Wednesday, January 25, 2023, in the City Clerk's Office, at the
Central Library, on the digital bulletin board in the City Council Chambers, and on the City
of Newport Beach website, and published the notice in the Daily Pilot on Saturday,
January 28, 2023. As per the notice, applications were accepted by the City Clerk's Office
until noon on Wednesday, February 8, 2023, or until filled.
Following a review of the applications, Council Member Grant desired to appoint
Keith Curry to serve on the Finance Committee until June 30, 2023
The appointments of Allen Cashion, Keith Curry and Nancy Scarbrough require Council
confirmation.
It should be noted that the annual appointments for the four citizen members on the
Finance Committee, including Council Members Avery, Grant, and Kleiman's
appointments, are scheduled to occur at the end of fiscal year 2022-2023 (June 30, 2023).
The process to fill the vacancies is provided in Resolution No. 2017-58, City Council
Policy A-2, and the Maddy Act, and the vacancies will be noticed according to City Council
Policy A-2 and the Maddy Act.

FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

would like to serve on the Finance Committee. I have followed City functions for several years, I have
participated in City Council meetings, Planning Commission meetings, all of the General Plan update meetings
and Workshops for the Housing and Circulation Elements. I attended most of the Finance Committee meetings
for the last 4-6 months. 1 have attended the Airport committee meetings, the Harbor Commission meetings, the ,
meetings and Study sessions for just about every City function offered.

learn more about fund accounting and am eager to participate in city leadership. 1 have a strong leadership
