TITLE: Appointments of Planning Commissioners to Fill Unscheduled
Vacancies
ABSTRACT:
Due to Planning Commissioners Lauren Kleiman and Erik Weigand being elected to the
City Council, the City Council has the opportunity to fill the vacant positions pursuant to
the City Charter, City Council Policy A-2 (Boards, Commissions and Committees), and
the Maddy Act.
RECOMMENDATIONS:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or indirectly;
and
b) Appoint Brady Barto, Jonathan Langford, Ekta Naik, David Salene, or Debbie Stevens
to fill the two vacancies on the Planning Commission, and determine who will receive
the terms that expire on June 30, 2024 and June 30, 2025.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Lauren Kleiman was appointed to the Planning Commission in 2017 and Erik Weigand
was appointed in 2015. Both Planning Commissioners were elected to the City Council
during the 2022 General Municipal Election and, therefore, can no longer serve on the
Planning Commission.
In compliance with City Council Policy A-2 and the Maddy Act, the City Clerk prepared
and posted a Notice of Vacancies on Wednesday, December 14, 2022, in the City Clerk's
Office, at the Central Library, on the bulletin board in the City Council Chambers, and on
the City of Newport Beach website. In addition, the Notice of Vacancies was published in
the Daily Pilot on Saturday, December 17, 2022. As per the Notice, applications were
accepted by the City Clerk's Office until noon on Wednesday, December 28, 2022.

Following policy guidelines, Mayor Noah Blom appointed himself, Mayor Pro Tern
Will O'Neill, and Council Member Lauren Kleiman to the Ad Hoc Appointments
Committee. At the conclusion of the application period, the applications were forwarded
to the Ad Hoc Appointments Committee for its review and scheduling of interviews.
Interviews were conducted on Monday, January 23, 2023.
Based upon the interviews, the Ad Hoc Appointments Committee recommends the
nomination of Brady Barto, David Salene, Debbie Stevens, Ekta Naik, and Jonathan
Langford. Copies of their applications are attached hereto as Attachment A.
Appointment Process
Pursuant to City Council Policy A-2, appointments to the Planning Commission will take
place in the following manner:
A. The City Council will vote on all appointments simultaneously. The voting will be
done by paper ballot and the City Clerk will tabulate and announce the results,
including the vote tally.
B. Each member of the City Council will cast two votes on the paper ballot. To be
appointed, an applicant must receive at least four votes.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING -
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

As a lifelong resident of Newport Beach, I have a strong appreciation for the distinct villages that make our community the greatest place to

I have lived all over Newport Beach — from CDM to the Peninsula to Dover Shores. I have
always marveled at how each area has its own personality, with unique opportunities for
recreation, dining, shopping, wandering, etc. and I have tried my best to enjoy them all I I
As my business interests are winding down, i hope to be able to get more involved in our great
city, be it on committees, groups, boards or wherever I can best serve. I would be thrilled and
honored to assist the city on the Planning Commission to make sure responsible, well -
conceived and appropriately designed projects are presented to the Council for consideration.
I believe I am especially qualified for the position based on my real estate career for the last 30
years. As a residential land developer, I have processed thousands of units and stood in front
of many planning commissions throughout So Cal. I am very familiar with the policies,
procedures and responsibilities of the Planning Commission as wetl as the Subdivision Map Act,
General Plans, local ordinances etc. i short, I can hit the ground running.

As part of my professional career, i work for Environmental Audit, Inc., which provides environmental consulting services for a
variety of clients. Most of the clients that I currently represent are heavy industrial facilities (e.g., refineries, port facilities, marine
terminals, pipelines, etc.) that do not have facilities in Newport Beach; school districts (not including Newport -Mesa); and air
districts (South Coast Air Quality Management District and Bay Area Air Quality Management District). We do not currently

I have been an environmental consultant for over 39 years and have extensive experience in planning and environmental compliance. My
education and work experience have provided a broad experience in planning and the environmental field, specifically preparing
documents in compliance with the California Environmental Quality Act (CEQA) since 1984, compliance with land use/air quality rules and
regulations, preparing health risk assessments, preparing coastal development permits, and hazardous waste compliance. I have
represented clients before the California Coastal Commission, as well as Environmental Commissions, Manning Commissions and City
Councils in various jurisdictions. I have recently worked on the Newport Beach General Plan and Housing Element Updates which
provided insight into changes in rules, regulations, plans, etc. that have or will occur shortly in Newport Beach, changing the way that the
City needs to evaluate projects. This experience would be helpful on the Newport Beach Planning Commission. I recognize the
importance and the challenges of the Planning Commission in Newport Beach and it would be an honor to serve an the Commission.
