TITLE: Resolution No. 2023-10: Dissolving the Affordable Housing Task
Force
With the full City Council engaged in the General Plan Update and implementing the
certified Housing Element, this task force is no longer needed.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2023-10, A Resolution of the City Council of the City of Newport
Beach, California, Dissolving the Affordable Housing Task Force.
DISCUSSION:
At the March 14, 2000 City Council meeting, the City Council established the Affordable
Housing Task Force by adopting Resolution No. 2000-27, and extended it pursuant to
Resolution Nos. 2001-9, 2002-20, and 2003-13 at the February 13, 2001; February 26,
2002; and February 25, 2003 City Council meetings, respectively. The Affordable Housing
Task Force was created to identify, evaluate and implement affordable housing projects
to satisfy community needs and achieve regional housing goals.
Since the middle of 2020, City of Newport Beach (City) staff and its consultant team
worked with the Housing Element Update Advisory Committee (HEUAC), Planning
Commission, City Council, and the community to prepare an update to the Housing
Element. On September 13, 2022, the Newport Beach City Council adopted the 6th Cycle
Housing Element for the 2021-2029 planning cycle in response to the Regional Housing
Needs Assessment (RHNA) allocation of 4,845 new affordable housing units for Newport
Beach.

On October 5, 2022, the City received a letter from the Department of Housing and
Community Development, certifying the City's Housing Element as being in full
compliance with State Housing Element Law. Since the City continues to work on the
Housing Element implementation, and with the full City Council engaged in the General
Plan Update, the Affordable Housing Task Force is no longer needed.
Resolution No. 2023-10 is attached hereto as Attachment A and disbands the Affordable
Housing Task Force.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, DISSOLVING THE
AFFORDABLE HOUSING TASK FORCE
WHEREAS, on March 14, 2000, the City Council of the City of Newport Beach
("City Council") adopted Resolution No. 2000-27, establishing the Affordable Housing
Task Force ("Task Force") for a term of one year;
WHEREAS, the Task Force was formed to identify, evaluate and implement one
or more affordable housing projects to address the affordable housing needs in Newport
Beach;
WHEREAS, the City Council extended the term of the Task Force pursuant to
Resolutions Nos. 2001-9, 2002-20, and 2003-13;
WHEREAS, pursuant to California Government Code Section 65580 et seq.
("State Housing Element Law"), the California Department of Housing and Community
Development ("HCD") adopted its 6th Cycle Regional Housing Needs Determination
("RHND") in 2019 for the 2021-2029 planning period, identifying a need for additional
affordable housing units within the regional jurisdiction of the Southern California
Association of Governments ("SCAG"), which includes the.City of Newport Beach ("City");
WHEREAS, in 2020, SCAG adopted its 6th Cycle Regional Housing Needs
Assessment ("RHNA"), which allocated 4,845 housing units to the City for the 2021-2029
planning period;
WHEREAS, City staff, consultants, Planning Commission, and the City Housing
Element Update Advisory Committee ("HEUAC"), developed the 6th Cycle Housing
Element for the 2021-2029 planning period ("6th Cycle Housing Element");
WHEREAS, on September 13, 2022, the City Council adopted the 6th Cycle
Housing Element in accordance with State Housing Element Law;
WHEREAS, HCD certified the City's 6th Cycle Housing Element on October 5,
2022, as compliant with State Housing Element Law; and
WHEREAS, the entire City Council is focused on issues related to affordable
housing and the Task Force is no longer necessary at this time.

NOW, THEREFORE, the ,City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby repeal Resolutions Nos. 2000-27,
2001-9, 2002-20, and 2003-13 and dissolves the Affordable Housing Task Force.
Section 2: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 3: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 4: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the California Code of Regulations, Title 14, Division 6, Chapter 3 ("CEQA Guidelines")
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 5: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
